Resolution of Intention No. 287. A Resolution of the Board of Trustees of the City of Huntington Beach, California, Declaring its Intention to order the Construction of Sewers along and in certain Streets, Alleys and Public ways in said City of Huntington Beach, and providing that the proposed work be done under "The Improvement Act of 191111 , as amended, and giving notice of time for hearing objections. The Board of Trustees of the City of Huntington Beach do hereby resolve as follows: Section 1. That the Dublic interest and convenience require, and that It is the intention of the Board of Trust- ees of said City to order, the following described work to be dome and improvements to be made in and upon certain alleys, streets and public ways in said City, to-wit: That setivfers be ccr.c>trui tt=d for sanitary purposes along and in certain streets, alleys, and public ways in said City the center lines of said sewers being described as follows, to-wit: Commencing in the first alley Northwesterly from Thir- teenth Street at a ;point four and one half feet Northeast- erly from the Southwesterly line of the first alley North- easterly from Ocean Avenue, which point is four and one half feet Southeasterly from the Northwesterly line produced of the first alley Northwesterly from Thirteenth Street; running thence Northeasterly in said first mentioned alley along a line four and one half feet Southeasterly from and parallel to the Northwesterly line of said first mentioned alley to a point twenty-eight (28) feet Southwesterly from -1 the Southwesterly line of the first alley Southwesterly from Main Street. Also commencing in the first alley Northwesterly from Twelfth Street at a, point four and one half feet North- easterly from the Southwesterly line of the first alley Northeasterly from Ocean Avenue, which point is four and one half feet Southeasterly from the Northwesterly line produced of the first alley NorthLvvesterly from Twelfth Street; running thence Northeasterly in said first men- tioned alley along a line four and one half feet South- easterly from and paralllel to the Northwesterly line of said first mentioned alley to a point twenty (20) feet Southwesterly from the Southwesterly line of Orange Avenue, Also commencing in the center line of Acacia Avenue at a point four and one half feet Southeasterly from the Northwesterly line of the first alley Northwesterly from Thirteenth Street and running thence Southeasterly along the center line of Acacia Avenue to a point four and one half feet Southeasterly from the Northwesterly line of the first alley, Northwesterly from Twelfth Street; running thence Northeasterly in the first alley Northwesterly from Twelfth Street along a line four and one half feet South- easterly from and paralllel to the Northwesterly line of the last mentioned alley to a boint one hundred and thirty" three and sixty-five hundredths (133.65) feet Southwesterly from the Southwesterly line of the first alley Southwesterly from Main Street, thence in a straight line in said first -2- • alley Northwesterly from Twelfth Street to a point four and one half feet Southeasterly from the Northwesterly line pro- duced of the last mentioned alley, which point is four and one half feet northeasterly from the Southwesterly line of the first alley Southwesterly from Main Street and running thence Northwesterly in the last mentioned alley along a line four and one half feet Northeasterly from and parallel to the Southwesterly line of the last mentioned alley to a point ten (10) feet Northwesterly from the Southeasterly line of Edgeware Boulevard. Also commencing in the first alley Northwesterly from Tenth Street at a point twenty (20) feet Northeasterly from the Northeasterly line of Acacia Avenue, which point is four and one half feet Southeasterly from the Northwesterly line of the last mentioned alley and running thence Northeasterly in the last mentioned alley along a line four and one half feet Southeasterly from and parallel to the Northwesterly line of the last mentioned alley, to a point four and one half feet Northeasterly from the Southwesterly line of the first alley Southwesterly from Crest Avenue; then Northwest- erly in the last mentioned alley along a line four and one half feet Northeasterly from the Southwesterly line of the last mentioned alley to a point four and one half feet South- easterly from the Northwesterly line of the first alley North- westerly from Eleventh Street, thence Southweste-rly in the last mentioned alley along a line four and one half feet Southeast- -3- • erly from the Northwesterly line of the last mentioned alley to the Southwesterly line of Acacia Avenue, thence along the same straight line in that certain public right of way deeded to the city of Huntington Beach by deed recorded in Book 264 at page 203 of Deeds, Records of Orange County, California, to a point twenty (20) feet Southwesterly from the Southwesterly line of Acacia Avenue. The said sewers shall be constructed and the work of con- structing the same shall be done in accordance with certain plans, profiles and specifications and careful estimates of the costs and expenses thereof, heretofore prepared and furnished to the City Council of said City by the City En- gineer of said City the said specifications being specifi- cation No. 9, as adopted and provided by Ordinance No. 143 of said City, and the said plans and profiles being numbered 1302 200, 205, 201 , 202, 208, 207, and 2.04; all of said plans profiles and specifications being now on file in the office of the City Engineer of said City of Huntington Beach and each and all of said plans, profiles and specification are hereby referred to for a more particular description of said work; and it is proposed that the depth, size, material , man- ner of construction and location of said sewers shall be