AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH-MMQ-3 CODE BY JPAL
AMENDING SECTION 3.02.110 THEREOF TO PROVIDE
FOR A 1% CREDIT TO LOCAL BIDDERS
WHEREAS, the City Council wishes to provide a 1% credit to

local bidders in recognition of sales tax revenue benefit to
the city,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Huntington Beach does ordain as follows :
SECTION 1. Section 3 . 02. 110 shall be and is hereby amended

to read as follows :
3.02.110 Award of bid. The award shall be to the lowest
acceptable and responsible bidder except as otherwise provided

herein. Award may be by item, if the Chief of Administrative
Services deems such manner of award to be in the best interests
li
of the city. Except as expressly required by City Charter, in
the case of informal or formal bid submitted by a local bidder,
the Chief of Administrative Services shall, for the purposes of
bid comparison only, reduce the amount of said bid by 1% for
that part of the purchases upon which the city will pay sales

tax. If tie low bids result from this reduction, quality and
service being equal, the contract shall be awarded to a local
bidder. The one percent adjustment is afforded to local

vendors to recognize sales tax reimbursements to the city on
such purchases . A "Local Bidder" , as that term is used herein,
shall be defined as a firm or individual who regularly
is

maintains a place of business and transacts business in, or
maintains an inventory of merchandise for sale in, and is
licensed by, or pays business taxes to, the City of Huntington
Beach.
SECTION 2 . This ordinance shall take effect thrity (30)
days after its adoption.

1, CONNIE BROCKWAY, the duly elected, qualified City
Clerk of the City of Huntington Beach and ex-officio Clerk of the
City Council of the said City, do hereby certify that the whole number
of members of the City Council of the City of Huntington Beach is seven;
that the foregoing ordinance was read to said City Council at a regular
meeting therof held on the 20th day of July
19 92 and was again read to said City Council at a regular
meeting therof held on the 3rd day of AuqU t 19 92 and
was passed and adopted by the affirmative vote of at least a majority of
all the members of said City Council .
