HomeMy WebLinkAboutOrdinance #2684 ORDINANCE NO. 2684 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH MUNICIPAL CODE BY ADDING THERETO NEW CHAPTER 12. 10 ENTITLED, "STANDARD SPECIFICATIONS FOR PUBLIC WORKS CON- STRUCTION," 1982 EDITION The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Municipal Code is hereby amended by adding new Chapter 12. 10 entitled, "Standard Specifications for Public Works Construction, " to read as fol- lows : 12. 10. 010 Adoption of standards . There is hereby adopted by the city council certain standard specifications known as the Standard Specifications for Public Works Construction, 1982 edi- tion, and the whole thereof, including all supplements and amend- ments, of which standard specifications not less than three (3) copies have been and are now on file in the office of the city clerk of the city of Huntington Beach. Such standard specifica- tions are hereby adopted and incorporated pursuant to Government Code sections 50022. 2 et seq. for the purpose of providing just , equitable , objective and practicable standard specifications whereby administrative procedures, construction materials, con- struction methods and requirements shall be established for all public works construction, and from the date on which this chapter takes effect, the provisions thereof shall be controlling within the corporate limits of the city of Huntington Beach. 12. 10. 020 Administration. The director of public works, or his duly appointed representative , is hereby authorized and di- rected to enforce the standard specifications as herein adopted or as may be amended hereafter from time to time. i 12. 10. 030 Application. The provisions of the standard speci- fications, together with adopted standard plans of the department of public works, adopted by resolution of the city council, shall apply to all existing or new public works construction. Such standard specifications shall also apply whenever there exists, in the opinion of the director of public works, any condition which constitutes an active or immediate hazard to life, limb , ahb 2/7/84 1. health, property, safety or the general welfare of the public. SECTION 2. The provisions of this ordinance insofar as they are substantially the same as existing provisions of the Huntington Beach Municipal Code relating to the same subject matter shall be construed as restatements and continuations and not as new enactments . SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of com- petent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Huntington Beach hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, or portions thereof, and amendments thereto, ir- respective of the fact that any one or more sections , subsections, sentences, clauses, phrases or portions, or amendments be declared invalid or unconstitutional. SECTION 4. This ordinance shall take effect thirty days after its adoption.
