RESOLUTION No. M 14
A RESOLUTION ORDERING THE MRK� PURSUANT TO RESO-
LUTION OF INTENTION NO. 269 OF THE BOARD OF TRUE-
TEES OF THE CITY OF HUNTI4GTON BEACH.
The Board of Trustees of the City of Huntington Beach, California,
do hereby re solve, as follows
Resolved, that whereas the Board of Trustees of said City
of Huntington Beach did on the loth day of June, 1915 pass its
Resolution of Intention No. 269, to order the hereinafter
described work to be done and improvement to be made in said
City of Huntington Beach, which Resolution of Intention was
- duly and regularly published as required- by law, as appears by
the affidavit of Jas. J. Conrad, now on file in the office of
of the City Clerk of the City of Huntington Beach; and whereas,
notices of the passage of said Resolution of Intention No.269,
headed "Notice of Improvement" were duly and legally posted
by the Superintedent of Streets of said City along the line
of said contemplated work and improvement and in front of all
the property liable to be assessed therefor, in form and manner
as required by law, ismmediately after the publication of said
Resolution of Intention, as appears by the affidavit of J.Tinsley,
Street Superintendent of the said City of Huntington Beach, who,
upon the completion of the posting of said notices forthwith,
filed said affidavit in the office of the City Clerk of said
City, making oath that he completed the posting of said notices
on the 23 day of June , 1915; and whereas, more than fifteen days
have expired since the day of the second publication of said

posting of said 'Notice of Improvement" , therefore be it,
RESOLVED, that the public interest and convenience require
the work herein described, and the Board of Trustees of said
City of Huntington Beach hereby orders the following stated
work to be done in said City, to-wit :
That sewers be constructed for sanitary purposes along
and in certain streets, Avenues, Alleys and public Ways in said
City, the center lines of said sewers being described as follows,
to-wit :
Commencing in the first alley Northwesterly from Eighth
Street at a point four and one half feet Northeasterly from the
Southwesterly line of the first alley Northeasterly from Ocean
Avenue, which point is four and one half feet Southeasterly from
the Torthwesterly line produced of the first alley Northwesterly
from Eighth Street; running thence Northeasterly in said first
mentioned alley along a line four and one half feet Southeasterly
from and parallel to the Northwesterly line of said first men-
tioned alley to a point eighteen (18) feet Southwesterly from
the Southwesterly line of Palm Avenue.
Also, commencing at a point in the first alley Northwesterly
from Ninth Street four and one half feet Northeasterly from the
Southwesterly line of the first alley Northeasterly from Ocean
Avenue, which point is four and one half feet Southeasterly
from the Northwesterly line produced of the first alley North-
westerly from Ninth Street; running thence Northeasterly along
a line four and one half feet Southeasterly from and :--.parallel
to •the Northwesterly line of the first alley Northwesterly from

Ninth Street to a point eighteen (18) feet Southwesterly from
the Southwesterly Line of Palm Avenue.
That said sewers shall be constructed, and the work of
constructing the same shall be done, in accordance with certain
plans, profiles and specifications and careful estimates of the
costs and expenses thereof, heretofore prepared and furnished
City by the City Engineer of said City, the said
to the City Council of said/specifications being specifications
No.9, as adopted and provided by Ordinance No.143 of said City,
and the said plans, and profiles being numbered 122, 200, 205,
207, 209 and 204; all of said plans, profiles and specifications
being now on fil6 in the office of the City Engineer of said
City of Huntington Beach, and each and all of said plans, profiles
and specifications are hereby referred to for a more particular
description of said work; and it is ordered that the depth, size,
material, manner of construction and location of said sewers
shall be in accordance with the aforesaid plans , profiles and
specifications.
Be it further RESOLVER, that said Board of Trustees hereby
determines and declares that said proposed work and improvement
is of more than local or ordinary public benefit and will affect
and benefit the lands and district hereinafter described, and
which said district is hereby declared to be the district affected
and benefited by said work and Improvement, and that,therefore,
the entire cost and expense of said work and improvement shall
be, and are hereby, made chargeable against and shall be assesseC;.
able upon said lands and district , which district is within the

and the exterior boundaries of said district and of said lands

affected and benefited by said work and improvement, exclusive
of any land within said boundaries which is now a part of the
public streets, alleys , and ways , are particularly described as
follows, to-wit:
Beginning at the point of intersection of the Northwesterly
line of Eight Street with the Southwesterly line of the first
alley Northeasterly from Ocean Avenue and running thence North-
easterly along the Northwesterly line of Eight Street to its
intersection with the Southwesterly line of Palm Avenue; thence
Northwesterly along the Southwesterly line of Palm Avenue
to its intersection with the Southeasterly line of Tenth Street;
thence Southwesterly along the Southeasterly line of Tenth
Street to its intersection with the Southwesterly line of the
first alley Northeasterly from Ocean Avenue; thence along the
Southwesterly line of the last mentioned alley to the point
of beglhning, excepting from the said district all the lands with-
in the aforesaid boundaries now a part of the public streets,
alleys and ways of said City of Huntington Beach.
Be it RESOLVED, that serial bonds shall be issued to repre-
sent assessments of $25.001 or over, for the cost and expense
of said work and improvement; that said serial bonds shall
extend over a period of nine years from the 2nd day of January
next succeeding their date., and an even annual portion of the
principal sum thereof shall be payable, by coupons, on the 2nd
day of January every year after their date, until the whole
is paid, and the interest shall be payable semi-annually, by
coupons, on the 2nd day of January and July, respectively, of
each year at the rate of seven per cent per annum, on all

unpaid, until the whole of said principal and interest are paid.
Be it further RESOLVED, that all of the said work so or-
dered shall be done in accordance with the aforesaid plans and
specifications heretofore prepared and furnished by the City
Engineer of said City and adopted for the doing of said work,
and which are now on file in the office of the City Engineer
of said City, and are hereby referred to for a further and, more
particular description of said work; and that all of the said
work shall be done in pursiance of an act of the Legislature
of the State of California, designated as the Improvement
Act of 1911, approved April 7th, 1911; and pursuant to the
said Resolution of Intention No.269, which is hereby referred
to for further particulars.
Be it further RESOLVED, that the City Clerk of said City
is hereby directed to post notices of said work, together with
the specifications therefor, conspicuously for five days on or
near the Council Chamber door of the City Council, or Board of
Trustees of said City, to-wit : The fromt door of the City
Hall in said City of Huntington Beach, inviting sealed proposals
or bids for doing the work ordered; and said City Clerk is di-
rected to publish a notice inviting such proposals and referr-
ing to the specifications posted, or on file, twice in the
Huntington Beach News , a weekly newspaper published and circu-
lated in the City of Huntington Beach, and hereby designated for--,-
that purpose, and it is ordered that the time fixed for the
opening of said proposals or bids shall be not less than den
days from the time of the first publication or posting of said
notice.

Be it further RESOLVED, that all proposals or bids
offered for doing said work shall be accompanied by a check,
payable to the City, certified by a responsible bank, for an
amount which shall not be less than ten per cent of the aggregate
of the proposal, or by a bond for the said amount, and so pay-
able, signed by the bidder and two sureties, who shall justify
before an officer competent to administer an oath, in double
said amount, over and above all statutory exemptions.
