HomeMy WebLinkAboutCity Council - 290A RESOLUTION OF INTENTION N0. 290 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION OF SEWERS ALONG AND IN CERTAIN STREETS ALLEYS AND PUBLIC WAYS IN SAID CITY OF HUNTINGTON BEACH, AND PRO- viding THAT THE PROPOSED WORD{ BE DONE UNDER "THE IMPROVEMENT ACT OF 191111 , AS,,MENDED, AND GIVING NOTICE OF TIME FOR HEARING OBJECTIONS. The Board of Trustees of the City of Huntington Beach do hereby resolve as follows: Section 1. That the public interest and convenience re- quire, and that it is the intention of the Board of Trustees of waid City to order, the following described work to be done and improvements to be made in and upon certain alleys, streets and public ways in said City, to-wit: That sewers be constructed for sanitary purposes along and in certain streets, alleys and public ways in said city, the center lines of said sewers being described as follows, to-wit: Commencing in the first alley Northeasterly from Ocean Avenue at a point four and one half feet Northeasterly from the Southwesterly line of the first alley Northeasterly from Ocean Avenue, which point is four and one half feet Southeasterly from the Northwesterly line produced of the first alley North- westerly from Fourteenth Street; running thence Northwesterly In said first mentioned alley along a line four and one half feet Northeasterly from and parallel to the Southwesterly line of said first mentioned alley to a point sixteen (16) feet Southeasterly from the Southeasterly line of Twentythird Str"t. 1, I The said sewers shall be constructed, and the work of constructing the same shall be done, in accordance with certain plans, profiles and specifications and careful esti- mates of costs and expenses thereof, heretofore prepared and furnished to the City Council of said City by the City Engineer of said City, .the said specifications being Specifications No.9 as adopted and provided by Ordinance No. 143 of said City, and the said plans and profiles ibeing numbered 132, 210, 202, 208, 207, and 204; all of said plans, profiles and specifications being now on file in the office of the City Ongineer of said City of Huntington Beach, and each and all of said plans, profiles, and specifications are hereby referred to for a more particular de- scription of said work; and it is proposed that the depth, size, material, manner of construction and location of said sewers shall be in accordance with the aforesaid plans, profiles and specifications. Section 2. That said Board of Trustees hereby determines and declared that dlid proposed work and improvement is of more than local or ordinary public benefit; that said proposed sewers will be located near together and will connect witn the same main line and form portions of the same general sewer system of said City, and will affect and benefit the lands and district herein- after described, and which said district is hereby declared to be the district affected and benefited by said work and improvement, and that, the entire cost and expense of said work and improve- ment shall be, and are hereby, made chargeable against and shall be assessable upon said lands and district, which district is within the City of Huntington Beach, County of Orange, 2. t • 0 State of California, and the exterior boundaries of said district and of said lands affected and benefited by said work and improvement, exclusive of any land within said boundaries which is now a part Of the public street, alleys and ways, are particularly described as follows, to-wit: Beginning at the point of intersection of the North- easterly line of Ocean Avenue with the Southeasterly line of Twentythird Street and running thence Northeasterly along the Southeasterly line of Twentythird Street to its intersection with the Southwesterly line of Edgeware Boulevard, thence South easterly along the Southwesterly line of Edgeware.Boulevard to its intersection witn the Northwesterly line of Sixteenth Street, thence Southwesterly along the Northwesterly line of Sixteenth Street to its intersection witn the Northeasterly line of Pallp Avenue, thence Southeasterly aling the Northeasterly line of Palm Avenue to its intersection with the Southeasterly line of Fifteenth Street, thence Southwesterly along the Southeasterly line of Fifteenth Street to its intersection with the Northeast erly line of the first alley Northeasterly from Ocean Avenue, thence Southeasterly along the Northeasterly line of the first alley Northeasterly from Ocean Avenue to its intersection with the Southeasterly line of the first alley Southeasterly from Fifteenth Street, thence Southwesterly in a straight line to toe Northerly corner of Lot 5 of Block 114, thence Southwesterly along the Northwesterly line of said Lot 5 to the Northeasterly line of Ocean Avenue, thence Northwesterly along the Northeast- erly line of Ocean Avenue to the place of beginning. 3. All of said lots and Blocks are shown on that certain map of Huntington Beach recorded on page 36 of Book 3 of Miscellaneous Maps, records of Orange County, California. Section 3. That said Board of Trustees hereby further determined that serial bonds shall be issged to represent assessments of $25.00, or over, for the cost and expense of said work and improvements; that said serial bonds shall extend over a period of nine years from the 2nd day of January next succeeding their dare, and an even annual portion of the principal sum thereof shall be payable by coupon, on the 2nd day of January every year after their date, until the whole Is paid, and the interest shall be payable semi-annually, by coupon, on the 2nd day of January and July, respectively, of each year at the rate of seven per cent per annum, on all sums unpaid, until the whole of said principal and interest are paid. Section 4. That notice is hereby given that on the 28th day of February, 1916, at the hour of eight o'clock P.P . of said day, at thd City Hall in said City of Huntington Beach, any and all persons having any objections to the proposed work and improvements may appear before the Board of Trustees and show cause why said proposed work and improvements should not be car- ried out in accordance tith this Resolution. Section 5. The City Clerk of said City shall cause this Resolution of Intention to be published twice in the Huntington Beach News, a weekly newspaper, printed published and circulated in said City, and hereby designated by said Board of Trustees for that purpose. 4.
