HomeMy WebLinkAboutOrdinance #2833 ORDINANCE NO. 2833 AN INTERIM URGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH PROHIBITING ISSUANCE OF BUILDING PERMITS FOR THE CONSTRUCTION OF MORE THAN ONE UNIT DWELLING PER LEGAL BUILDING SITE WITHIN AN AREA PROXIMATE TO MAIN STREET BETWEEN ELEVENTH AND PALM STREETS WHEREAS, the City Council of the City of Huntington Beach desires to establish a forty-five (45) day moratorium on the issuance of building permits for new construction of more than one dwelling unit per legal building site within an area proximate to Main Street, generally bounded by Eleventh, Palm, and Lake Streets, as more particularly described on a map attached as Exhibit A incorporated by reference herein; and At the present time there are inadequate uniform regulations and guidelines governing the development of real property located in the described areas; and The city needs time to consider, draft, and present ordinances to govern development in the area for the consideration of the Planning Commission and City Council within such interim moratorium period, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. A forty-five (45 ) day moratorium is hereby established upon the issuance of building permits for new construction of more than one dwelling unit per legal building site in the area described on Exhibit A. 1. SECTION 2 , The City Council finds that there is a current and immediate threat to the public health, safety and welfare, and that the approval of building permits for new construction of more than one dwelling unit per legal building site in the described area would result in a threat to public health, safety, or welfare in that the Planning Division of the Department of Development Services is presently conducting a comprehensive study of the existing land uses in the area. (a) An increase in population density may exceed that allowed by current provisions of the General Plan and the Huntington Beach Ordinance Code. (b) A serious problem may exist with the illegal conversion of existing structures to multiple-unit dwellings. (c) The City Council recognizes that it will be necessary for the Planning Commission to study, hold hearings and consider the adoption of new regulations and guidelines prior to consideration by Council. It would be destructive of the proposed regulations and guidelines if during the period they are being considered and studied as the subject of public hearings, parties seeking to evade the operation thereof in the form in which they may be adopted should be permitted to enter upon a course of construction which might progress so far as to defeat the whole or in part the ultimate objective of such regulations and guidelines. Further, it is probable that the uses contemplated on real property in the area may not conform to the regulations and guidelines now being formulated, thereby destroying the usefulness of such regulations and guidelines. 2 . This ordinance shall take effect immediately andl in accordance with Government Code § 65858, shall be of no further force and effect forty-five (45 ) days from the date of its adoption. The City Clerk shall certify to the passage of this ordinance and shall cause same to be published within fifteen days of its adoption in a newspaper of general circulation.
