RESOLUTICI 110. 259 —
A Resolution ordering, the vrork, Pursuant to
Resolution of Intention, No. 257, of the Board of
Trustees of the City of Hulsting ton Beach.
The Board of Trustees of the City of Huntington Beach,
California, do hereby resolve, as follows:
RESOLVED, that whereas the Board of Trustees of said City
of Huntington Beach did on the 8th day of February, 1915, pass
its Resolution of Intention, No. 257, to order the hereinafter
described work to be done and imrrovements to be made in said
City of Huntington Beach, which. Resolution of Intention was duly
and regularly published as required by law, as appears by the af-
fidavit of Jas. J. Conrad, now on file in the office of the. City
Clerk of the City of Huntington Beach; and whereas, notices of pas-
sage of said Resolution of Intention, 1To. 257 , he ,ded 1°T?otice of
Improvement" were duly and legally posted by the Street Superin-
tendent of said City along the line of said contemplated work and
improvement and in front of all of the property liable to be asses-
sed therefor, in form and manner as required by law immediately af-
ter the publication of said Resolution of Intention, as appears by
the affidavit of J. Tinsley, Street Superintendent of the said City
of Huntin- ton Beach, who, upon the completion of the posting of said
notices forthwith, filed sa i:a_ --.f f idavit in the office of the City
Clerk of saicl City, makinc-; oath that he completed the 1-)ostin�; of
said notices on the day of February, 1915; and whereas, more
than fifteen days have expired since the day of the second publi-
cation of said Resolution of Intention, Lgol 257, and the completion

of the posting of said "T'otices of Improvement" , therefore be it
RESOLVED, t-at t:ie �-) ,Iblic interest and convenience require
the work herein described, and the Board of Trustees of said
City of Huntington Beach hereby orders the follov!ing stated �R=ork
to be done in said City, to- it:
That a sewer be constructed for sanitary purposes along
and in certain streets, avenues , alleys, pla.,ces and public way
in said City, the center line of said set�Ter being described as
follows:
Commencing at a point in the first alley Northeasterly
from Ocean Avenue four and a, half feet Yortheasterly from the
Southwesterly line of said alley and four and a half feet South-
easterly from the Northwesterly line produced of the first alley
Idorthv!esterly from Eleventh Street; thence Northeasterly along
and in said last mrel.itioned alley four and a, half feet Southeast-
erly from the line of s<.id alley any'_ se id line -pro-
duced to tl}e Yorthea.sterly -line of Orange Aven,ae; thence continu-
ing in a strai ht line }Tortheasterly through Blocks 411 and 511,
of "Huntington Beach, Seventeenth St. Section, " as shown on a
map recorded in Book 4, at page 10, of I.Tiscellaneous Traps , Records
of Orange County, California, along the center of a. certain right
of way described in a certain deed, recorded in Book 254, at page
203 of Deeds, Records of said Orange County, said right of if,ay be-
ing a. -oublic way ten feet in width, lying and being, five feet in
17,ridth on each side of a center line, i^hicAi is 128 feet Northwest-
erly from and parallel to the 'Northv esterly line of Eleventh
Street , to a boint seventeen and a half feet Southwesterly from

the Southwesterly line of Acacia Avenue.
That sai,6' serrer shall be constructed and the Fork of con-
structing the same shall be done in accordance with certain -01ans
an. soecifice_tions and careful estimates of the costs and exnenses
thereof heretofore -)re-oared and- furnished to the City Council of
saio- City by the City -Engineer of sa.ACL City, the said snecifica-
tions beii--, Specifications '"o. 9 as adoT)ted and -o-rovided by
Ordinance Yo. 143, of said City, and the said ;Mans being number-
ed 112, 200, 205, 206, 207, 208, and 209, all of said plans and
snecificzations beiiv,,: no- on file in the office of the City EEngi-
neer of the City of ITiintin-'ton De�p,_ch, anC. each and all of the
plans -nd s-riecifications are hereby referred to for a, more par-
ticular descriiPtion of the said ---)ron-osed ixTork; and it is ordered
th,-,'U the depth, size, material, manner of construction and loca-
tion of said server shell be in accordance with the' aforesaid
?clans and specification.
Be it further RESOLVED, that said Board of Trustees hereby
determines and declares that said -oronosed work and inmorovement
is of more than local or ordinary public benefit and will affect
and benefit the lands and district hereinafter described, and
Which said district is hereby declared to be the district affect-
ed and benefited by said work and improvement , and that, there-
fore, the entire cost and expense of said i,.!ork and inprovelment
shell be , and are hereby, ma-de chargeable ai--�,,Pinst and shall be
as-essable u-Pon said lands and district , which district is within
the City of Huntington Beach, County of Orange , State of Califor-
nia., and the exterior boundaries of said district and of said lands

