RESOLUTION ORDERING WORK, RESOLVED: That the -oublic interest and convenience require the work herein described, and described in Reso- lution of Intention No. 276, adopted by the Board of Trtst- ees of the City of Huntington Beach on the 7th. day of Sept- ember, 1915, and that the said Board of Trustees hereby orders said work to be done, as follows, to-wit: (a) That TzJ'ain Street from the center line of Clay Street to the North line of- Orange Avenue; and Seventeenth Street from a line nine feet West bf and parallel to the center line of Delaware Avenue, to Main Street; and Acacia Avenue from the East line of Main Street to the West line of the right of way of the Southern Pacific Railroad Company; and the Southeast- erly one-half of Sixth Street from the Northeasterly line of Orange Avenue to the Southwesterly line of Magnolia Avenue; and the Northwesterly one-half of Fifth Street from the Northeasterly line of Orange Avenue to the Southwesterly line of liagnolia. Avenue; and Utica Street from the East line of Main Street to the Northwesterly line of Seventeenth Street; be graded, crowned, paved, capped, surfaced, oiled, improved and constructed to the official grade thereof in accordance with Specifications No. 8, as provided and adopted in Or- dinances numbered 125 and 164 of said City, now on file in the office of the City L Clerk of said City, and in accordance with plans, profiles and cross-sections for said work and -1- i improvements numbered 124, 109, and 111 , on file in the office of the City Engineer of said City, to w'-ich speci- ficetions, plans, profiles and cross-sections reference is hereby made for a more particular description of said work. (b) That corrugated iron culverts be constructed across and in the above described portions of Main Street, and Seventeenth Street, in accordance with Specifications No. 8, as adopted and provided in Ordinances numbered 125 and 164 of said City, and at the places and as shown on and in accordance with the said plans, profiles and cross-sections for said work hereinbefore referred to and on file in the office of the City Engineer of said City, to w-nlch refer- ence is hereby made for a more particular description of said work and the location of said culverts. (c) That reinforced concrete pipe culverts and drains with concrete catch basin* be constructed across and in the above described portions of Seventeenth Street, in accord- ance with Specifications No. 8, as adopted and provided in Ordinances numbered 125 and 164 of said City and at the places and as shown on and in accordance with said plans, Profiles and cross-sections for said work hereinbefore re- ferred to and on file in the office of the City Engineer of said City, which plans, profiles and cross-sections ate here- by referred to for a more particular description of said work. (d) That a subway and approaches thereto under the tracks and road bed of the Southern Pacific Railway Company -2- P t be built in the above described portion of Seventeenth • Street with concrete retaining galls and concrete and wood supports for the railroad tracks and road ' ed, in accordance with Specifications No.8, as adopted and pro- vided in Ordinances numbered 125 and 164 of said City, and at the place where said tracks and road bed cross said portion of Seventeenth Street , and as shown on and in accordance with said plans, profiles and cross-sections for said work hereinbefore referred to and on file in the office of the City Engineer of said City, to which refer- ence is hereby made for a more particular description of said work and the location of said subway and approaches thereto. (e) That open drain ditches be constructed along and in each side of Lake Avenue from Seventeenth Street to Utica Street in accordance with Specifications No. 8, as adopted and Drovided in Ordinances numbered 125 and 164 of said City, and as shown on and in accordance with said plans, profiles and cross-sections for said work hereinbef ore referred to and on file in the office of the City Engineer of said City, to which plans, profiles and cross-sections reference is hereby made for a more particular description of said work. (f) That reinforced concrete pipe drains, with con- crete end wall, be constructed along and in that certain public right of way from Seventeenth Street to Wichita Street through Lot or Block 2301 of the East Side Villa Tract, des- cribed in that certain instrument recorded on page 385 of -3- f Book 277 of Deeds, Records of Orange County, California, and in Wichita. Street from the right of way of the South- ern Pacific Company to Huntington Avenue, in accordance with Specifications No.8, as adopted and provided by Ordinances numbered 125 and 164 of said City, and as shown on and in accordance with the plans, profiles and cross-sections here- inbefore referred to and on file in the office of the City Engineer of said City, to which plans, profiles and cross sections reference is hereby made for a. more particular description of said work. (g) That the park gays or courts in the center of Main Street from Loma. Avenue to Clay Street be graded, crowned, improved and constructed in accordance with Speci- fications No. 8, as adopted and provided in Ordinances num- bered 125 and 164 of said City, and as shown on and in accord- ance with said plans, profiles and cross-sections hereinbefore referred to and on file in the office of the City Engineer of said City, to which plans, profiles and cross-sections reference is hereby made for a more particular description of said work. (h) That corrugated iron culverts be constructed across and in the park way or court in the center of Main Street from Loma. Avenue to Clay Street , in accordance with Specifi- cations No. 8, As adopted and provided in Ordinances Number- ed 125 and 164 of said City, and as shown on and in accord- ance with said plans, profiles and cross-sections herein- before refereed to and on file in the office of the City -4- • Engineer of said City, to which ;clans, profiles and cross- sections reference is hereby made for a more na.rticular description of said work. (i) That cement curbs be built and constructed in and along the above described portion of Main Street, bordering on and surrounding the park ways or courts in the center of Main Street, in accordance with Specifi- cations No. i, as adopted and provided in Ordinances numbered 28 and 163 of said City, and as shown on and in accordance with said plans, profiles and cross-sec- tions hereinbefore referred to on file in the office of the City Engineer of said City, to which plans, profiles and cross-sections reference is hereby made for a. more particular description of said work. Section 2. That all of the herein proposed work and improvements shall be done and made in pursuance