HomeMy WebLinkAboutOrdinance #3495 ORDINANCE NO. 3495 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING CHAPTER 10.12 OF THE HUNTINGTON BEACH MUNICIPAL CODE RELATING TO SPEED LIMITS The City Council of the City of Huntington Beach does hereby ordain as follows: _ SECTION 1. Chapter 10.12 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.12.010_Twenty-five m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an engineering and traffic survey of the portions of the streets hereinafter set forth, the City Council determines and declares that the prima facie speed limit of twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said streets and that the prima facie limit of speed on a portion of the following streets as listed in Section 10.12.080 shall be and is twenty-five (25) miles per hour. 10.12.020 Thirty m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an engineering and traffic survey of the portions of the streets hereinafter set forth, the City Council determines and declares that a speed greater than the prima facie speed limit of twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said streets; that a prima facie speed limit of thirty(30) miles per hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit of speed on a portion of the said streets as listed in Section 10.12.080 shall be and is thirty(30)miles per hour. 10.12.030 Thirty-five m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an engineering and traffic survey of the portions of the streets hereinafter set forth, the City Council determines and declares that a speed greater than the prima facie speed limit of twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said streets; that a prima facie speed limit of forty(40) miles per hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit of speed on a portion of the said streets as listed in Section 10,12.080 shall be and is forty(40) miles per hour. 10.12.050 Forty-five m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an engineering and traffic survey of the portions of streets hereinafter set forth, the City Council determines and declares that a speed greater that the prima facie speed limit of twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said streets; that a prima facie speed limit of forty-five (45) miles per hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit of speed on a portion of the said streets as listed in Section 10.12.080 shall be and is forty-five (45) miles per hour. ordOl/speed limid3/21/01 1 10.12.060 Fifty m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an engineering and traffic survey of the portions of the streets hereinafter set forth, the City Council determines and declares that a speed greater that the prima facie speed limit of twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said streets; that a prima facie speed limit of fifty(50)miles per hoar is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit of speed on a portion of the said streets as listed in Section 10.12.080 shall be and is fifty(50)miles per hour. 10.12.065 Fifty-five m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an engineering and traffic survey of the portions of streets hereinafter set forth, the City Council determines and declares that a speed greater than the prima facie speed limit of twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said streets; that a prima facie speed limit of fifty-five (55)miles per hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit of speed on a portion of the said streets as listed in Section 10.12.080 shall be and is fifty-five (55) miles per hour. 10.12.070 Sneed limits on state highway. The State of California has established that orderly movement of vehicular traffic requires that a reasonable and safe limit be placed upon said streets and that the prima facie limit of speed on a portion of the following streets shall be and is as listed in Section 10.12.080. 10.12.080 Speed limits enumerated. Streets are listed alphabetically and categorized up (North) and to the right (East). An asterisk (*) denotes speed limit not set by survey. Ordinance for Reaffirmation (City Council) REAFFIRM City Council Adoption on 4/16101 of Ordinance No. 3495 with..a New Effective Date of 5/30101 Amending Chapter 10.12 of the H.B. Municipal Code Relating to Speed Limits on Various City Streets and Direct the Public Works Commission to Reconsider Heil Avenue Speed Limit from Saybrook Lane to Beach Boulevard (580.60) Communication from the Director of Public Works and the Chief of Police regarding the matter of the City Council's action on May 7, 2001 meeting to reconsider the April 16, 2001 adoption of Ordinance No. 3495— An Ordinance of the City of Huntington Beach Amending Chapter 10,12 of the Huntington Beach Municipal Code Relating to Speed Limits Staff believes that the City Council intended to reconsider the speed limit on Heil Avenue near Springdale Street in response to the concerns expressed by a citizen during the Public Comments portion of the last Council meeting, rather than the speed limit adjustment contained in Ordinance No. 3495 on Heil Avenue east of Beach Boulevard. To this end it would be appropriate to reaffirm Ordinance No. 3495, direct the City's Public Works Commission to reevaluate the speed limit on Heil Avenue from Saybrook Lane to Beach Boulevard, and report these findings back to the City Council. Should the City Council decide to arbitrarily reduce the speed limit on Heil Avenue, then radar cannot be used for speed enforcement on that street segment. Recommended Action: Motion to: 1. Reaffirm Ordinance No. 3495 which was previously requested for reconsideration, with an effective date to be May 30, 2001 — "An Ordinance of the City of Huntington Beach Amending Chapter 10.12 of the Huntington Beach Municipal Code Relating to Speed Limits, [Approved 5-0-2 (Julien Houchen, Garofalo absent)] and 2. Direct the Public Works Commission to reconsider the speed limit on Heil Avenue from Saybrook Lane to Beach Boulevard, and present its recommendation to the City Council.