affected and benefited by said work, exclusive of any land with-
in said boand��ries i}7hich is now a Hart of the ;public streets, al-
leys and ways, are particularly described as follows, to-writ:
Beginning, at the point of intersection of the Northwesterly
line of Eleventh Street zarith the Southta.!esterly line of the first
alley Northeasterly from Ccean Avenue and runnin'; thence i'orthvrest-
erly along the last entioned alley line to its intersection with
the Southeasterly line of TTI=elfth Street, thence Yortheasterly
a.1ong the Southeasterly line of Tinelfth Street to its intersection
with t=,.e South�resterly line of Orange ,Avenue, thence T?orthwesterly
along=, the Southwesterly line of Orange .Avenue to its intersection
with the Southeasterly line of Thirteenth Street, thence North-
e <sterly along the Southeasterly line of Thirteenth Street to its
intersection with the Southwesterly line of .Acacia, Avenue, thence
Southeasterly along; the Southeesterly line of Acacia .Avenue to its
intersection with the 17orthiresterly line of :eleventh Street, thence
Southwesterly alonfj the Northwesterly line of Eleventh Street to
the point of beginning, excepting; from the said district all lands
with the aforesaid boundaries now a. part of the 'aublic streets,
alleys and weys of said Cite of Hunting-ton Beach.
Be it further:° ESOLVEB, that serial bonds shall be issued
to represent assessments of $25.00, or over, for the costs and
expenses of said work and im;:)rovement; that said serial bonds
shall extend over a period of nine years from the 2nd day of Janu-
ary next succeedi-n t-- eir date , and an even annual portion of the
Drincipal sum thereof shall be payable, by coupons, on the 2nd day
of January every year after their date, until the whole is paid,

and the interest shall be payable semi-annually, by coupons, on

the 2nd day of T anuary an respectively, of each y U ear at the
rate of seven -,-per cent ner annum, on all sums un-oaid, until the
whole of said orinci-oal and interest are -n a i d.
Be it further RESOLVEDY that all of the s,--id v,ork so order-
ed shall be done in accordance with tie aforesaid plans and, speci-
fications heretofore -ore-oared and furnished by the City Engineer
of said City, and adopted for t.-,,Le doing of said -work, and which
are novr of file in Vae office of the City Zngineer of said City,
and are hereby referred to for further and riiore oarticular descri-,)-
tion of said work; that all of the said work shall be done in ,our-
nuance of an act of the Legislature of the State of California., de-
signated as the Improvement Act of 1911, approved April 7th, 1911,
and nursuant to the said, 7esolution of Intention 17o. 257, vrhich is
hereby referred to for further narticulars;
Be it further RESOLVED, the City Clerk of said City is
hereby directed to nost notices of said 1Arork, togeti-i.er -,,-Ith the
snecification therefor, conspicuously for five days on or near the
Council Chamber door of the City Council,

said City, to-wit: The front door of the, City Hall in said City
of Huntington Beach, inviting- sealed pro-posals or bids for doing
the, if,orlk ordered; and said City Clerk is directed to Publish a,
notice inviting such propose.ls and referrin-- to the specifications
posted, or on file , twice in the Huntington Beach Neirs, a weekly
newspaper published and circulpte , in the City of Huntington Beach,
and hereby designated for that purpose, and it is ordered that
the tirzie fixed for the opening of said T)roposals or bids shall be

. not less than ten days from the time of the first r)ublica.tion or
posting of sa;.ic.- notices.
Be it further RESOLVED, tho.t all -proposals or bids offered
for doing said work shall be accompanied by a. check, 0. a,yable to
the City, certified by a responsible Bank, for an a:_iount which
shall not be less than ten per cent. of the aggregate of the pro-
posal, or by a bond for the spid amount, and so payable, signed
by the bidder and t,rTo sureties , who shall ,justify before an of-
ficer competent . to e,,dminister an oath, in double said amount, and
over and above all statutory exemptions.
