A RESOLUTION ORDERING THE WORK, PURSUANT TO RESOLU-
TION OF INTENTION NO. 267 OF THE BOARD OF TRUSTEES
OF THE CITY OF HUN TINGTON BEACH.
The Board of Trustees of the City of Huntington Beach,
California, do hereby resolve, es follows :
RESOLVED, that whereas the Board of Trustees of said
City of Huntington Beach did on the 7th day of June , 1915,
pass its Resolution of Intention No. 267, to order the here-
inafter described work to be done and improvements to be made
in said City of Huntington Beach, which Resolution of Intention
was duly and regularly published as required by law, as appears
by the affidavit of Jas . J. Conrad, now on file in the office
of the City Clerk of the City of Huntington Beach; and whereas ,
notices of the passage of said Resolution of Intention No.267,
headed "Notice of Improvement" were duly and legally posted *by
the Street Superintendent of said City along the line of s�-id
contemplated work and improvement and in front of all the pro-
perty liable to be assessed therefor, in form and manner as re-
quired by law, immediately after the publication of said Reso-
lution of Intention, as aopears by the affidavit of J. Tinsley,
Street Superintendent of the said City of Huntington Beach, who,
upon the completion of the posting; of said notices forthwith,
filed said affidavit in the office of the City Clerk of said
City, making oath that he completed the posting of said notices
on the 15th day of June , 1915; and Whereas, more than fifteen
days have expired since the day of the second publication of
said Resolution of Intention No. 267, and the completion of

the posting of said "Notices of Improvement" , therefore be it •
Resolved, that the public interest and convenience require
the work herein described, and the Board of Truatees of said
City of Huntington Beach hereby orders the following stated
work to be done in said City, to-wit:
That a sewer be constructed for sanitary purposes along
and in certain streets , avenues , alleys , places and public ways
in said City, the center line of said sewer being described as
follows , to-wit:
Commencing in the first alley Northwesterly from Tenth
Street at a point four and one half feet Northeasterly from the
Southwesterly line of the first alley Northeasterly from Ocean
Avenue, which point is four and one half feet Southeasterly from
the Northwesterly line produced of the first alley Northwesterly
from Tenth Street; running thence 'northeasterly in said first
mentioned alley along a line four and one half feet Southeasterly
from and parallel to the Northwesterly line of said first mentioned
alley to a point eighteen feet Southwesterly from the Southwest-
erly line of Acacia Avenue .
That said sewers shall be constructed, and the work of
constructing the same shall be done, in accordance with certain
plans, profiles and specifications and careful estimates of the
costs and expenses thereof, heretofore prepared and furnished to
the City Council of said City by the City Engineer of said City,
the said specifications being humbered specifications No.9, as
adopted and provided by Ordinance No.143 of said City, and the
said plans and profiles being, numbered 120, 200, 205, 207 , 208
and 204; all of said plans , :profiles and specifications being Uions

now on file in the office of the City Engineer of said City
• of ?-.untington Beach, and each and all of said plans , profiles
and specifications are hereby referred to -17or a more parti-
cular description of said work; and it is ordered that the
depth, size , material , manner of construction and location of
said sewer shall be in accordance with the aforesaid plans,
profiles and specifications.
Be it further Resolved, that said Board of Trustees
hereby determines and declares that said proposed work and im-
'orovement is of more than local or ordina.nry public benefit and
will affect and benefit the lands and district hereinafter des-
cribed, and which said district is hereby declared to be the
district affected and benefited by said work and improvement,
and that, therefore , the entire cost and expense of said work
and improvement shall be, and are hereby, made chargeable
against and shall be assessable upon said lands and district,
z,=.h ich district is within the City of Hulntington Beach, County
of Orange , State of California, and the exterior boundaries
of said district and of said lands affected and benefited by
said work, exclusive of any land within said boundaries which
is now a. past of the public streets , alleys and ways, are
particularly described as follows , to-wit:
Beginning at the point of intersection of the Northwesterly
line of Tenth Street with ;the Southwesterly line of the first
alley Northeasterly from Ocean Avenue and running thence North-
easterly along the Northwesterly line of Tenth Street to its
intersection witn the Southwesterly line of Acacia Avenue, thence
Northwesterly along the Southwesterly line of Acacia Avenue to

its intersection with the Southeasterly line of Eleventh Street,

thence Southwesterly along the Southeasterly line of Eleventh
Street to its intersection witn the South.7esterly line of the
first alley Northeasterly from Ocean Avenue , thence Southeasterly
along the Southwesterly line of the last mentioned alley to the
point of beginning.
Be it further Resolved, that serial bonds shall be
issued to represent assessments of $25.90, or over, for the
cost and expense of said work and improvement; that said serial
bonds shall extend over a period of nine years from the 2nd day
of January next succeeding their date, and an even annual portion
of the principal sum thereof shall be payable, by coupons , on the
2nd day of January every year after their date , until the whale
is paid, and the interest shall be :payable semi-annually, by
cou^ons , on the 2nd day of January and July, respectively, of each
year at the rate of seven per cent per annum, on all sums unpaid.
until the whole of said principal and interest are paid.
Be it further Resolved, that all ^f the said work so
ordered shall be done in accordance witn the aforesaid plans and
specifications heretofore prepared and furnished by the City En-
gineer of said City, and adopted for the doing of said work, and
which are now on file in the office of the City Engineer of said
City, and are hereby referred to for further and more particular
description of said work; that all of the seid work shall be done
in pursuance of an act of the Legislature of the State of Calif-
ornia, designated as the Improvement Act of 1911, approved April
7th, 1911 ; and pursuant to the said Resolution of Intention No.
267, which is hereby referred to for further particulars;

Be it further
r Resolved, that the C ity Clerk of said
City is hereby directed to post notices of said work, together
with the specifications therefor , conspicuously for five days on
or near the Council Chamber door of the City .Ceuncil, or Board
of Trustees of said City, to-wit: The front door of the City
Hall i: n said City of Huntington Beach, inviting sealed propo-
_sals or bids for doing the work ordered; and ;aid City Clerk
is directed to publish a notice inviting such proposals and
referring to the specifications posted, or on file, twice in the
Huntington Beach News , a weekly newspaper published and circu-
lated in the City of Huntington Beach, and hereby designated
f'or that purpose , and it is ordered that the time fixed for the
opening of said proposals or bids shall be not less than ten.
days from the time of the first publication or posting of said
notice.
Be it further Resolved, that all proposals or bids offered
for doing said work shall be accompanied by a check, payable to
the City, 'certified by a responsible bant, for an amount which
shall not be less than ten per cent of the aggregate of the
proposal , or by a bond for the said amount, and so payable,
signed by the bidder and two sureties , who shall justify before
an officer competent to administer an oath, in double said
amount, and over and above all statutory exemptions .

ordering work No.272, was duly and regularly passed and adopted
by the Board of Trustees of said City of Huntington Beach at a
