Resolved, that whereas the Board of Trustees of the
City of Huntington Beach did on the 27th. day of July, 1914,
pass and adopt its Resolution of Intention, No. 248 to order
the hereinafter described work to be done and improvement"'to
be made in said City of Huntiington Beach, which Resolution
of Intention was duly and legally published, as required by
law, and as appears by the affidavit of James J. Conrad now
on file in the office of the City Clerk of said City of Hunt-
ington Beach, the said Resolution of Intention having been
published in the Huntington Beach News, a weekly newspaper
of general circulation, printed, published and circulated
in said City of Huntington Beach on the 31st. day of July,
1914 and on the 7th. day of August, 1914; and whereas, im-
mediately after the adoption of said Resolution of Inten-
tion, No. 248, notices of the passage of said Resolution of
Intention, No. 248, headed "Notice of Improvement" were duly
and legally posted by the Street Superintendent of said City
along the line of said contemplated work and improvement, in
front of all the property liable to be assessed therefore,
not more than 300 feet in distance apart and not less than
three in all, and along all the Streets within the District
mentioned and described in said Resolution of Intention and
not less than three in all on each Street in said District ,
as appears by the affidavit of John Tinsley, Street Superin?z
tendent of said City, now on file with the City Clerk of said
City; and whereas, immediately upon the completion of the
posting of said notices said t S reet Superintendent filed

said affidavit of posting in the office of said City
Clerk making oath that he completed the posting of said
notices on August 4th. ,1914; and whereas, more than
fifteen days have expired since the date of the second
publication of said Resolution of Intention, No.248, and
since the completion of the posting of said "Notice of
Improvement" , therefore,
BE IT RESOLVED, that the public interest and
convenience require the work herein described, and the
Board of Trustees of said City of Huntington Beach here-
by orders the following described work to be done and im-
provement to be made in said City of Huntington Beach,
to-wit:
(a.) That Ninth Street from a line twenty eight
(28) feet northeasterly from and parallel to the center
line of Ocean Avenue to a line eighteen (18) feet south-
westerly froip and parallel to the center line of Palm Av-
enue, be paved, guttered, crowned, graded, capped and oiled
to the official grade thereof, in accordance with Specifi-
cations No. 8 as provided in Ordinance No. 125 of said City,
and in accordance with plans No. 103 and No. 104, all of
which said specifications and plans are now on file in the
office of the City Engineer of said city of Huntington Beach.
(b) That cement curbs be constructed at grade along
both sides of Ninth Street in said City from the northeaster-
ly line of Ocean Avenue to the southwesterly line of Pala
Avenue ( excepting such portions of said Ninth Street between
said points along which a cement curb has already been con-

structed and now is to the official line and grade) in
accordance with Specifications No. 1 as adopted by Ordinance
No. 28 of said City df Huntington Beach, on file in the office
of the City Merk of said City and in furt'ter accordance with
the plans, profiles and cross sections for said work on file
in the office of the City Engineer of said City, said plans. ,
profiles and cross sections being numbered Numbers 103 and
104; to which specifications, plans, profiles and cross
sections reference is hereby made for a more particular dds-
cription of said work.
(c) That a cement widewAlk, five feet in width be con-
structed along both sides of Ninth Street in said City from
the northeasterly line of Ocean Avenue to the southwesterly
line of Palm Avenue (excepting such portions of said street
between said points along which a cement widewalk, five feet
in width has already been constructed and now is to the
official line and grade) in accordance with specifications
no.2 as adopted by Ordinance No. 29 of said City of Hunting-
ton Beach, for the construction of cement sidewalks in said
City of Huntington Beach, on file in the office of the City
Ul erk of said City; and in further accordance with the plans,
profiles and cross sections for said work on file in the ffice
of the City Engineer of said City* said plans, profiles and
cross sections being numbered Nos. 103 and 104 to which speci-
fications, plans profiles and cross sections, reference is
hereby made for a more particular description of said work.
Said sidewalk shall be so constructed that the line of the
inner side of the same shall be one foot from and parallel to
the property line of the abutting property of said street.

(d) That corrugated iron Culverts be constructed
across and in said Ninth Street at the places shown on
and in accordance with the plans, profiles and cross sec-
tions for said work on file in the office of the City En-
gineer of said City, said plans, profiles and cross sec-
tions being numbered 103 and 104, and hereby referred to
for a more particular description of said work and the
location of said culverts; and that said corrugated iron
culverts be constructed in accordance with specifications
No. 8, as provided in Ordinance No. 125 of said City, which
specifications are hereby referred to for a more particular
description of said work.
Section 2. That, said Board of Trustees do hereby de-
termine and declare that said proposed work and improve-
ment is of more than local or ordinary public benefit and
will affect and benefit the,-lands and district hereinafter
described and which said district is hereby declared to be
the district affected and Benefited by said work and im-
provement arnd that ;;hepef c%-e the entire cost and expense
of said work and improvement shall be and are hereby charge-
able against and shall be assessable upon said lands and
district, which district is within the City of Huntington
Beach, County of Orange, State of California, and the ex-
terior boundaries of the lands affected and --benefited by
said work, exclusive of any land wit'_lin said boundaries
which is now a part of the public streets, is particularly
described as follows to-wit;-

Beginning at the point of intersections of the center
line of Ocean Avenue with the northwesterly line produced
of the first alley southeasterly from Ninth Street, thence
northeasterly along the last described alley line, to its
intersection with the center line of Palm Avenue, thence
northwesterly along said center line of Palm Avenue to its
intersection with the southeasterly line of the first alley
northwesterly from Ninth Street, thence southwesterly along
the last described alley line produced to its intersection
with the center line of Ocean Avenue, thence southeasterly
along said center line of Ocean Avenue to the point of be-
ginning.
Section 3. The Board of Trustees of said City of Hunt-
ington Beach hereby further resplve and determine that serial
bonds shall be issued to represent assessments of Twenty five
025) Dollars or over for the cost and expense of said work
and improvement; said serial bonds shall extend over a period
of nine (9) years from the second of January next succeeding
their date, and an even annual proportion of the principal
sum thereof shall be payable by coupons on the second day
of January every year after their date until the whole is
paid and the interest shall be payable semi annually by
coupons on the second day of January and Jhly, respective-
ly, of each year, at the rate of seven (?%) per cent, per
annum, on all sums unpaid until the whole of said principal
and interest are paid.

Section 4. All work shall be done in accordance
with the plans and specifications heretofore adopted
for doing said work now on file in the office of the
City Engineer of said City.
Section 5. All of the herein proposed work shall
be done in pursuance of an Act of the Legislature of the
State of California designated as the Improvement Act of
1911 , approved April 7th. , 1911.
That the City Clerk of said City of Huntington Beach
is hereby directed to cause to be posted a notice of said
work together with the plans and specifications therefore,
conspicuously, for five days on or near the Counsil Chamber
Door of said Counsel , to-wit:
The front door of the City Hall in said City of Huntington
Beach inviting sealed proposals or bids for doing the work
ordered, and to cause to be published twice in the Hunting-
ton Beach News, a weekly newspaper published in said City
of Huntington Beach, a notice inviting sealed proposals or
bids for doing the said work ordered and that said Hunting-
ton Beach News is hereby Designated as the newspaper In
which said notice shall be published; that the time fixed
In said notice for the opening of bids shall be not less
than teen days from the time of the first publication or
posting of said notice and all .of said notices shall be in
. compliance with the requirements of the Improvement AO t of
1911.
