HomeMy WebLinkAboutCity Council - 257A RESOLUTION OF INT 7 TICN N.O. 257-` A Resolution of the board of Trustees of the City of Huntington Beach Declaring its Intention to Order the Construction of a Sewer along and in certain Streets, avenues, Alleys, Places and Public lay in said City of Huntingtoni Beach, and Provi ,_ing that the proposed trork be done under "The Improvement Act of 1911. " The Board of Trustees of the City of Huntington Beach do hereby resolve as follo*irs: Section 1. That the public interest and convenience of the people of the City of Huntington Beach require, and that it is the intention of the Board_ of T---,ustees of said City to order, the following work to be done and improvement to be made in said City, to-grit; That a. serer be constructed for sanitary ?purposes along; and in certain streets, avenues, alleys, places and public way in said City, the center line of said sewer being described, as fol- lows: Commencing at a point in the first alley Northeasterly from Ocean Avenue four and a. half feet t°Torthea.sterly from the Southwesterly line of said alley and four and a half feet South- easterly from the 1,Tortht rresterly line produced of the first alley Northwesterly from Eleventh Street; thence Northeasterly along and in said last mentioned alley four and a half feet Southeasterly from the Northwesterly line of said alley and said line produced to the "?ortheasterly line of Orange Avenue; thence continuing in a straight line Northeasterly through Blocks 411 and 511, of "Hunt- ington Beach, Seventeenth St. Section, " as shown on a map recorded in Book 4, at ?gage 10, of ":'is cell aneous Taps, Records of Orange County, California, along the center of a certain right of way described in a certain deed, recorded in Book , at page , of Deeds, Records of said Orange County, said right of way being a public- way ten feet in `Fridth, lying and being five feet in width on each side of a center line, which is 128 feet Northwesterly from and parallel to the Nlorthwesterly line of Eleventh Street , to a point seventeen and a half feet Southwesterly from the Southi,.lester- ly line of Acacia avenue; The said sewer shall be constructed and the work of construct- ing ti.e same shall be. dome in accordance =,rith certain plans and specifics Lions and careful estimates of the costs and. expenses there- of heretofore prepared and furnished to the City Council of said City by the City Engineer of said City, the said specifications be- ing Specifications To. 9, as adopted and provided by Ordinance No. 143, of said City, and the s= id plans being; numbered 112, 200, 205, 2061 207, 208 and 209, and all of sair plans and specifications be- ing now on file in the office of the City Engineer of the City of Huntington Beach, and each and all of the plans and specifications are hereby referred to for a more particular description of the said proposed v!ork; and it is proposed tent she depth, size, material, manner of construction and location of said sexier shall be in accord- ance with the aforesaid plans and specifications. Section 2. The said Board of Trustees hereby determines and declares thy=t said proposed work and improvement is of more than i local or ordinarypublic benefitf p c and will affect and benefit the lands and district hereinafter described, and which said district is hereby declared to be the district affected and benefited by -2- :?. said work and improvement, and that , therefore, the entire cost and expense of said ,,,!ork and improvement shall be and are hereby, made chargeable against and shall be assessable upon said lands and dis- trictl i,!hich district is within the City of Huntington Beach, County of Orange, State of Cslifornia, and the exterior boundaries of said district and of sp.i , lands r?,f fected and benefited by said work, ex- clusive of any land within said boundaries which is now a -,-,)art of the oublic streets alleys and Trays, are particularly described as follows, to-wit: Beginnin.,, at the point of intersection of the 17orthiresterly line of Eleventh Street with the Southwesterly line of the first alley Ii.lortheasterly from Ocean Avenue and running thence North- z,esterly along; the last mentioned alley line to its intersection v,ith the Southe,�.sterlir line of Twelfth Street, thence Northeasterly along the Southeasterly line of Twelfth Street to its intersection with the Southwesterly line of Orange Avenue, t!"Lence Northwesterly along the SouthiT,!esterly line of Orange Avenue to its intersection with the Southeasterly line of Thirteenth Street, thence TLVT orth.- easterly along the Southeasterly line of Thirteenth Street to its intersection with the Southwesterly line of Acacia. That serial bonds shall be issued to represent assessments of 4125.(-)0, or over, for the cost and expense Of said -3- I-J, 'r� work and improvement; that said serial bonds shah_ extend over a period of nine years from the 2nd day of January next succeeding their date, and an even annual portion of the principal sum there- of shall be payable, by coupons , on the 2nd day of January every year after their date, until the ix1hole is paid, and the interest shall be payable semi-annually, by coupons, on the 2nd day of Jan- uary and July, respectively, of each year at the rate of seven per cent. per annum, on all sums unpaid, until the whole of said prin- cipal and interest are paid. Section 4. All of said work shall be do--:e in accordance with the aforesaid plans and specifications heretofore prepared and furnished by the City .engineer of said City, and adopted for the doing of said work, and which are now on file in the office of the City Engineer of said City, and are hereby referred to for furtrier and -Ilore nart .cuDar descrii)tion of said work. Section 5. The City Clerk shall cause this Resolution of Intention to be published trice in the Huntington Beach T?ews, a weekly newspaper published and circulated in said City, and here- by designated for that purpose by said Board of Trustees. Section 6. The Street Superintendent of said City shall immediately cause to be conspicuously posted, along the line of said contemplated work and improvement and in front of all of the property liable to be assessed, notices of the passage of this Resolution of Intention in the manner and form rewired by law. Section 7. All of the herein proposed t�rork shall be done in pursuance of an Act of the Legislature of the State of California, designated as the Improvement Act of 1911, approved April 7th, 1911. -4- F T i E.
