HomeMy WebLinkAboutOrdinance #2745 ORDINANCE NO. 2745 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 TO PROVIDE FOR CHANGE OF ZONING FROM OFFICE PROFESSIONAL DISTRICT TO QUALIFIED MEDIUM-HIGH DENSITY RESIDENTIAL DIS- TRICT ON REAL PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF YORKTOWN AVENUE, EAST OF BEACH BOULEVARD (ZONE CASE NO. 84-17) WHEREAS, pursuant to state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No. 84-17 wherein both bodies have carefully considered all in- formation presented at said hearings, and after due consideration of the findings and recommendation of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper , and consistent with the general plan, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The following described real property, generally located on the south side of Yorktown Avenue approximately 340 feet east of Beach Boulevard, is hereby changed from R5, "Office Professional District" to (Q) R3 , "Qualified Medium-High Density Residential District" : Beginning at a point in the northerly boundary of the Southwest quarter of Section 1, Township 6 South, Range 11 West, San Bernardino Base and Meridian, in the city of Huntington Beach, said point being the northeast corner of the parcel of land described in the deed from W. G. Newland and Mary J. Newland, his wife to the Union Oil Company of California, dated December 2, 1922 , recorded in Book 445, page 336, of Deeds, records 1. ahb 11/19/84 of Orange County, California; thence from said point of beginning, westerly along said northerly boundary 264 feet; thence southerly parallel with the westerly boundary of the southwest quar- ter of said Section 1, 165 feet; thence easterly parallel with said northerly boundary 264 feet to a point in the easterly boundary of the parcel of land described in said deed, dated December 2, 1922; thence northerly along said easterly bound- ary 165 feet to the point of beginning. Excep- ting therefrom all oil, gas minerals and other hydrocarbons, below a depth of 500 feet, without the right of surface entry, as reserved in instru- ments of record. subject to the following limitations, restrictions and conditions : (a) The proposed development shall be architecturally compat- ible with residential developments adjacent and easterly of this development in terms of building offsets, roof and wall materials and colors, window insets, and other similar features. (b) Variations in building setbacks and building height are required to enhance the development. A minimum building offset of four (4) feet shall be provided for every thirty-eight (38) feet of building frontage. (c) A mix of one, two or three bedroom units is recommended within the development. (d) Balconies shall be reduced in size and/or recessed to complement the varied building setbacks, and produce a greater variety in building elevations. (e) Prior to issuance of building permits, the applicant shall file a parcel map consolidating the three existing lots. Said map shall be recorded prior to final building inspection. (f) Intensified landscaping shall be provided in the setback areas to create a park-like atmosphere compatible with surrounding uses. A landscape plan shall be submitted to and approved by the Department of Development Services and the Department of Public Works . (g) Any proposed development shall be subject to review and 2. approval by the Design Review Board. (h) A use permit application along with the Design Review Board' s action shall be submitted to and approved by the Planning Commission for the entire project prior to the issuance of build- ing permits. SECTION 2. Section 9061 of the Huntington Beach Ordinance Code, District Map 1 (Sectional District Map 1-6-11) is hereby amended to reflect the change contained in this ordinance and on the map attached hereto. The Director of Development Services is hereby directed to prepare and file an amended map. A copy of said district map, as amended, is available for inspection in the office of the City Clerk. SECTION 3 . This ordinance shall take effect thirty days after its passage.
