AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH AMENDING HUNTINGTON BEACH
ORDINANCE CODE BY DELETING SECTION 9021(f) AND
ADDING SECTION 9022 TO EXPAND THE ENFORCEMENT PROCEDURE
The City Council of the City of Huntington Beach does
ordain as follows:
SECTION 1. Section 9021(f) of the Huntington Beach
Ordinance Code is deleted.
SECTION 2 . Section 9022 of the Huntington Beach Ordinance
Code is added to read as follows:
9022 Enforcement Penalties
(a) It shall be the duty of the director to enforce
the provisions of the Ordinance Code. Official
and public employees of the City of Huntington
Beach shall not issue permits or licenses for
structures or uses which are in conflict with the
provisions of this Code. Any such permits or
licenses issued in conflict with this Code shall
be deemed null and void.
(b) Not withstanding any other provision of the
Ordinance Code, each violation of this Code may
be alternatively enforced as follows :
Each method set forth herein is intended to be
mutually exclusive and does not prevent
concurrent or consecutive methods being used to
achieve compliance against continuing
violations . Each and every day any such
violations exist constitutes a separate offense.

(1) Misdemeanor. Any person violating any of
the provisions or failing to comply with any of
the mandatory requirements of this Code may be
prosecuted for a misdemeanor. Written citations
for misdemeanors may be issued by police officers
or environmental officers and land use officers
who have successfully completed a course in the
Power of Arrest as specified in California Penal
Section 832 . This citation power is pursuant to
lif Ca ornia Penal Code 836 . 5 .
All citations issued under this Code shall be
delivered to the City Attorney who shall have the
prosecutory discretion as to the filing of a
misdemeanor complaint with the court as required
by California Penal Code Section 853 . 6 .
Any person convicted of a misdemeanor under the
provisions of this Code shall be punished by a
fine not to exceed five hundred dollars ($500 . 00)
or imprisonment for a term not to exceed six (6)
months, or both fine and imprisonment.
(2) Civil Action. The City Attorney at the
request of the City Council may institute an
action in any court of competent jurisdiction to
restrain, enjoin or abate the condition(s) found
to be in violation of the provisions of this
Code, as provided by law.
