HomeMy WebLinkAboutOrdinance #3655 ORDINANCE NO. 3655 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH MODIFYING THE BASIS AND METHOD OF LEVYING THE ASSESSMENT WITHIN THE HUNTINGTON BEACH AUTO DEALERS BUSINESS IMPROVEMENT DISTRICT The City Council of the City of Huntington Beach does hereby ordain as follows: SECTION 1. The City Council of the City of Huntington Beach hereby finds and declares as follows: WHEREAS, the California Legislature, in adopting the Parking and Business Improvement Law of 1989 (Streets and Highways Code §36500 et seq.), found that cities are authorized to levy assessments on businesses in order to promote economic revitalization and tourism, create jobs, attract new businesses and prevent erosion of business districts; and WHEREAS, the California Legislature has found that cities are authorized to levy assessments on businesses which benefit from these improvements and activities; and WHEREAS, the City Council has formed a business improvement area, known as the Huntington Beach Auto Dealers Business Improvement District (the "District"), by passage of Ordinance No. 3175 on September 8, 1992. The City Council has renewed the existence of the District for fiscal year 2003-04 by levying assessments on those business that benefit from the improvements constructed; and WHEREAS, pursuant to Ordinance No. 3175, any businesses covered by Ordinance No. 3175 shall also be subject to changes which may be made in the assessments or in the uses to which the revenue shall be put, as specified in Ordinance No. 3175 and permitted by the Act, and that such changes shall be made by later ordinance adopted after hearing before the City Council or by resolution, if approved in conjunction with confirmation of the annual report; and WHEREAS, the advisory body to the District, the Huntington Beach Auto Dealers Business Improvement District Advisory Group, has recommended that the. City Council modify the basis and method upon which the assessment is levied on the District for the purposes of repayment of a loan obtained from the Redevelopment Agency of the City of Huntington Beach to fund certain improvements, which improvements shall benefit the businesses subject to the assessments. SECTION 2. The City Council of the City of Huntington Beach by this ordinance does hereby: A. Modify assessments for businesses levied in the District for the remainder of fiscal year 2003/04 as set forth in Exhibits Al and A2 in the amount set forth in Exhibit A3, which exhibits are attached hereto and incorporated herein by this reference. 04ord/auto dealers bid/4/06/04 1 Ordinance Number 3655 B. The revenue from the levy of assessments from the District adopted by this ordinance shall be used for those purposes as recommended by the Huntington Beach Auto Dealers Business Improvement District Advisory Group set forth in Ordinance No. 3175, this ordinance, and by the Resolution of Intention No. 2004- 22 as the same may be modified by City Council from time to time. SECTION 3. This ordinance shall become effective 30 days after its adoption.
