HomeMy WebLinkAboutOrdinance #2709 ORDINANCE NO. 2709 AN URGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH MUNICIPAL CODE BY REPEALING SECTION 14 .12. 080; BY AMEND- ING SECTIONS 14 . 12. 040 AND 14 .12.050; AND BY ADDING THERETO NEW SECTION 14 .12 . 045, ALL RE- LATING TO WATER RATES The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. Section 14 .12. 080 of the Huntington Beach Municipal Code is hereby repealed. SECTION 2 . The Huntington Beach Municipal Code is hereby amended by amending sections 14. 12 . 040 and 14 .12 . 050 to read as follows : 14 .12 . 040 Water rates--Designated. The water rates to be charged monthly and collected monthly or bimonthly, as may be determined by the city, from consumers of water supplied by the city, are established and the water department is authorized and directed to charge and collect the same as follows: Domestic , Commercial and Industrial Service Quantity rates First 500 cu. ft . or less $4.00 Over 500 cu. ft. , per 100 cu. ft . $0.41 Minimum Charges Size of service Minimum charge per month Water in cu.ft. 5/8" or 3/4 : $ 4 . 00 500 1" $ 6. 80 1,000 1-1/2" $ 9. 50 1,500 2" $ 12. 50 2,000 3" $ 31. 00 5,000 4" $ 55. 50 9,000 6" $110. 00 18,000 8" $157. 50 26, 000 10" $210. 00 35,000 GH:ahb 6/12/84 1. i A charge of one dollar ($1) shall be made for each unit in excess of one connected to each meter. "Unit" means any building or a portion of a building consist- ing of one or more rooms separated from the rest of the build- ing by a partition, occupied independently of the other parts of the building, or another building. The above water rates, plus a 10 percent surcharge, shall be applicable to areas outside the boundaries of the city of Huntington Beach, wherever the city serves water, including Sunset Beach, an unincorporated area, and Surfside, located within the city of Seal Beach. 14 .12 .050 Water rates---Construction purposes. All construc- tion water shall be taken from existing outlets designated by the water department or from special outlets installed at the ex- pense of the consumer. If in the determination of the water de- partment, the setting of a meter is impracticable or uneconomical for the supply of construction water, the charge for such un- metered water shall be as follows : (a) Housing tracts or subdivisions will be charged a flat rate of twelve dollars ($12) per unit during construction. (b) For miscellaneous uses not herein specified, the quantity of water shall be estimated by the water department and charged at the quantity rate in effect at the time the estimate is prepared. SECTION 3. The Huntington Beach Municipal Code is hereby amended by adding thereto new section 14.12 . 045 to read as fol- lows : 14 12 . 045 Water rates--Budget . It shall be the policy of the city that a balanced budget shall be maintained for the water fund. Pursuant to section 602 of the Charter of the city of Huntington Beach, the city administrator shall be required to submit said water fund budget in a balanced condition to the city council, together with the other budget submittals. The water rate adjustment necessary to maintain a balanced budget shall be incorporated as part of the annual budget which shall modify the rates as set forth in section 14 .12 . 040 of the Huntington Beach Municipal Code upon adoption of the budget. For the purpose of this section, "balanced budget" shall mean that total appropriations for operating expenses do not exceed total estimated revenues in the annual budget of the water fund. Operating expenses shall include appropriations for the de- 2. preciation cost of those capital improvements customarily pro- vided for in the operating budget and in accordance with gen- erally accepted accounting principles. Revenues shall exclude bond proceeds, if any, but include interest earnings and other nonoperating revenue in accordance with generally accepted ac- counting principles. Any budget surplus realized as a result of actual revenues exceeding actual expenditures shall be used for emergency re- serves or for capital improvements and shall not be used for general operations. SECTION 3. The city declares that this ordinance is an urgency measure necessary for the immediate preservation of the public peace, health, or safety in order to insure that adequate supplies of clean, potable water continue to be available to the citizens of Huntington Beach. SECTION 4. This ordinance shall take effect immediately after its passage .