in accordance with the aforesaid plans, profiles and specifica- tions. Section 2. That said Board of Trustees hereby determines -4- and declares that said proposed work and improvement is of more than local or ordinary public benefit; that said pro- posed sewers will be located near together and will connect with the same main line and form portions of the same general sewer system of said City, and will effect and benefit the lands and district hereinafter described, and which said district is hereby declared to be the district affected . and benefited by said work end improvement, and that, the entire cost and expense of said work and improvement shall be, and are hereby, made chargeable against and shall be assessable upon said lands and district, which district is within the City of Huntington Beach, County of Orange, State of California, and the exterior boundaries of said district and of said lands affected and benefited by said work and improvement, exclusive of any land within said boundaries which is now a part of the public streets, alleys and ways , are particularly described as follows, to-wit: Beginning at the point of intersection of the South- westerly line of the first alley Nort;aeasterly from Ocean Avenut with the Southeasterly line of Fourteenth Street and running thence Northeasterly along the Southeasterly _line of Fourteenth Street produced to its intersection with the West- erly line of Edgeware Boulevard, thence along the last men- tioned line to its intersection with the Westerly line of Main Street, thence Southerly along the last mentioned line to it intersection with the Northwesterly line of Twelfth Street, thence Southerly in a straight line to the North- westerly corner of Block 811 , thence Southerly in a straight line to the Southwesterly corner of Block 811, thence South- westerly in a_ straight line to the Northwesterly corner of Lot 18 of Block '711 , thence Southeasterly along the South- westerly line of Crest Avenue to its intersection with the Northwesterly line of Tenth Street , thence Southwesterly along the last mentioned line to its intersection with the Northeasterly line of Acacia. Avenue, thence Northwesterly along the last mentioned line to its intersection:'With the Northwesterly line of Eleventh Street, thence Southwesterly along the last mentioned line to a point twenty-five ( 25) feet South«.Testerly from the Southwesterly line of Acacia Avenue, thence Northwesterly along a straight line which is twenty-five (25) feet Southwesterly from and par llel to the Southwesterly line of Acacia Avenue to a point on the South.- easterly line of Thirteenth Street, thence Southwesterly along the Southeasterly line of Thirteenth Street to its intersection with the Southwesterly line of Orange Avenue, thence Southeast- erly along the last mentioned line to its intersection with the Northwesterly line of Tvftlffn Street, thence Southwester- ly along the last mentioned line to its intersection with the Southwesterly line of the first alley Northeasterly from Ocean Avenue, thence Northwesterly along the last mentioned line to the place of beginning. -6- All of said Lots and Blocks are shown on that certain map of Wesley Park Tract, recorded on page 16 Book 4 of Misc- ellaneous Maps, Records of Orange County, California. Section 3. That said Board of Trustees hereby further deterkines that serial bonds shall be issued to renresent assessments of $25.00, or over, for the cost and expense of said work and improvements; that said serial bonds shall extend over a period of nine years from the 2nd. day of Jan- uary next succeeding their date, and an even annual portion of the principal sum thereof shall be pay'Able, by coupon, on the 2nd. day of January every year after their date, until the whole is paid, and the interest shall be payable semi- annually, by coupon, on the 2nd. day of January and July, re- spectively, of each year at the rate of seven per cent per annum, on all sums unpaid, until the whole of said principal and interest are paid. Section 4. That notice is hereby given that on the 21st. day of January, 1916, at the hour of eight o ' clock P. M. of said day, at the City Hall in said City of Huntington Beach, any and all persons having any objections to the proposed work and improvements may appear before the Board of Trustees and show cause why said nroposed work and improvements should not be carried out in accordance with this Resolution. Section 5. The City Clerk of said City shall cause this Resolution of Intention to be published twice in the Hunting- ton Beach News, a weekly newspaper, printed, published and circulated in said city, and hebeby designated by said Board of Trustees for that purpose. r7 Section 6. The Street Superintendent of said City shall forthwith cause to be conspicuously posted along the line of said contemplated work and improvement, at? not more than 300 feet in distance apart, but not less than three in all, and along all the open streets within said district, at not more than 300 feet in distance apart , but not less than three in all on each street , notices of the passage of this Resolution of Intention in the manner end form required by law, which notices shall contain also a statement of the day, hour, and place when and where any and a1.1 persons hav- ing any objections to the proposed work or improvements may appear before the g6id Board of Trustees and show cause why said proposed work and improvements should not be carried out in accordance with this Resolution. Section '7. All the herein proposed work and improve- ments and all proceedings taken in regard thereto shall be in pursuance of and in accordance with the aforesaid Act of the Legislature of the State of Ca;ifornia, designated as the "Improvement Act of 1911" , approved April ?th. 1911 , and the several acts amendatory thereof.
