HomeMy WebLinkAboutCity Council - 276A RESOLUTION TJO. 2T6 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH DECLARING ITS INTENTION TO ORDER CERTAIN WORK DONE AND IMPROVEMMITS IVIADE ON CERTAIN STREETS, COURTS, PLACES AND PUBLIC WAYS IN THE CITY OF HU14TINGTOII BEACH; AND THE' THE PROPOSED STORK BE DONE UNDER "THE IMPROVEMENT ACT OF 19111t , AS AMENDED, AND GIVING NOTICE OF TIDE FOR HEARING OBJECTIONS. The Board of Trustees of the City of Huntington Beach California, do hereby resolve as follows: Section 1. That the public interest and convenience require, and that it is the intention of the Board of Trustees of said City, to order the following described work to be done and improvements to be made in and upon certain streets , courts, places and public ways in said City, to-wit : (a) That, Hain Street from the center line of Clay Street- to the North line of Orange Avenue; and Seventeenth Street from a line nine feet 'West of and parallel to the center line of Delaware Avenue, to Main Street; and Acacia Avenue from the East line of Main Street to the West line of the right of way of the Southern Pacific Railroad Company; and the Southeasterly one-half of Sixth Street from the Northeasterly line of Orange Avenue to the Southwesterly line of Magnolia Avenue; and the Northwesterly one-half of Fifth Street from the Northeasterly line of Orange Avenue to the Southwesterly line of 11JAgnolia Avenue; and Utica Street from the East line of Bain Street to the Northwesterly line of Seventeenth Street; be graded, crowned, paved, capped, surfaced, oiled, improved and constructed to the official grade thereof, in accordance with specifications No.8, 1. • as provided and adopted in Ordinance Numbered 125 and 164 of said City, now on file in the office of the City Clerk of said City, .-and -:in accordance with plans, profiles and cross-sections for said work and improvement numbered 124s 109, and 111, on file in the office of the City Engineer of said City, to which specifications, plans, profiles and cross-sections reference is hereby made for a more particular description of said work. (b) ThAb corrugated iron culverts be constructed across and in the above described portions of Vain Street and Seven- teenth Street in accordance with Specifications No.8, as ad- opted and provided in Ordinances numbered 125 and 164 of said City, and at the places and as shown on and in accordance with the said plans, profiles and cross-sections for said work hereinbefore referred to and on file in the office of the City Engineer of said City, to which reference is hereby made for a more particular description of said work and the location of said culverts. (c) That reinforced concrete pipe culverts and drains with concrete catch basins be constructed across and in the above described portions of Seventeenth Street in accord=e with specifications No.81 as adopted and provided in Ordinances numbered 125 and 164 of said City and at the places and as shown on and in accordance with said plans, profiles and cross-sections for said work hereinbefore referred to and on file in the office of the City Engineer of said City, which plans, profiles and cross-sections are hereby referred, to for a more particular description of said work. 2. (d) That a subway and approaches thereto under the tracks and road bed of the ,,:Southern Pacific Railway Company be built in the above described portion of Seventeenth Streeet with concrete retaining walls and concrete and wood supports for the railroad tracks and road bed) in accordance with Speci- fications No.9, as adopted and provided in Ordinances numbered 125 and 164 of said City) and at the place where said tracks and road bed cross said portion of Seventeenth Street, and as shown on and in accordance with s&id plans, profiles and cross- sections for said work hereiabefore referred to and on file in the office of the City Engineer of said City, to which reference is hereby made for a more particular description of said work and th6, location of said subway and qproaches thereto. W That open drain ditches be constructed along and in each side of Lake Avenue from Seventeenth Street to Utica Street in accordance with specifications No.8, as adopted and provided in Ordinances numbered 125 - and 164 of said City) and as shown on and in accordance with said plans) profiles and cross-sections for said work hereinberore referred to and on file in the office of the City Engineer of said City) to which plans) profiles and cross-sections reference to hereby made for a more particular description of said work. (f) Thztre-enforeed concrete pipe drains) with concrete end wall, be constructed along and in that certain public right of way fk7om Seventeenth Street to Wichita Street through Lot or Block 2301 of the East Side Villa Tract, described in that certain instrument recorded ,on page 3 B-5 of Book 277 of Deeds, Records of Orange County, California, and in Wichita Street from the right of way of the Southern Pacific Company to Huntington Avenue, in accordance with Specifications No.8, as adopted and provided by Ordinances numbered 125 and 164 of said City, and as shown on and in accordance with the plans, profiles and cross-sections hereinbefore referred to and on file in the office of the C1.ty Engineer of said City, to which plans, profiles and cross-sections reference is hereby made for a more particular description of said work. (g) That the park ways or courts in the center of Main Street from Loma Avenue to Clay Street be graded, crowned, im- proved and constructed in accordance with Specifications No.8, as adopted and provided in Ordinances numbered 125 and 164 of said City, and as shown on and in accordance with said plans, profiles and cross-sections hereinbefore referred to and on file in the office 6f the City Engineer of said City, to which plans, profiles and cross-sections reference is hereby made for a more particular description of said world. (h) That corrugated iron culverts be constructed across and in the park way or court in the center of Main Street from Loma Avenue to Clay Street, in accordance with Specifications No.8, as adopted and provided in Ordinances numbered 125 and 164 of said City, and as shown on and in accordance witn said plans, profiles and cross-sections hereinbefore referred to and on file in the office of the city engineer of said City, to which plans, profiles and cross-sections reference is hereby made for a more particular description of said work. (I) That cement curbs be built and constructed in and along the above described portion of Main Street, bordering 4. on and surrounding the park ways or courts in the center of Main Street, in accordance with Specifications No.l, as adopted and provided in Ordinances numbered 28 and 163 of said City and as shown on and in accordance with said plans, profiles and cross-sections hereinbefore referred to on file in the office of the