HomeMy WebLinkAboutCity Council - 269A • RESOLUTION OF INTENTION NO. 269 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION OF SEWERS ALONG AND IN CERTAIN STREETS, ALLEYS, AND PUBLIC NAYS IN SAID CITY OF HUNTINGTON BEACH, AND PRO- VIDING THAT THE PROPOSED WORD{ BE DONE UNDER "THE IIVITPROVEMENT ACT OF 1911" The Board of Trustees of the City of Huntington Beach do hereby resolve as follows : That sewers be constructed for sanitary urposes along and in certain Streets , Alleys , and public '?nays in sE,id City, the center lines of said sewers being described as fo116ws , to-wit: Co. encing in the first alley Northwesterly from Eight Street at a point four and a half feet Northeasterly from the South�x.esterly line of the first alley Northeasterly from Ocean Avenue , which point is four and a half feet Southeasterly from the Northwesterly line produced of the first alley Northwesterly from Eight Street; running thence Northeasterly in said first mentioned alley along a line four and A half feet Southeasterly from and parallel to the Northwesterly line of said first mentioned , alley to a point eighteen (18) feet Southwesterly from the South- westerly line,of Palm Avenue. Also , commencing at a point in the first alley Northwesterly from Ninth Street four and a half feet Northeasterly from :the Southwesterly line of the first alley Northeasterly from Ocean Avenue, which point is four and a half feet Southeasterly from 1 . • the Northwesterly line produced of the first alley North- westerly from Ninth Street; running thence Northeasterly along; a line four and a half feet Southeasterly from and Para- llel to the Northwesterly line of the First alley Northwesterly from Ninth Street to a point eighteen feet (18) Southwesterly from the Southwesterly line of Palm Avenue . The said sewers shall be constructed, and the work of constructing the same shall. be done , in accordance with c@rtain plans, profiles and specifications and careful estimates of the costs and. expenses thereof, heretofore prepared and furnished tc _ the city Council of said City by the C ity Engineer of said City, the said specifications being specifications No.9, as adopted and provided by Ordinance No.143 of said City, and the said plans and profiles being humbered 122, 200, 205, 207 , 208 and 204; all of said plans , profiles and specifications being now on file in the office of the City Engineer of said City of Hunting- ton Beach, and each and all of said plans, profiles and specifi- cations are hereby referred to for a more particular description of said work; and it is proposed that the depth, size, material, manner of construction and location of said sewers shall be in accordance witn the aforesaid plans , profiles and specifications Section 2. The said Board of Trustees hereby determines and declares that said proposed word and improvement is 'of more than local or ordinary public benefit; that said proposed sewers will be located near together and will connect tith the same main line and form portions of the same general sewer system of said City and will affect and benefit the lands and district herein- after described, and. which said district is hereby declared to 2 f i be the district affected and benefited b,,T said work and im- provement, and that, the entire cost and expense of said work and improvement shall be, and are hereby, made chargeable against and shall be assessable upon said lands and district, which dis- trict is within the City of Huntington Beach, County of Orange , State of California, and the exterior boundaries of d_aid district and of said lands affected and benefited by said work and improve- ment, exclusive of ahy land within said boundaries which- is now a. part of the public streets, alleys and ways, are particularly described as follows, to-wit: Beginning at the ;point of intersection of the Northwesterly line of Eight Street with the Southwesterly line of the first alley Northeasterly _from Ocean Avenue t.nd running thence North- easterly along the Northwesterly line of Eight Street, to its intersection with the Southwesterly line of Palm Avenue , thence Northwesterly along the Southwesterly line of Palm Avenue to it intersection with the Southeasterly line of Tenth Street , thence Southwesterly along the Southeasterly Line of Tenth Street to its intersection with the Southwesterly line of the first alley northeasterly from Ocean Avenue, thence along the Southwesterly line of the last mentioned alley to the ;point of beginning, excepting from the said district all lands within the aforesaid boundaries now a, part of the public streets ,alleys and ways of said City of Huntington Beach. Section 3 . That serial bonds shall be issued to represent assessments of $25.00, or over, for the cost and expense of said work L_;_nd improvement; that said serial bonds shall extend over a period of nine years from the 2nd day of January next succeeding 3. • • their date, and an even annual portion of the principal sum thereof shall be payable , by coupons , on the 2nd day of January every year after their date , until the whole is paid, and the interest shall be payable semi-annually, by coupons , on the 2nd day of January and July, respectively, of each year at the rate of seven per cent per annum, on all sums unpaid, until the whole of said principal and interest are paid. Section 4. All of said work :>hall be done in accordance with the aforesaid plans , orofiles and specifications heretofore flrepared and furnished by the City Engineer of said City, and adopted for the doing of said work, and which are now on file in the office of the City Engineer of said City, and are hereby referred to for further and more particular description of said work. Section 5. The City Clerk shall cause this Resolution of Intention to be published twice in the Huntington Beach News, a weekly newspaper published and circulated in said City, and hereby designated for that :purpose by said Board of Trustees. Section 6. The Street Superintendent of said City shall immediately cause to be conspicuously posted along the line of said contemplated work and improvement , and in front of all pro- perty liable to be assessed, notices of the passage of this Resolution of Intention in the manner and form required by law. Section 7. All of the said proposed work and improvement shall be done in pursuance of an act of the Legislature of the State of California, designated as the Improvement Act of 1911, approved Aoril 14th, 1911.
