AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING ORDINANCE NO. 3333 AND
CHAPTER 17.66 OF THE HUNTINGTON BEACH MUNICIPAL CODE
REGARDING A LIBRARY DEVELOPMENT FEE
THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH does hereby ordain
as follows:
SECTION 1. Findings and Intent. The City Council finds as follows:
A. On September 3, 1996,the City Council of the City of Huntington Beach
adopted Ordinance No. 3333 adding Chapter 17.66 to the Municipal Code regarding a Library
Development Fee.
B. Ordinance No. 3333 and the Library Development Fee require amendment
to insure their effective implementation.
SECTION 2. Section 17.66.040 of the Huntington Beach Municipal Code,
entitled"Calculation of Required Fees" is renumbered to be 17.66.045 and is amended to read as
follows:
"The Building and Safety Director shall calculate the fees required by this
Chapter prior to the issuance of the building permit for a Development
Project."
SECTION 3. Section 17.66.050(b) of the Huntington Beach Municipal Code is
amended to read as follows:
"(b) Payment Procedure for Residential Development Projects. The fee
required by this Chapter from a Residential Development Project shall be
paid before final inspection of the dwelling unit on which the fee was
imposed. However,the Planning Director may adopt procedures to
advance the time the fee is due on Residential Development Projects
consistent with Government Code Section 66007, as amended."
SECTION 3. Section 5 of Ordinance No. 3333 is amended to read as follows:
"This Ordinance shall apply to all submittals for building permits received
beginning November 3, 1996. Vesting Tentative Maps for which an
application was deemed complete prior to November 3, 1996 shall be
exempt from the requirements of this Ordinance, provided, however,that
this exemption shall not apply to any Development Agreement or any
Development Project which permits or requires payment of new City-wide

impact fees adopted after approval of the Development Agreement or the
Development Project."
SECTION 4. In amending Section 5 of Ordinance No. 3333, the City Council is merely
clarifying its prior intent regarding which Development Projects are subject to the Library
Development Fee. Further, in delaying the effective date of the Library Development Fee to
November 3, 1996, the Council is complying with Government Code Section 66017.