City Engineer of said City, to which plans, profiles and cross-sections reference is hereby made for a more particular description of said world. Section 2. That all of the herein proposed work and im- provements shall be done and made in pursuance of An Act 6f the Legislature of the State of California, entitled, "An Act to Provide for work in and upon Streets, Avenues, Lanes, Alleys, Courts , Places and Sidewalks within Municipalities , and upon property and rights of way owned by Municipalities and for establishing and changing the grades of any such Streets, Ave- nues, Lanes , Alleys, Courts , Places and Sidewalks, and providing for the issuance and payment of Street Improvement Bonds to re- present certain assessments for the cost thereof, and providing a method for the payment of such Bonds" , approved April 7th, 1911, and the several acts amendatory thereof, or supplementary thereto; also in accordance with Specifications , Profiles and Cross-sections herein referred to. Section 3. That in the opinion of said Board of Trustees the said proposed and contemplated work and improvements are, and said Board of Trustees does hereby determine and declare that said proposed and contemplated work and improvements are of more than local or ordinary public benefit and will affect and benefit the lands and district hereinafter described, which • 5. t- C, i • district is hereby declared to be the district affected and benefited by said world and improvements, and, that the entim cost and exuense of said work and improvements shall be charge- able against and assessed upon said lands and district, which district is within the City of Huntington Beach, County of Orange, State of California, and that the exterior boundaries of the said lands and district affected and benefited by said work, exclusive of the strips and portions of land sought to be improved and ex- clusive of any land within said boundaries which is now a part of the public streets, courts or ways in said City, are particu- larly described, as follows, to-wit: Beginning at the point of intersection of the center line of Clay Street (north City Boundary Line) with the quarter section line running north and south through the center of section 2, T 6 S, R 11 W, S.B .B. & M. ; and running thence west two miles to the quarter section line running north and south through the center of Section 4, T 6 S, R 11 W, S. B. B. & M. ( the west city boundary line) , thence south along the last described quarter section lime ( the west city boundary line) to its intersection with a line which"is one hundred and eighty (180) feet southwesterly from and parallel to the center line of the right of way of the Los Angeles Inter-Urban Railway Co, as described in that certain deed recorded in book 155 at page 260 of Deeds , Records of Orange County, Cal: , thence South- easterly along the said line one hundred and eighty (180) feet southwesterly from and parallel to the center line of the said right of way of the Los Angeles Inter-Urban Railway Co.r to the quarter section line running north and south through the center of section 14, T 6 S, R 11 W, S.B.B.& M. thence north along said quarter section line produced through the center of Section 11, T 6 S, R 11 W, to its intersection with the produced south line of Wichita Street, thence east along the produced south line of Wichita Street to its intersection with the east line of Huntington Avenue , thence north along the east line of Huntington Avenue to its: intersection with a line fifty (50) feet southeasterly from and parallel to the southeasterly line of Seventeenth Street, thence northeasterly along said line fifty (50) feet southeasterly from and Para- llel to the southeasterly line of Seventeenth Street to its intersection with the center line of Clay Street ( the north city boundary line) thence west along the center line of Clay Street ( the north city boundary line) to its intersection with . a line fifty (50) feet northwesterly from and parallel to the northwesterly line of Seventeenth Street, thence Southwesterly 6. • along said line fifty (50) feet northwesterly from and para- • llel to the northwesterly line of Seventeenth Street to its intersection with the quarter section line running north and south through the center of section 2, T 6 S, R 11 W, S.B.B.& M. , thence north along the last described quarter section line tO the point of beginning. Section 4. That said Board of Trustees hereby further determined that serial bonds shall be issued to represent assess- ments of $25.00, or over, for the cost and expense of said work, and improvements; that said serial bonds shall extend over a period of nine •years from the 2nd day of January next succeeding their date and an even annual proportion of the principal sum thereof shall be payable, by coupon, on the 2nd day of January every year after their date, until the whole is paid, and the interest shall be payable semi-annually, by coupon, on the 2nd day of January and July respectively of each year at the rate of seven per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Section 5. That notice is hereby given that on the 4th day of October, 1915, at the hour of eight o' clock P.M. of said day at the city hall in said City of Huntington Beach, any and all persons hewing any objections to the proposed work and improvements may appear before the said Board of Trustees and show cause why said proposed work and improvements should not be carried out in accordance with this Resolution. Section 6. The City Clerk of said City shall cause this Resolution of Intention to be published twice in the Huntington Beach News, a weekly newspaper printed, published and circulated in said City, and hereby designated by said Board of Trustees for that purpose. • 7. c • Section 7. The Street Superintendent of said City shall forthwith cause to be conspicuously posted along the line of said contemplated work and improvement at not more than 300 feet in distance apart, but not less than three in all, and along all the open streets within said district at not more than 300 feet in distance apart, but not less than three in all on each street, notices of the passage of this Resolution of Inten- tion in the manner and form required by law, which notices shall contain also a statement of the day, hour and place when and where any and all persons having any objections to the proposed work or improvements may appear before the said Board of Trustees and show cause why said proposed work and improvements should not be carried out in accordance with this Resolution. Section 8. All of the herein proposed Cork and improve- ments and all proceedings taken in regard thereto shall be in pursuance of an in accordance witn the aforesaid Act of the Legislature of the State of California, designated as "The Improvement Act of 1911" , approved April 7th, 1911, and the several acts amendatory thereof. _ E.
