P Ayes Trustees Noes Trustees Absent Trustees—&21�W,�X/4,L" �r City Clerk and x=bfficio clerk of the Boar ' Trustees of the City of Hun &ton Beach, California. f i RESOLUTION OF INTENTION NO.2.45 - A Resolution of the Board of Trustees of the City of Huntington Beach declaring their intention to improve a portion of Ninth Street in said City of Huntington Beach and providing that the proposed work be done under the Improvement Act of 1911. The Board of Trustees .-f the City of Huntington Beach do hereby resolve as follows :- Section 1. That the public interest and convenience of the people of the City of Huntington Beach require , and that it is the intention of the Board of Trustees of said City to order the following work to be done and improvement to be made in said city, to-wit :- (a) That Ninth street from a line twenty eight (28) feet north-easterly from and parallel to the center line of Ocean Avenue to a line eighteen (18) feet southwesterly from and parallel to the center line of Palm Avenue, be paved, guttered, crowned, graded, capped ;-.nd oiled to the official grade thereof, in accordance with Specifications No.8 as provided in Ordinance No.125 of said City, and in accordance with plans No.103 and No.104, all of which said specifications and plans are now on file in the office of the City Engineer of said city of Huntington Beach. (b) That cement curbs be constructed at grade along both sides of Ninth Street in said city from the northeasterly line of Ocean Avenue to the southwesterly line of Palm Avenue ( excepting such portions of said Ninth Street between said points 1. • along which a ceislent curb has already been constructed and now is to the official line and grade) in accordance with Specifi- cations No.l as adopted by Ordinance Number 28 of said City of Huntington Beach, on file in the office of the City Clerk of said City and in further accordance with the plans , profiles and cross sections for said work on file in the office of the City Engineer of said City acid plans, profiles and cross sections being numbered Numbers 103 and 104; to which specifi- cations, plans , profiles and cross sections reference is hereby made for a more particular description of said work. (c) That a cement side walk, five feet in width be constructed alone; both sides of Ninth Street in said City from the Northeasterly line of Ocean A venue to the south- westerly line of Palm Avenue (excepting; such portions of said Street between said points along wrlich a cement side- walk, five feet in width has already been constructed and now is to the official line and grade ) 'in accordance with Specifications No-2 as adopted by Ordinance No .29 of said City of Huntington Beach, for the construction of cement sidewalks in said City of Huntington Beach, on file in the office of the City Clerk of s&id City; and in further accordance with the plans , profiles and cross sections for said work on file in the ,office of the City Engineer of said City, said plans, pro- files -and cross sections being numbered Numbers 103 and 104 to which specifications , plans, profiles and cross sections , reference is hereby made for a more particular description of said work. Said sidewalks shall'>be so constructed that 2. j. • the line of the inner side of the same shall be one foot from and parallel to the property line of the abutting property of said street . Section 2. That said Board of Trustees do hereby determine and declare that said proposed work and improvement is of more than local or ordinary public henefit and will affect and benefit the lands and district-:hereinafter des- cribed and which said district is hereby declared to be the district affected and henefitted by said work and improvement and that therefore the entire cost and expense of said work and Improvement shall be and are hereby made chargeable against and shall be assessable upon said lands and district:, which district is within the City of Huntington Beach, County of Orange, State of California, and the exterior boundaries of the lands affected and benefitted by said work, exclusive of any land within said boundaries which is now part of the public streets , is particularly described as follows to wit : Beginning at the point of intersection of the center Line of Ocean Avenue with the northwesterly line produced of the first alley southeasterly from Ninth Street, thence north- easterly along the last described alley line , to its inter- section with the center line of Palm Avenue , thence north- westerly along said center line of Palm Avenue to its inter- section with the southeasterly line of the first alley north- westerly from Ninth Street, thence southwesterly alonj the last described alley line produced to its intersection with • the center line of Ocean Avenue , thence southeasterly along said center line of Ocean Avenue to the point of beginning. 3. Section 3. The Board of Trustees of said city of Huntington Beach hereby further resolve and determine that serial bonds shall be issued to represent assessments of Twenty-five ( 25. ) Dollars or over for the cost and expense of said work and improvement; said serial bonds shall extend over a period of nine (9) years from the second of January next succeeding their date, and an even annual proportion of the principal sum thereof shall be payable by coupons on the second day of January every year after their date until the whole is paid and the interest shall be payable semi-annually by coupons on the second day of January and July, respectively, of each year, at the rate of seven (7%) per cent, per annum, on all sums unpaid until the whole of said principal and in- terest are paid. Section 4. All work shall be done in accordance with the plans and specifications adopted for doing said work now on file in the office of the City Engineer of said City. Section 5. The City Clerk shall cause this Resolution of Intentions to be published twice in the Huntington Beach News, a weekly newspaper published and circulated in said City and herebyfor that designated purpose by the Board of Trustees. Section 6. The Street Superintendent shall immediately cause to be conspicuously posted along the line of said contem- plated work and improvement and in front of all the property liable to be assessed, notices of the passage of this Resolu- tion of Intention in the manner and form required by law. Section 7. All of the herein proposed work shall be done in pursuance of an Act of the Legislature of the State of 4. • California, designated as the Improvement Act of 1911, approved April "?th, 1911. Chas. R.
