HomeMy WebLinkAboutOrdinance #3028 20 ORDINANCE NO. 3028 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING SECTION 9061 OF THE HUNTINGTON BEACH ORDINANCE CODE TO PROVIDE FOR A CHANGE OF ZONING ON REAL PROPERTY GENERALLY LOCATED IN . 85 ACRES SOUTH OF HAMILTON AVENUE AND WEST OF MAGNOLIA STREET (ZONE CHANGE NO. 87-14-A) WHEREAS, pursuant to the State Planning and Zoning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Change No. 87-14 to change the zone of the subject parcel from LUD-0-CZ-FP2 (Limited Use District combined with oil-Coastal Zone-Floodplain) to (Q) LUD-0I-CZ-FP2 (Qualified Limited Use District combined with oil facilities and new drilling-Coastal Zone-Floodplain) , wherein both bodies have carefully considered all information presented at said '_ hearings, and after due consideration of the findings and recommendations of the Planning Commission and all evidence presented to the City Council, the City Council finds that such zone change is proper, and consistent with the General Plan, and The Coastal Commission has reviewed Zone Change No. 87-14 and imposed the Coastal Conservation District (CC) suffix on said Zone Change, and The City Council of the City of Huntington Beach does agree and accept such modification by the Costal Commission. NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. The following described areas property, generally located approximately 1, 000 feet south of Hamilton Avenue and 1, 100 feet west of Magnolia Street is hereby changed to LUD-Ol-CZ-FP2-CC (Limited Use District Combined with Oil Production-Coastal Zone-Floodplain - Coastal Conservation District) . In the City of Huntington Beach, County of Orange, State of California, and being that portion of the northeast one-quarter of the southeast one-quarter of Section 13, Township 6 South, Range 11 West, S,B,B, &M. , in the Rancho Las Bolsas, as shown on the map filed in book 51 of miscellaneous maps at page 7, in the Office of the County Recorder of Orange County, more particularly described as follows : -1- Commencing at the intersection of the centerlines of Hamilton Avenue and Magnolia Street; Thence along the centerline of Magnolia Street, South 00 degrees 40 feet and 24 inches east 1319 .49 feet; Thence leaving said centerline, south 89 degrees 32 ' 53" west 1098 .42 feet to the true point of beginning; Thence continuing along said line, south 89 degrees 32 ' 53" West 94 . 58 feet to a point on the northeasterly line of that certain strip of land described per document recorded in Book 4942 at Page 122 of official records of said county, said point of being also a point on a curve, concave northeasterly, and having a radius of 2317. 50 feet, a radial line to said point bears south 80 degrees 40 ' 07" west; Thence northwesterly along said curve, through a central angle of 08 degrees 16 ' 28" , an arc distance of 334 . 50 feet, a radial line bears south 88 degrees 56 ' 35" west; Thence leaving said curve, north 86 degrees 51 ' 18" east 122 .36 feet; Thence south 00 degrees 27 ' 07" east 339 . 00 feet to the point of beginning. Containing . 0868 acres, more or less . Subject to the following conditions : a. Prior to the issuance of any permits for grading, building or drilling on the subject . 868 portion of the 38 acre Ascon site, characterization of the entire 38 acre site (including access road) in accordance with recommendations from the City and other responsible agencies including Regional Water Quality Control Board, shall be completed. Depending on the results of the characterization, it shall either be verified by all responsible agencies that the portion of the site to be utilized for drilling purposes is free of contaminants and drilling activities may safely proceed without remediation of the subject portion or overall portion of the site, or the site shall be remediated to the satisfaction of all responsible agencies prior to issuance of any grading, building or drilling permits. b. All storage tanks shall include vapor recovery systems approved by the City Fire Department. Prior to the issuance of drilling permits, fire hydrants (number and location to be determined by the City Fire Department) shall be provided on site. _2_ 3028 c. The proposed private roadway running from Hamilton Avenue to the drilling site shall be a designated fire lane, minimum 24 foot side, and constructed in accordance with Public Works standards and criteria. The road shall be of "all weather" material . A study must be completed of roadway area for potential gas seeps, etc. and reviewed . by appropriate state agencies prior to issuance of any conditional use permit. d. Dust suppression and soil erosion mitigation measures such as watering the soils during grading, and the utilization of dikes, sandbags, etc. during construction shall be approved by the Director of Community Development and implemented. e. Access to the site shall be taken from Hamilton Avenue only. Delivery and pick up routes shall be limited to those indicated in the proposed plan (see attached site plan and rout map) . Deliveries and pick ups shall be limited to the hours between 7: 00 am and 5 : 00 pm Monday through Friday and shall be prohibited entirely on Saturday, Sundays and holidays. f. The project shall comply with the City of Huntington Beach Oil Code and Noise Ordinance. g. All safety measures and contingency plans shall be in conformance with the standards of, and approved by, the City of Huntington Beach Fire Department. A liability/performance bond shall be reviewed and approved by the Planning Commission prior to any development. h. If lighting is included with the project, energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide) . All outside lighting shall be directed to prevent "spillage" onto adjacent properties . i . A detailed soils analysis shall be prepared by a registered soils engineer, This analysis shall include on-site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities prior to issuance of conditional use permit. j . Prior to the issuance of grading permit, a grading plan shall be submitted to the City's Department of public Works . A plan for silt control for all water runoff from the property during construction and during initial operation of the project may be required by the Director of Public Works if deemed necessary. k. No slant-drilling shall be permitted under Edison Company property. -3- 3028 1 . If during drilling, hazardous wastes are encountered, drilling operations must immediately cease until the hazard is defined and subsequently mitigated following an q Y g g approved contingency plan. Should this situation occur, the Department of Health Services must be notified at once. SECTION 2 : The Director of Community Development is hereby directed to amend Section 9061, District Map 14 (Sectional District Map 13-6-11) to reflect Zone Change No. 87-14-A described in Section 1 hereof . A copy of said district map, as amended hereby, is available for inspection in the Office of the City Clerk. SECTION 3 : This ordinance shall take effect thirty (30) days after its adoption.
