OF INTENTION,NO. 254.:I A RESOLUTIOY OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH DECLARING ITS INTENTION TO IMPROVE PORTIONS OF ELEVENTH STREET, TENTH STREET, EIGHTH STREET, SIXTH STREET, FIFTH STREET, MAGNOLIA AVENUE AND ACACIA AVENUT IN SAID CITY OF HUNTINGTON BEACH, AND PROVIDING THAT THE PROPOSED WORK BE DONE UNDER "THE IMPROVEMENT ACT OF 1911". The Board of Trustees of the City of Huntington Beach do hereby resolve as follows; Section 1. That the public interest and convenience of the people of the City of Huntington Beach require, and that it is the intention of the Board of Trustees of said City to order the following stated woikto be done and improvements to be made in said City, to-wit: (a) That Eleventh Street from a line twenty-two feet southwesterly from and parallel to the Northeasterly line of Ocean Avenue to aline 28. 5 feet Northeasterly from and parallel to Southwesterly line of Main Street; and Tenth Street from the Sout-r.westerly line of Orange Avenue to a line 12 feet Northeasterly from and parallel to the South- westerly line of Palm Avenue; and Eighth Street from a line 22 feet Southwesterly from and parallel to the Northeast- erly line of Ocean Avenue; to a line 12 feet Northeasterly froia and parallel to the Southwesterly line of Palm Avenue; and Sixth Street from a line 22 feet Southwesterly from and parallel to the Northeasterly line of Ocean Avenue to a line 28.5 feet East of and parallel to the West line of Main Street; and Fifth Street from a line 22 feet Southwesterly -1- Ir' from and parallel to the Northeasterly line of Ocean Avenut to a line 28.5 feet East of and parallel to the West line of Main Street; and Magnolia Avenue from the Southeasterly line of Eleventh Street to the Easterly line of Lake Avenub; and Acacia Avenue from the South- easterly line of Eleventh Street to a line 28.5 feet East of and Parallel to the West line of Main Street; Excepting from the above described portions of said Streets Magnolia Avenue from the Southeasterly line of Sixth Street to the Northwesterly line of Fifth Street, and the Northwesterly half of Fifth Street from the Northeasterly line of Orange Avenue to the South- westerly line of Magnolia Avenue, and the Southeasteblry half of Sixth Street from the Northeasterly line of Orange Avenue to the Southwesterly line of Magnolia Avenue; Be graded, crowned, paved, capped, oiled, improved and constructed to the official grade thereof , in accord- ance with Specificiations No. 8, as provided in Ordinance No. 125, of said City, excepting said above described portions of Magnolia Avenue and Acacia Avenue, which por- tions of said avenues sl_-�all be so improved and construct- ed to the official grade thereof, in accordance with Speci- fications No. 10, as provided in Ordinance No. 145 of said City, and all in accordance with plans Nos. 105 and 108, all of which said specifi6ations and plane are now on file in the office of the City Engineer of the City of Hunting- ton Beac-n , and are hereby referred to for a more particu- lar description of said work and improvements. (b) That a cement - side-we.lk, five feet in widt'z,be constructed along both sides of the above described por- tions of said Streets and Avenues to the official line and grade, excepting such portions of said Streets along which a cement side-walk, five feet in width, has already been donstructed and now is to the official line and grade, and excepting the above described portions of Fifth and Eleventh Streets, and excepting the hereinhefore except portions of Magnolia. Avenue, Fifth Street and Sixth Street ; all of said cement side- .Talks to be constructed in accord- ance with Specifications No. 2, as adopted by Ordinance No. 29 of said City of Huntington Beach, for the Construct- ion of cement side-walks in said City of Huntington Beach, on file in the office of the City Clerk of said City, and in further accordance with the plans, profiles and cross- sections for said work on file in the office of the City Engineer of said City, said plans, profiles and cross- sections being numbered 105 and 108, to which specifica- tions, plans, profiles, and cross-sections reference is hereby made for a more particular description of said work; all of said side-walks shall be so constructed that the line of the inner side of the same shall be one foot from and parallel to the property line of the abutting property of said street. (c) That cement curbs be constructed at grade along both sides of the above described portions of said -3- Streets and Avenues , excepting said portions of Fifth Street and Eleventh Street, and excepting the excepted portions of Magnolia Avenue, Fifth Street, Sixth Street , said curbs to be constructed in accordance with Speci- fictions No. 1 , as adopted by Ordinance No. 28, of said City of Huntington BeacIn, on file in the office of the City Clerk of said City, and in further accordance with the plans, profiles and cross-sections, for said work,on file in the office of the City Engineer of said City; said plans, profiles and cross-sections being numbered 105 and 108, to which specifications, plans profiles and cross- sections reference is hereby made for a. more particular description of said work. (d) That corrugated iron culverts be constructed across and in the above described portions of Eleventh Street, Tenth Street, Eighth Street, Sixth Street and Fifth Street in accordance with Specifications No. 8, as adopted by Ordinance No. 125, of said City of Huntington Beach, and as shawn on and in accordance with the plans, profiles and cross-sections, for said work, on file in the office of the City Engineer of said City, said plans profiles and cross- sections being numbered 105 and 108, and hereby referred to for a more particular description of said work and the location of said culverts. -4- That corrugated iron culverts be constructed across and in said above described portions of Magnolia Avenue and Acacia Avenue, in accordance with Specifications No. 11 , as adopted by Ordinance No. 146, of said City, and at the places shown