HomeMy WebLinkAboutCity Council - 248A RESOLUTION OF INTENTION NO. 248 -4 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH DECLARING THEIR IN- TENTION TO Ii,=:PROVE A PORTION OF NINTH STREET IN SAID CITY OF HUNTINGTON REACH AND PROVID- ING THAT 'HE PROPOSED WORK BE DONE UNDER THE I1V:PROVE11ENT ACT OF 1911. The Board of Trustees of the City of Huntington Beach do hereby resolve as follows : Section 1. That the public interest and convenience of the people of the City of Huntington Beach require, and that it is the intention of the Board of Trustees of said City to order the - following work to be done and improvement to be made in said city, to-wit; ( a) That Ninth Street from , a line twenty eight (28) feet northeasterly from and parallel to the center line of Ocean Avenue to a line eighteen (18) feet southwesterly from and parallel to the center line Palm Avenue , be paved, guttered, crowned, graded, capped and oiled to the official grade thereof, in accordance with Specifications No.B as provided in Ordinance No.125 of said City, and in accordance with plans No.1.03 and No. 104, all of which said specifications and plans are now on file in the office of the City Engineer of said city of Huntington Beach. (b) That cement curbs be constructed at grade along both sides of Ninth Sheet in said City from the northeasterly line of Ocean Avenue to the southwesterly line of Palm Avenue ( excepting such portions of said Ninth Street between said points along which a cement curb has already been constructed 1. • • and now is to the official line and grade) in accordance with Specifications 1,1o.1 as adopted by Ordinance No.28 of said City of HuntinCD gton Beach, on file in the office of the City Clerk of said City and in further accordance with the plans , profiles and cross sections for said work on file in the office of the City Engineer of said City, said plans , profiles and cross sections being numbered Numbers 103 and 104; to which specifications , plans profiles and cross sections reference is hereby made for a more particular description of said work. ( c) That a cement sidewalk, five feet in width be con- structed along both sides of Ninth Street in said City from the northeasterly line of Ocean Avenue to the southwesterly line of Palm Avenue (Excepting such portions of said street between said points along which a cement sidewalk, five feet In width has already been constructed and now is to the official line and grade) in accordance with specifications No.2 as adopted by Ordinance No.29 --If said City of Huntington Beach, for the con- struction of cement sidewalks in said City of Huntington Beach, on file in the office of City Clerk of said City; and in fur- Cher accordance with the plans, profiles and cross sections for said work on file in the office of the City Engineer of said City, said plans , profiles and cross sections being numbered Nos . 103 and 104 to which specifications , plans , profiles and cross sections , reference is hereby made for a more particular descri-otion of said work. Said sidewalks shall be so constructed that the line of the inner side of the same shall be one foot from and parallel to the property line of the abutting property of said street. 2. • (d) That corrugated iron culverts be constructed across and in said Ninth Street at the places shown on and in accordance with the plans, profiles and cross sections for said work on file in the office of the City Engineer of said City, said plans , profiles and cross sections being numbered 103 and 104, and hereby referred to for a more particular description of said work and the location of said culverts ; and that said corrugated iron culverts be constructed in accordance with specifications No.8, as provided in Ordinance No.125 of said City, which specifications are hereby referred to for a more particular description of said work. Section 2. That said Board of Trustees do hereby deter- mine and declare that said broposed work and improvement is of more than local or ordi ary puT&lic benefit and will affect and benefit the lands and district hereinafter described and which said dis- trict is hereby declared to be the distruct affected and benefited by said Mork and improvement and that therefore the entire cost and expense of said world and improvement shall be and are hereby chargeable against and shall be assessable upon s&id lands and district , which district is within the City of Huntington Beach, County of Orange , State of California, and the exterior boundaries of the lands affected and benefited by said work, exclusive of any land within said boundaries which is now a part of the public streets , is particularly described as follows to-wit : Beginning at the point of intersection of the center line of Ocean Avenue with the northwesterly line produced of the first alley southeasterly from Ninth Street, thence northeasterly al- ong the last described alley line , to its intersection with the 3 . • center line of Palm Avenue, thence northwesterly along said cen- ter line of Palm Avenue to is intersection with the southeasterly line of the first alley northwesterly from Ninth Street, thence southwesterly along the last described alley line produced to its intersection with the center line of Ocean Avenue , thence southeasterly along said center line of Ocean Avenue to she point of beginning. Section 3. The Board of Trustees of said City of Huntington Beach hereby further resolve and determine that serial bonds shall be issued to represent assessments of Twenty five ( 25. ) Dollars or over for the cost and expense of said work and improvement; said serial bonds shall extend over a period of nine (9) years from the second of January next succeeding their date, and an even annual proportion of the principal sum thereof shall be payable by coupons on the second day of January every year after their date until the whole is paid and the interest shall be payable semi-annually by " cou- pons on the second day of January and July, respectively, of each year, at the rate of seven (?%) per cent, per annum, on all .sums unpaid until the whole of said principal and interest are paid. Section 4. All work shall be done in accordance 4th the plans and s[Decifications heretofore adopted for doing said work now on file in the office of the City Engineer of said City. Section 5. The City Clerk, shall cause this Resolution of Intention to be published twice in the Huntington Beach News , a weekly newspaper published and circulated in said City and hereby designated for that purpose by the Board of Trustees . 4. �,t r Section 6. The Street Superintendent shall immediately cause to be conspicuously posted along the line of said. contem- plated work and improvement and in front of all the property liable to be assessed, notices of the passage of this Reso- lution of Intention in the manner and form required by law. Section 7. All of the herein proposed work shall be done in pursuance of an Act of the Legislature of the State of California designated as the Improvement Act of 1911, approved April 7th, 1911. E-.
