HomeMy WebLinkAboutOrdinance #3215 /s7- , 4:�57 u ORDINANCE NO. 3215 AN ORDINANCE OF THE CITY COUNCIL AMENDING CHAPTER 9.20 OF THE HUNTINGTON BEACH MUNICIPAL CODE BY ADDING SECTION 9.20.040 RELATING TO PROHIBITING TRESPASSING ON SCHOOL GROUNDS WHEREAS, recently violence has erupted on certain campuses within this city and in other campuses in nearby cities; and Some of that violence was the result of confrontations between students and non-students who had no other reason for being on that campus except to cause trouble; and Making such campuses closed to non-students except for certain persons doing business with the District or school will help lessen opportunities for trouble; and - The California Court of Appeals in Matter of Rudolfo Q.A. (1980) 110 Cal.App.3d 845, 168 Cal.Rptr. 338 has recognized the right of cities to adopt ordinances making it a trespass to be on school grounds; NOW, THEREFORE, the City Council does hereby ordain as follows: SECTION 1: That Section 9.20.040 is hereby added to the Huntington Beach Municipal Code to read: "9.20.040 Trespassing on School Grounds. No person shall enter posted school grounds without first obtaining permission from the administrative office of the school or school district, except for the following persons: (a) Students, currently enrolled at that school. (b) Teachers, staff members and other employees of the school d istrict. (c) Service providers and vendors doing business with the school, including counselors. (d) Volunteers approved by the school. (e) Parents of students currently enrolled. (f) Law enforcement and other governmental employees and representatives having business at the school. (g) Attendees at school events that are open to the public, while those events are open and only in the area open for the event. (h) Attendees at authorized Civic Center Act functions. SECTION 2: This ordinance shall take effect thirty days from the date of its passage.
