HomeMy WebLinkAboutOrdinance #2794 f 15? 0/i ! r' y ORDINANCE NO. 2794 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 TO PROVIDE FOR CHANGE OF ZONING FROM COMMUNITY BUSINESS DISTRICT TO COMMUNITY BUSINESS DISTRICT--SERVICE STATION ON REAL PROPERTY LOCATED ON THE NORTHWEST CORNER OF MAGNOLIA STREET AND ADAMS AVENUE (ZONE CASE NO. 85-9) WHEREAS, pursuant to the state Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No. 85-9 wherein both bodies have carefully considered all information presented at said hearings, and after due consider- ation of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, and con- sistent with the general plan. NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The following described real property, located on the northwest corner of Magnolia Street amd Adams Avenue, is hereby changed from C2, "Community Business District" to C2-SS, "Community Business District, " service station permitted: The east 150.00 feet, measured from the tan- gential portion of the east line of the south 150.00 feet, measured from the tangential por- tion of the south line of Lot 83 of Tract No. 4339 in the city of Huntington Beach, county of Orange, state of California, as per map recorded in Book 175, pages 15 to 18 inclusive of Miscellaneous Maps ion the office of the County Recorder of said county. EXCEPT all minerals, petroleum, asphaltum, brea, oil, gas and all other hydrocarbon 1. substances and all minerals and mineral rights whatsoever lying and being at a depth of more than 500 feet below the natural surface of the ground, together with the perpetual right of drilling, exploring, mining and in every usual way operating therefor and removing the same from said land by operations starting upon the surface adjoining or other lands and first entering said hereinbefore described land at a depth of more than 500 feet below the natural surface of the ground of said land in such a manner as will not interfere with or prohibit the full, free and complete use and enjoyment of said described land above said 500 feet but without any right whatsoever to enter upon or use in any manner said surface or any part of said land lying between said surface and above 500 feet below said surface, as reserved in various deeds of record. SECTION 3 . Section 9061 of the Huntington Beach Ordinance Code, District Map 1 (Sectional District Map 1-6-11) is hereby amended to reflect the change contained in this ordinance and on the map attached hereto. The Director of Development Services is hereby directed to prepare and file an amended map. A copy of such district map, as amended, shall be avail- able for inspection in the office of the City Clerk. SECTION 4. This ordinance shall take effect thirty days after its passage.