of an Act of the Legislature of the State of California., entitled, "An Act to Provide For Work In and Upon Streets, Avenues, Lanes, Alleys, Courts, Places and Sidewalks Within Munici- palities, and Upon Property and Rights of Way Owned by Municipalities and For the Establishing and Changing the Grades of Such Streets, Avenues, Lanes, Alleys, Courts, Places and Sidewalks, and Providing For the Issuance and Payment of Street Improvement Bonds to Represent Certain Assessments For the Cost Thereof, and Providing a Illethod _5 • a • For the Payment of Such Bonds," approved April 7th. 19112 and the several acts amendatory thereof, or supplementary thereto ; also in accordance with the Specifications, Pro- files and Cross-Sections herein referred to. Section 3. That in the opinion of said Board of Trustees the said proposed and cortemplated work and improvements are, and said Board of Trustees does hereby determine and declare that said proposed and contemplated work and improvements are more than local or 6rdinary public benefit and will affect and benefit the lands and district hereinafter des- cribed, which district is hereby declared to be the district affected and benefited by said, work and' improvements, and that the entire cost and expense of said work and improvements shall be chargeable against and assessed upon said lands and dist- rict, which district is within the City of Huntington Beach, County of Orange, State of California, and that the exterior boundaries of the said lands and district affected and bene- fited by said work, exclusive of the strips and portions of land soug'_n.t to be improved and exclusive of any land within said boundaries which is now a part of the public Streets, Courts, or Ways in said City, are particularly described, as follows, to-wit: Beginning at the point of intersection ofTrthe center line of Clay Street ( the north city boundary line) with the quarter section line running North. and South through the center of sec- tion 2, T. 6 S. , R. 11 W. , S.B.B. & M. , and running thence -6- West two miles to the quarter section line running North and South through the center of section 4, T. 6 S. , R. 11 W. , S.B.B.& 14. (the west city boundary line) , thence South along the last described quarter section line ( the west city bound- ary line) to its intersection with a line which is one hun- dred and eighty (180) feet Southwesterly from and parallel to the center lne of the right of way of the Los Angeles Inter-Urban Railway Co. as described in that certain deed recorded in book 155 at page 260 of Deeds, Records of Orange County, California, thence Southeasterly along the said line one hundred and eighty (180) feet Southwesterly from and par- al�lel to the center line of the said right of way of the Los Angeles Inter-Urban Railway Co. , to the quarter section line running North and South throught the center of section 14, T. 6 S. , R. 11 W. , S.B.B. & M. , thence North along said quarter section line produced throught the center of section line produced through the center of section 11 , T. 6 S. , R.11 W. , to it intersection with the produced South line of Wichita Street, thence East along the produced South line of Wichita Street to its intersection with the East line of Huntington Avenue, thence North along the East line of Huntington Ave- nue to its intersection with a line fifty ( 50) feet South- easterly from and parallel to the Southeasterly line of Seven- teenth Street, thence Northeasterly along said line fifty ( 50) feet . Southeasterly from and parallel to the Southeasterly line of Seventeenth Street to its intersection with the center line -7- • of Clay Street (the north city boundary line) , thence West along the center line of Clay Street (the north city bound- ary line) to its intersection with a line fifty (50) feet Northwesterly from and parallel to the Northwesterly line of Seventeenth Street, thence Southwesterly along said line fifty (50) feet Northwesterly from and parallel to the Northwesterly line of Seventeenth Street to its intersection with the quart- er section line running North and South through the center of section 2, T. 6 S. , R. 11 W. , S.B.B.&.M. , thence North along the last described quarter section line to the point of be- ginning. Section 4. That said Board of Trustees hereby further determines that serial bonds shall be issued to represent assessments of $25.00 or over, for thb cost and expense of said work and improvements; that said serial bonds shall ex- tend over a period of nine years from the 2nd. day of Jan- uary next succeeding their date and an even annual propor- tion of the principal sum thereof shall be payable, by cou- pon, on the 2nd day of January every year after their date, until the whole is paid, and the interest shall be payable semi-annually, by coupon, on the 2nd. day of January and July resrectivelyr of each year at the rate of seven per cent per annum on all sums unpaid until the whole of said prin- cipal and interest are paid. Section 5. All of the herein proposed work and"improve- ments and all proceeding; taken in regard thereto shall be in -g- • purcuance of and in accordance with the aforesaid Aft of the Legislature of the State of California, designated as " The Improvement Act of 191111 , approved April 7th. , 1911 , and the several acts amendatory thereof. That the City Clerk and Ex-Officio Clerk of said Board of Trustees, be, and he is hereby, directed to post notices, with specifications, conspicuously for five days on or near the council chamber door of said Board of Trustees inviting sealed proposals or bids for doing the work ordered, and to publish notice inviting such proposals, and referring to the specifications posted, or on file, twice in the Huntington Beach News, a weekly newspaper published and circulated in said City of Huntington Beach, and hereby designated for that purpose, and that the time fixed for the opening of such bids shall be not less than ten days from the time of the first pub- lication or posting of said notices. That said notice shall re6u* re a. certified c:­.eck, payable to said City, or a bond as prescribed by law and for an amount not less than ten per cent. of the aggregate of the proposal, to accompany each bid; that the 15th. day of November 1915, is hereby designated and fixed as tare day on which, up to the hour of eig'ht o ' clock P.M. , the said proposals or bids shall be re- ceived) and the said notices shall so specify that the said bids or proposals, for the doing of said work, shall specify showing and segregating amounts for the several portions of the said work, and shall state a separate sum or amount for the constbuction of the subway hereinbefore mentioned and -9- s and described, ) and in accordance with the said plans and specifications therefor.
