AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING CHAPTER 2 . 52 OF THE HUNTINGTON BEACH
MUNICIPAL CODE BY DELETING FROM SECTION 2 . 52. 030
RELATING TO DUTY TO ENFORCE LAWS
WHEREAS, the District Superintendent for the California
Department of Parks and Recreation has requested that the Huntington
Beach Police Department assume responsibility for investigation of
Part I Crimes that occur on state beaches within the city, and City
Ordinance 2 .52 . 030 currently specifically prohibits enforcement
action by the police department on the state beaches unless there is
a contract for such services;
NOW, THEREFORE, the City Council of the City of Huntington Beach
does hereby ordain:
SECTION 1 : Chapter 2 . 52 of the Huntington Beach Municipal Code
is hereby amended by deleting from Section 2 . 52. 030 to read as
follows :
2 . 52 . 03Q Duty to enforce laws . It shall be the duty of each
and every member of the police department to enforce impartially all
the laws and statutes of the United States and of the state of
California and all of the ordinances of this city, within the limits
of this city, and to perform such other and further duties as by
statute and ordinance now existing or hereafter enacted, may be
imposed upon them in their capacity as peace officers . (Ord. 1949,

SECTION 2 : This ordinance shall take effect 30 days after its
passage.

PASSED AND ADOPTED by the City Council of the City of Huntington
Beach at a regular meeting thereof held on the 22nd day of
January 1991.