on and in accordance with the plans, pro- files and cross-sections, for said work, on file in the office of the City Engineer of said City; said plans,pro- files and cross-sections being numbered 105 and �08, and here-by referred to for a, more particular description of said work and the location of said culverts. Section 2. That said Board of Trustees do hereby de- termine and declare that said proposed work and improve- ments are of more than local or ordinary public benefit and will affect and benefit the lands and district here- inafter described, and which said district is hereby de- clared to be the district affected and benefited by said work and improvements, and that , therefore, the entire cost and expenses of said work and improvements* shall be, and herebyr(i made chargeable against and shall be assessable upon said lands and district, which district is within said City of Huntington Beach, ©range County, California, and the exterior boundaries of said district and said lands affected and benefited by said work, exclusive of the said portions of said Streets to be improved and exclusive of any land within said boundaries, which is now a Dart of the -5- • • public Streets, is particularly described as follows, to-wit: Beginning at the point of intersection of the Souttt- westerly line of Ocean Avenue with the northeasterly line produced of the first alley northwesterly from Eleventh Street and running thence northeasterly along the said alley line produced to its intersection with the south- westerly line of Orange Avenue, thence northwesterly to the southwesterly corner of Block 411, t�ience northeast- erly to the northwesterly corner of Block 511 , thence northeasterly to the intersection of the northeasterly line of Acacia Avenue with. the southeasterly line of the first alley northwesterly from Eleventh Street, thence northeasterly along the said alley line to the northwest- erly corner of lot 13 of Block 711 , thence northerly to the southwesterly corner of lot 19 -of Block 711, thence north- easterly to the northerly corner of the last mentioned lot, thence northeasterly to the westerly corner of Block 811 , thenc northeasterly to the northerly corner of Block 811, thence southeasterly to the northwesterly corner of Block 910, thence southerly to the southeasterly corner of lot 19 of B1ock :310, thence southwesterly to the southwesterly corner of lot 10 of Block 810, thence sou.t"'_erly to the point of intersection of the northeasterly line of Palik Avenue with the southeasterly line of Tenth Street, thence -6- • along the northeasterly line of Palm Avenue to the south easterly corner of lot 2 of Block 706, thence southeaster- ly to the northwesterly corner of Block 605, thence south- erly along the easterly line of Main Street to the south- west corner of lot 20 of Block 504, trence to t-11-e south- east corner of lot 19 of Block 504, thence southeasterly to the southwest corner of Block 503, thence southerly to the northwest corner of Block 402 A, thence southwesterly to the southeasterly corner of lot 15 of Block 403, thence westerly to the southwesterly corner of lot 34 of Block 403, thence southwesterly to the southeasterly corner of lot 6 of Bl6ck 404, thence northwesterly to the southwest- erly corner of said lot 6 of Block 404, thence southwester- ly to the southeasterly corner of lot 16 of said Block 404, thence soutl-westerly along the northwesterly line produced of the first alley northwesterly from Main Street to the intersection of the last mentioned alley line produced with the southwesterly line of Ocean Avenue, thence northwester- ly along the southwesterly line of Ocean Avenue to the point of beginning; all of which said lots and Blocks are shown on maps on file In the Records of Orange County, Califcrn- ia; Blocks 411 and 511 are shown on map of Huntington Beach, om page 10 of book 4 of Miscellaneous Maps, Blocks 711 ,811 , 810, 910 and 706 are shown on a map of Wesley Park Tract, on page 16 of book 5 , Miscellaneous Maps; Blocks 605, 504, 503, 402A2 403 and 404 are shown on a Map of Huntington Beach4 Main Street Section on page 43 of book 4, Miscellan- eous Maps Records of orange County, California,,---except- -7- ing therefrom Block 405 belonging to Huntington Beach School District and occupied by Huntington Beach Grammar School , and excepting therefrom all lands within said bound- aries now a part of the public Streets of said City of Hunt= ington Beach. Section 3. That serial bonds shall be issued to rep- resent assessments of $25.00 or over, for the cost and expense of said work and improvements; said serial bonds shall extend over a period of nine years from the 2nd. of January mext succeeding their date, and an even annual portion of the principal sum thereof shall be payable by coupons on the 2nd. day of January every year after their date, until the whole is paid, and the interest shall be payable semi-annually by coupons on the 2nd. day of January and July, respectively, of each year at the rate of seven per cent. per annum, on all sums unpaid, until the whole of said principal and interest are paid. Section 4. All of said work shall be done in accord- ance with the said plans and specifications -eretofore adopted, for doing said work, now on file in the office of the City Engineer of said City. Section 5. The City Clerk shall cause this Resolution of Intention to be published twice in the Huntington Beach News, a weekly newspaper published and circulated in said City, and hereby designated for that purpose by said Board of Trustees. Section 6. The Street Superintendent of said City shall immediately cause to be conspicuously posted, along • the line of said contemplatdd work and improvements and in front of all of the property liable to be assessed, notices of the passage of thit Resolution of Intention in the manner and form required by law. Settion 7. All of the herein proposed work shall be done in pursuance of an Act of the Legislature of the State of California, designated as the Improvement Act of 1911 , Approved April 7, 1911. E.
