HomeMy WebLinkAboutCity Council - 268A t RESOLUTION NO. 268 A A RESOLUTION ORDERING THE WORK, PURSUANT TO RESOLUTION OF INTENTION, NO. 265 OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTIrGTON BEACH. The Board of Trustees of the C ity of Huntington Beach, California, do hereby resolve , as follows : RESOl,,VED, that whereas the Board of Trustees of said City of Huntington Beach did on the 7th day of May, 1915, pass its Resolution of Intention, No.265, to order the hereinafter described work to be done and improvement to be made in said City of Huntington Beach, which Resolution of Intention was duly and regularly published as required by law, as appears by the affidavit of Jas . J. Conrad, now on file in the office of the City Clerk of the City of Huntington Beach; and whereas, notices of the passage of said Resolution of Intention, No. 265, headed "Notice of Improvement" were duly and legally posted by the Street Superintendent of said City along the line of said contemplated work and improvement and in front of all the property liable to be assessed therefor, in form and manner as required by law, immediately after the publication of said Resolution of Intention, as appears by the affidavit of J. Tinsley, Street Superintendent of the said 6ity of Huntington Beach, who, upon the completion of the posting of said notices forthwith, filed said affidavit in the office of the City Clerk of said City, making oath that he completed the posting of said notices on tie 18th day of IVlL y, 1915; and whereas , more than fifteen days have expired since the day of the second ouls licatibn of s .id Resolution of Intention, No. 265 , �,.nd the com- T - pletion of the posting of sz "Notice Notice of Improvement" , there- for be it RESOLVED, that ,-"the public interest and convenience re- quire the work herein described, and the Board of Trustees of said City of Huntington Beach hereby orders the following stated work to be done in said City, to-wit : That a sewer be constructed for sanitary purposes along and in certain street, avenues , alleys , places and public w .ys in said City, the center line of said sewer being described as follows : Commencing in the first alley Northwesterly from Main Street at a point four and one half feet Northeasterly from the South- ``'esterly line of the first alley Northeasterly from Ocean Avenue , which point is four and one half feet Southeasterly from. the Porthwesterly line produced of the first -alley Northwesterly from Main Street; running thence Northeasterly in said first mentioned alley along a line four and one half feet South- easterly from and parallel to the Northwesterly line of said first mentioned alley to a point in the center line of Fifth Street. Also, commencing at a point in the first alley Northwesterly from Fifth Street four and one half feet Northeasterly from the Southwesterly line of the first alley Northeasterly from Ocean Avenue, which point is four and one half feet Southeasterly from the (Northwesterly line produced of the first alley Northwesterly from: Fifth Street; running thence Northeasterly along a line four and one half feet Southeasterly from and parallel to the North- westerly line of the firwt alley Northwesterly from Fifth Street to a point eighteen (18) feet Southwesterly from the Southwesterly 2. • line of Orange Avenue. The said sewers shall be constructed, and the work of con- structing the same shall be done, in accordance with certain. plans, profiles and specifications and careful estimates of the costs and expenses thereof, heretofore prepared and furnished to the City Council of said City by the City Engineer of said City, the said specifications being specifications No.9, as adopted and provided by Ordinance No.143 of said City, and the said plans and 'orofiles being numbered 118, 200, 205, 207 and 204; all of said plans profiles and specifications being now on file in the office of the City Engineer of said City of Huntingtnn Beach, and each and all of said Plans , profiles and specifications are hereby referred to for a more particular description of said work; and it is ordered that the depth, size , material , manner of construction and location of the said sewers shall be in accord- ance with the aforesaid plans , profiles and specifications. Be it further RESOLVED, that said Board of Trustees bereby determines and declares that said proposed work and improvement is of more than local or ordinary public benefit and will affect and benefit the lands and district hereinafter described, and which slid district is hereby declared to be the district affected and benefited by said work and improvement, and that, therefore, the entire cost and expense of said work and improvement shall be and are hereby, made chargeable against and shall be assess- able upon said lands and district, which ;district is within the City of Huntington Beach, County of Orange, State of California, and the exterior boundaries of said district and of said lands affected and benefited by said work, exclusive of any land with- , 2. i in said boundaries which is now a park of the public streets, alleys , and ways , are particularly described as follows, to-wit: Beginning at the point of intersection of the Northwesterly line of Main Street witn the Southwesterly line of the first alley Northeasterly from Ocean Avenue and running thence North- eaa.terly along the Northwesterly line of Hain Street, to its intersection witn the Southwesterly line of Magnolia Avenue , thence Northwesterly along the Southwesterly line of Magnolia Avenue to its intersection witn the Southeasterly line of Sixth Street, thence Southwesterly along the Southeasterly line of Sixth Street to its intersection with the Southwesterly line of the first alley Northeasterly from Ocean Avenue, thence along the Southwesterly line of the last mentioned alley to the point of beginning, excepting from the said district all lands within the aforeesaid boundaries now a oart of the public streets , alleys and ways of said City of Huntington Beach. Be it further RESOLVED, that ,serial bonds shall be issued to represent assessments of $25 .00, or over. for `n.e cost and expense of said wore and improvement; that said serial bonds shall extend over a period of nine yeard from the 2nd day of January next succeeding their date , and an even annual portion of the principal sum thereof shall oe payable , by cou- pons , on the 2nd day of Uanuary every year after their date , until the- whale is paid, and the interest shall be payable semi- annually, by coupons, on the 2nd day of January and July, res- pectively, of each year at the r&te of seven per cent per annum, on all sums unpaid, until the whole of said principal and in- terest ate paid. 3. Be it further RESOLVED, that all of the said world so ordered shall be done in accordance with the aforesaid plans and speci- • fications heretofore prepared and furnished by the City Engineer of said City, and adopted for the doing of said work, and which are now on file in the dice of the City Engineer of said City, and are hereby referred to for further and more particular des- cription of daid work; that all of the said worlk shall be done in pursuance of an act of the Legislature of the State of Cali- fornia, designated as the Improvement Act of 1911, approved April 7th, 1911 , and pursuant to the said Resolution of Inten- tion, No. 265, which is hereby referred to for further particu- lars; Be it further RESOLVED, that the City Clerk of said City is hereby directed to post notices of said work, together with the specifications therefor, conspicuously for five days on or near the Council Chamber door of the City Council, or Board of Trustees said City, to-wit : The front door of the City Hell in said City of Huntington Beach, inviting sealed proposals or bids for doing the work ordered; and said City Clerk is directed to publish a notice inviting such proposals and referring to the sepcif cations posted or on file, twice in the Huntington Beach News , a. weekly newspaper published and circulated in the City of Huntington Beach, and 'hereby designated for that purpose, and it is ordered that the time fixed for the opening of said proposals or bids shall be not less than ten days from the time of the first publication or posting of said notice. . Be it further RESOLVED, that all, proposals or bids offered for doing said work shall be accompanied by a check, payable to 4. • • the City, certified by a responsible bank, for an amount which shall not be less than ten per cent of the aggregate of the proposal, or by a bond for the said amount, and so payable , signed by the bidder and two sureties , who shall justify before an officer competent to administer an oath, in double said amount, over and above all statutory exemptions.
