HomeMy WebLinkAboutOrdinance #3244 71-9 r <� ORDINANCE NO. 3244 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING THE HOLLY-SEACLIFF SPECIFIC PLAN CODE AMENDMENT NO. 93-10 WHEREAS, pursuant to the Planning and Zoning Law, the California Government Code Sections 65493 et seq., the Planning Commission of the City of Huntington Beach, after notice duly given, held a public hearing on March 15, 1994, to consider Code Amendment No. 93-10 which will amend the Holly-Seacliff Specific Plan to allow sideyard encroachments for fireplaces, bay windows, unroofed balconies, open stairways and architectural features; and On July 18, , 1994, after notice duly given, a public hearing was held before the City Council of the City of Huntington Beach, regarding the aforesaid code amendment, and said code amendment having been considered, the City Council finds that Code Amendment No. 93-10 is necessary to provide sideyard encroachments for fireplaces, bay windows, unfilled balconies, open stairways and architectural features to maintain consistency with City-wide residential development provisions, to provide effective interior design and efficient exterior design in the Holly-Seacliff Specific Plan; NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby ordain as follows: SECTION 1. The Holly-Seacliff Specific Plan is hereby amended by amending Section III(D)(1)(h) thereof relating to Low Density Residential (RL-1) Development Standard, to read as follows: h. Setback (Side Yard) The minimum setback from the side property lines shall be as follows: 1 41s1Ord:Holly-S.S.P.93-10\07/15/94 1) Interior Side Yard Dwellings, garages and accessory buildings, Minimum of five (5) feet. Eaves: Eighteen(18) inches. Fireplaces: Thirty (30) inches. Bay windows, unroofed balconies, open stairways and other architectural features: Three (3) feet. 2) Exterior Side Yard Dwellings, and accessory buildings: Minimum of ten (10) feet. Side entry garages or carports: Ten(10) feet. Eaves: Eighteen(18) inches. Fireplaces: Seven and one-half(7.5) feet. Bay windows, unroofed balconies, open stairways and architectural features: Eight (8) feet. SECTION 2. The Holly-Seacliff Specific Plan is hereby amended by amending Section III (D)(2)(h) thereof relating to Low Density Residential 2 (RL-2)Development Standards, to read as follows: h. Setback (Side Yard) The minimum setback from the side property lines shall be as follows: 1) Interior Side Yard Dwellings, garages and accessory buildings: Minimum of five (5) feet. Eaves: Eighteen(18) inches. Fireplaces: Thirty(30) inches. Bay windows, unroofed balconies, open stairways and other architectural features: Three (3) feet. 2 41s1Ord:Holly-S.S.P.93-11)107/15/94 3244 2) Exterior Side Yard Dwellings and accessory buildings: Minimum of ten (10) feet. Side entry garages or carports: Ten(10) feet. Eaves: Eighteen(1S) inches. Fireplaces: Seven and one-half(7.5) feet. Bay windows, unroofed balconies, open stairways and other architectural features: Eight (8)feet. 3) Exception for Zero Lot Line A zero side yard setback or a zero rear yard setback shall be permitted as long as the following requirements are met: • The lot adjacent to the zero setback side or rear yard shall be held under the same ownership at the time of application and the setback for the adjacent lot shall be either zero or a minimum of ten (10) feet. • No portion of the dwelling or any architectural features shall project over the property line, except rooftop eaves no greater than 24-inches. • The zero setback shall not be adjacent to a public or private right- of-way. • Exposure protection between structures shall be provided as specified by the Fire Department and the Building Division. SECTION 3. The Holly-Seacliff Specific Plan is hereby amended by amending Section III(D)(3)(h)thereof relating to Low Density Residential 3 (RL-3) Development Standards, to read as follows: h. Bay windows, unroofed balconies, open stairways and other architectural features: Three (3) feet. 2) Exterior Side Yard Dwellings and accessory buildings: Minimum of six (6) feet. Side entry garages or carports: Six (6) feet. Eaves- Eighteen(18) inches. Fireplaces: Three and one-half(3.5) feet. The Holly-SeacliiT Specific Plan is hereby amended by amending Section III(D)(4)(g) thereof relating to Medium Density Residential (RM) Development Standards, to read as follows: g. Setback (Side Yard) The minimum setback from the side property lines shall be as follows: 1) Interior Side Yard Dwellings, garages and accessory buildings: Minimum of five (5) feet. Also, fifteen(15)foot minimum building structure separation for one (1) and two (2) story buildings on the same lot. Twenty (20) foot minimum building structure separation for three (3) story buildings on the same lot. Eaves: Eighteen (18) inches. Fireplaces: Thirty (30) inches. Bay windows, unroofed balconies, open stairways and other architectural features: Three (3) feet. 2) Exterior Side Yard Dwellings, garages and accessory buildings: Minimum of ten (10) feet. Side entry garages or carports: Ten(10) feet. Eaves: Eighteen(18) inches. Fireplaces: seven and one-half(7.5) feet. The Holly-Seacliff Specific Plan is hereby amended by amending Section III (D)(5)(g) thereof relating to Medium-High Residential (RMH) Development Standards, to read as follows: g. Setback (Side Yard The minimum setback from the side property lines shall be as follows: 1) Interior Side Yard Dwellings, garages and accessory buildings: Minimum of five (5) feet. Also, fifteen(15) foot minimum building structure separation for one (1) and two (2) story buildings on the same lot. Twenty (20)foot minimum building structure separation for three (3) story buildings on the same lot. Eaves: Eighteen (18) inches. Fireplaces: Thirty (3 0) inches. Bay windows, unroofed balconies, open stairways and other architectural features: Three (3) feet. 2) Exterior Side Yard Dwellings, garages and accessory buildings: Minimum of ten (10) feet. Side entry garages or carports: Ten(10) feet. Eaves: Eighteen (18) inches. Fireplaces: Seven and one-half(7.5) feet. This ordinance shall take effect thirty (30) days after its adoption.
