A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH CALIFORNIA DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION OF SEWERS ALONG AND IN CERTAIN STREETS, ALLEYS, AND PUBLIC WAYS IN SAID CITY OF HUNTING- TON BEACH, AND PROVIDING THAT THE PROPOSED WORK BE DONE UNDER "THE IMPROVET,C.ENT ACC' OF 1911" , AS AMENDED AND GIVING NOTICE OF TIME FOR HEARING OBJECTIONS. The Bdard of Trustees of the City of Huntington Beach do hereby resolve as follows: Section 1. That the public interest and convenience require, and that it is the intention of the Board of Trust- ees of said City to order, the following described work to be done and improvements to be made im and upon certain alleys, streets and public ways in said City, to-wit: That sealers be constructed for sanitary purposes along and in certain Streets, alleys and Public Ways in said City, the center lines of said sewers being described as follows, to-wit: Commencing in the first alley Northwesterly from Four- teenth Street at a point four and one half feet Northeast- erly from the Southwesterly line of the first alley North- easterly from Ocean Avenue, which point is four and one half feet Southeasterly from the Northwesterly line pro- duced of tie first alley Northwesterly from Fourteenth Street; running thence Northeasterly in said first men- tioned alley along a line four and one half feet South- easterly from and parallel to the Northwesterly line of -1- of said first mentioned alley to a point in the center line of Palm Avenue. Also , commencing at a point in the first alley North- easterly from Ocean Avenue four and one half feet North- • easterly from the Southwesterly line of the first alley Northeasterly from Ocean Avenue, w:^ich point is four and one half feet Southeasterly from the Northwesterly line produced of the first alley Northwesterly from Fourteenth Street; running thence Southeasterly along a line four and one half feet Northeasterly from and paralllel to the South- westerly line of the first alley Northeasterly from Ocean Avenue to a point four and one half feet Southeasterly from the Northwesterly line produced of the first alley Northwesterly from ThirteemtY Street. The said sewers shall be constructed, and the work of constructing the same shall be done in accordance with certain plans, profiles and specifications and carefules- timates of the costs and expenses thereof, heretofore pre- pared and furnished to the City Council of said City by the City Engineer of said City, the said specifiications being specifications No. 9, as adopted and provided by Ordinance No. 143 of said City, and the said plans and profiles being numbered 126,200,205,202,208,207, and 204; all of said plans profiles and specifications being now on file in the office of the City Engineer of said City of Huntington Beach, and each and all of said plans, profiles and specifications are -2- hereby referred to for a more particular description of • said work; and it is proposed that the depth, size, ma- terial , manner of construction and location of said sewers shall be in accordance with the aforesaid plans, profiles and specifications. Section 2. That said Board of Trustees hereby de- termines and declares that said proposed work and improve- ment is of more than local or "ordinary public benefit; that said proposed sewers will be located near together and will nonnect with the same main line and form portions of the same general sewer system of said City, and will affect and benefit the lands and district hereinafter described, and which said district is hereby declared to be the district affected and benefited by said work and improvement, and that , the entire cost and expense of said work and improve- ment shall be, and are hereby, made chargeable against and shall be assessable upon said lands and district , which district is within the City of Huntington Beach, Count,; of Orange, State of California, and the exterior boundaries of said district and of said lands affected and benefited by said work and improvement , exclusive of any land within said boundaries which is now a part of the public streets, alleys, and ways, are particularly described as follows, to-wit: Beginning at the point of intersection of the South- easterly line of Fifteenth Street with the Northeaasterly line of Ocean Avenue and running thence Northeasterly along -3- the Southeasterly line of Fifteenth Street to it Inter- section wit?: the Northeasterly line of Palm Avenue, thence Southeasterly along the Northeasterly line of Palm Avenue to it intersection with the Norwesterly line of Fourteenth Street; thence Southwesterly along the Northwesterly line of Fourteenth Street to a point twenty-five feet Northeasterly from the Northeasterly line of the first alley Northeasterly from Ocean Avenue, thence Southeasterly to a point on the Southeasterly line of Fourteenth Street , which point is the Northwesterly corner of lot 12 of block 113; thence South- easterly along the Northeasterly line of said lot 12 to the Northeasterly corner of said lot 12; thence Southerly to the Southwesterly corner of lot 11 of bloc-It 113; thence Southwesterly to the Northeasterly corner of lot 6 of block 113, thence Southwesterly along the Southeasterly lire of said lot 6 to the Northeasterly line of Ocean Avenue; thence Northwesterly along the Northeasterly line of Ocean Avenue to the point of beginning. All of said lots and block are shown on that certain map of Huntington Beach Tract re- corded on page 36 of Book 3 of Miscellaneous Daps, Records of Orange County, California. Section 3. That said Board of Trustees hereby further determines that serial bonds shall be issued to represent assessments of $25.00, or over, for the cost and expenses bf said work and improvements; that said serial bonds shall extend over a period of nine years from the 2nd. dpy of Jan- uary next succeeding their date and an even annual proportion -4 c of the principal sum thereof shall be payable, by coupon, on the 2nd. day of January every year after their date, until the whole is paid, and the interest shall be payable semi-annually, by coupon, on the 2nd. day of January and July respectively of each year at the rate of seven percent per annum on all sums unpaid until the whole of, said prin- cipal and interest are paid. Section 4. That novice is hereby given that on the 1st. day of Novem er, 1915, at the hour of eight o 'clock P.M. of said day, at the City Hall in said City of Huntington Beach, and' and all persons having any objections to the proposed work and improvements may a-pear before the said Board of Trustees and show cause w y said proposed work and improve- ments should not be carried out in accordance with this Res- olution. Section 5. The City Clerk_ of said City shall cause this Resolution of Intention to be published twice in the Huntington Beach News weekly newspaper, printed, published and circulated in said city, and hereby designated by said Board of Trustees for that purpose. Section 6. The Street Superintendent of said City shall forthwith cause to be conspicuously posted along the line of said contemplated work and, improvement , at not more than 300 feet in distance apart, but not less than three in all, and along all the open streets within said district, at not more th n -300 feet in distanceart but not less than a apart , s a three in all on each street, notices of the passage of this -5- Resolution of Intention in the manner and form required by law, which notices shall contain also a statement of the day, hour and place when and where any and all persons having any objections to the proposed work or improvements may appear before the said Board of Trustees and show cause why said proposed work and improvements should not be carried out in accordance with this Resolution. Section 7. All of the herein proposed work and im- provements and all proceeding taken in regard thereto shall be in pursuance of and in accordance with the aforesaid Act of the Legislature of the State of California, designated as the "Improvement Act of 1911" , approved April 7th. 1911 ; and the several acts amendatory thereof.
