ORDINANCE NO. 3006
AN EMERGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH,
CALIFORNIA, AMENDING TITLE 17 OF THE HUNTINGTON BEACH
MUNICIPAL CODE TO REQUIRE SMOKE DETECTORS IN ALL DWELLINGS
AND LODGINGS CLASSIFIED UNDER GROUP R DIVISION 3
OF THE UNIFORM BUILDING CODE
SECTION 1: Findings and PurMses '
WHEREAS, in order to implement the goals and objectives of reducing fire
hazards and injuries within the City of Huntington Beach in dwellings and lodgings; the
installation and maintenance of smoke detectors would reduce the incidence of tragic
injuries and deaths.
The adoption of an enabling ordinance for these programs is in the public interest
and promotes the public health, safety and general welfare.
ACCORDINGLY, this ordinance establishes procedures and standards which:
Establish requirements for smoke detectors in dwellings and lodgings classified
under Group R Division 3 of the Uniform Building Code.
ACCORDINGLY, the City Council of the City of Huntington Beach hereby
amends Title 17 of the Huntington Beach Municipal Code by adding Section 17.04.055
entitled Huntington Beach Dwellings and Lodgings Fire Prevention Regulations.
SECTION 1: The Huntington Beach Municipal Code is hereby amended to add new
Section 17.04.055 to read as follows:
17.04.055 The Uniform Building Code is hereby amended by adding thereto a new
paragraph to Section 12.10(a) Dwellings and Lodgings Fire Prevention Regulations to read
as follows:
Section 12-10(a) Any dwelling or lodging classified under Group R Division 3 of
the Uniform Building Code shall have a smoke detector installed as herein described above
in this section,
All such smoke detectors a shall be installed within 90 days of the passage of the
ordinance.
SECTION 3: Severability
If any section, subsection, part, subpart, paragraph, clause or phrase of this
ordinance, or any revision of the ordinance is for any reason held to be invalid or
unconstitutional; the remaining sections, subsections, parts, subparts, paragraphs, clauses
or phrases shall not be affected, but shall remain in full force and effect.
SECTION 4
The city declares that this ordinance is an urgency measure necessary for the
immediate preservation of the public peace, health, or safety in order to insure that
adequate fire prevention systems are present in all dwellings and lodgings in the City of
Huntington Beach.
SECTION 5
This ordinance shall take effect immediately after its passage.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at
a regular meeting thereof held on the>9t;day of June, 1989.
