ORDINANCE NO. 2705
AN URGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH
ENACTING A ZONING MORATORIUM ON FORTUNETELLING BUSINESS.
WHEREAS, the City Council of the City of Huntington Beach
ordains as follows :
SECTION 1 . Fortunetelling, as defined herein, is hereby
prohibited within the city during the term of this interim
ordinance and any extensions thereof.
"Fortunetelling, " as used in this ordinance, shall include
astrology, palmistry, phrenology, lifereading, fortunetelling,
cartomancy, clairvoyance , clairaudience , crystal gazing, medium-
ship, spirit photography, spirit writing, spirit voices, spirit
materialization, etherealization, prophecy, augury, divination,
magic, necromancy, fortunetelling by handwriting analysis, or
other similar business or act.
SECTION 2. This interim ordinance is adopted as an urgency
measure to prohibit any uses which may be in conflict with a
contemplated zoning proposal concerning fortunetelling which the
legislative body, planning commission, or development services
department, is considering or studying or intends to study within
the term of this ordinance . This ordinance shall be of no further
force and effect forty-five ( 45) days from the date of its
adoption unless extended pursuant to Government Code
Section 65858.
SECTION 3. The city council finds that there is a current
and immediate threat to the public health, safety, or welfare, and
that the approval of additional subdivisions, zonings, land use
permits, variances, building permits, or any other applicable

entitlement for use which is required in order to comply with the
zoning ordinance would result in a threat to public health,
safety, or welfare, in that the city is currently considering
repealing an existing ban on fortunetelling and there is no exist-
ing zoning regulation for the location and standards applicable to
fortunetelling businesses; the unregulated establishment of
fortunetelling businesses within the city would result in a threat
to public health, safety, or welfare; and a reasonable time is
needed for the city to study appropriate zoning classifications
and regulations for fortunetelling businesses .
SECTION 4. This ordinance shall require five (5)
affirmative votes and shall take effect immediately upon adoption .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 4th
day of June 1984.
