HomeMy WebLinkAboutOrdinance #2749 r/ ORDINANCE NO. 2749 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 TO PROVIDE FOR CHANGE OF ZONING FROM MEDIUM-DENSITY RESIDENTIAL DIS- TRICT TO (QUALIFIED) MEDIUM-DENSITY RESIDENTIAL DISTRICT, COMBINED WITH 01 OIL PRODUCTION, ON REAL PROPERTY GENERALLY LOCATED AT THE NORTH- EAST CORNER OF HOLLY STREET AND CLAY AVENUE (ZONE CASE NO. 84-19 ) WHEREAS, pursuant to state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No. 84-19 wherein both bodies have carefully considered all in- formation presented at said hearings, and after due consideration of the findings and recommendation of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper , and consistent with the general plan, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1 . The following described real property, generally located at the northeast corner of Holly Street and Clay Avenue, is hereby changed from R2 , "Medium-density Residential District" to (Q) R2-01, " (Qualified) Medium-density Residential District, " combined with an 01 oil production suffix: Lots 22 , 23 and 24 in Block A of Garfield Street Addition in the city of Huntington Beach, as shown on a map thereof recorded in Book 7 , pages 27 and 28 of Miscellaneous Maps, records of Orange County, California. subject to the following conditions: (a) Additional landscaping beyond that meeting minimum re- quirements and set out in a landscape plan, approved by the 1 . RCS :ahb 12/26/84 Director of Development Services, shall be provided. (b) The redrilled well shall be soundproofed to reduce the impact on surrounding residents . A licensed acoustical engineer shall submit a study to the Director of Development Services cer- tifying that the operation meets city noise standards . (c) Six (6 ) months after the approval of a use permit for redrilling of the well, the city shall initiate a zone change to remove the 01 designation from the property. (d) This zone change shall be reviewed annually by the Planning Commission until removal of the 01 designation. (e) New oil drilling shall be limited to one well . SECTION 2 . Section 9061 of the Huntington Beach Ordinance Code, District Map 32 (Sectional District Map 25-5-11 ) is hereby amended to reflect the change contained in this ordinance and on the map attached hereto. The Director of Development Services is hereby directed to prepare and file an amended map. A copy of said district map, as amended, shall be available for inspection in the office of the City Clerk. SECTION 3 . This ordinance shall take effect thirty days after its passage .
