VVHEREAS: Heretofore, to-wit: on or about the
month of March, 1911 , bills were presented to the City of
Huntington Beach, by the Amalgamated Oil Company of the
City of Los Angeles, for oil theretofore used on North Main
Street in the City of Huntington Beach, and,
WHEREAS, the Board of Trustees of the City of
Huntington Beach at its meeting held on the 4th day of April ,
1911 , approved said bills, or a portion of them, and ordered
warrants drawn in part payment of the same, said warrants
being numbered Nos. 466-67-68-69 and,
'riEREAS, thereafter other warrants were ordered
drawn in connection with the same transaction, said warrants
being numbered Nos. 588 and,
WHEREAS, it appears that the payment of the said
warrants by the City of Huntington Beach, would be technically
illegal , and whereas, it further appears that said warrants
of said City are still outstanding and unpaid, and that there
is no money in the City treasury of the funds provided for
said purposes for the year during which the warrants were
drawn, and,
WHEREAS, it appears that the books of the City
Treasurer and the City Clerk cannot agree while these warrants
are outstanding,
NOW THEREFORE, the Board of Trustees of the City of
Huntington Beach, while they deplore the niggardly conduct

and unmanly spirit of those citizens of the said City of
Huntington Beach, who choose to take the benefits of trans-
actions carried on in good faith, and yet refuse to pay a
just and honest consideration therefore, yet they find them-
selves under the painful necessity of adopting the following
resolution:
Be it resolved by the Board of Trustees of the
City of Huntington Beach:
Resolved that the City Clerk and City Treasurer be
and hereby ordered to cancel and recall all warrants for oil
and freight now outs- tanding, for oil furnished for the im-
provement of Mainstreet for the year 1909-1910, and to make
their books correspond as if such warrants had never been
issued. That the action of this Board in allowing said
claims is hereby rescinded, and the officers of this city
are hereby instructed and ordered not to pay the same.
Be it further resolved that this Board of Trust-
ees stands ready and willing to compensate the Amalagated
Oil C-emiany for the oil furnished by them for the said work
if anyblegal manner of doing so can be pointed out.
