AN URGENCY ORDINANCE OF THE CITY OF HUNTINGTON
BEACH EXTENDING ZONING MORATORIUM ON FORTUNE-
TELLING BUSINESSES
WHEREAS, on June 4 , 1984 the City Council of the City of
Huntington Beach adopted Ordinance No, 2705 to place a forty-
five (45) day moratorium on fortunetelling businesses so that
appropriate zoning regulations and standards for locating
such businesses could be formulated; and
The City Council finds it necessary to extend such mora-
torium in order to allow the Department of Development Services
and the Planning Commission to complete their research and rec-
ommendation for an ordinance regulating the zoning and conduct
of such f'ortunetelling businesses; and
Notice and public hearing having been held thereon,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does ordain as follows :
SECTION 1. The moratorium heretofore placed on zoning
regulations for the location of and standards applicable to
fortunetelling businesses is hereby extended for 10 months and
15 days, pursuant to Government Code section 65858, to provide
sufficient time for the Department of Development Services and
the Planning Commission to complete their research, and rec-
ommend to this Council an ordinance to establish and regulate
the location of fortunetelling businesses in Huntington Beach.
SECTION 2. The City Council finds that there is a current
and immediate threat to the public health, safety, or welfare, and
that the approval of additional subdivisions , zonings, land use
permits, variances, building permits, or any other applicable
entitlement for use which is required in order to comply with

the zoning ordinance would result in a threat to public health,
safety, or welfare, in that the city is currently considering
repealing an existing ban on fortunetelling and there is no ex-
isting zoning regulation for the location and standards appli-
cable to fortunetelling businesses; the unregulated establish-
ment of fortunetelling businesses within the city would result
in a threat to public health, safety, or welfare ; and a rea-
sonable time is needed for the city to study appropriate zoning
classifications and regulations for fortunetelling businesses.
SECTION 3. This ordinance shall take effect immediately
and in accordance with Government Code section 65858, shall be
of no further force and effect 10 months and 15 days from the
date of its adoption. The City Clerk shall certify to the pas-
sage of this ordinance and shall cause same to be published
within fifteen days of 'its adoption in the Huntington Beach
Independent , a newspaper of general circulation.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on thel6th
day of July, 1984 .
