The Board of Trustees of the City of Huntington Beach, California fo hereby resolve, as follows: Resolved, that whereas the Board of Trustees of said City of Huntington Beach did on the 24th day of January, 1916, pass its Resolution of Intention No.290 to order the hereinafter described work to be done and improvements to be made in said City of Huntington Beach, which Resolution of Intention was duly and regularly published as required by law, as appears by the affidavit of Jas. J. Conrad, now on file in the office of the City Clerk of the City of Huntington Beach; and whereas, notices of the passage of said Resolution of Intention No.290, headed "notice of Improvement" were duly and legally posted by the Street Superintendent of said City along the line of said contemplated work and improvement and in front of all the property liable to be assessed therefor, in form and manner as required by law, immediately after the publication of said Resolution of Intention, as appears by the affidavit of J. Tinsley, Street Superintendent of the said City of Huntington Beach, who, upon the completion of the posting of said notices forthwith filed said affidavit in the office of the City Clerk of said City, making oath that he completed the posting of said notices on the 14th day of February, 1916; and, whereas, more than fifteen days have expired since the day of the second 1. • • publication of said Resolution of Intention No.290, and the completion of the posting of said "Notices of Improvement" , therefore be it RESOLVED, that the public interest and convenience require the work herein described, and the Board of Trustees of said City of Huntington Beach hereby orders the following stated work to be done in said City, to-wit: That sewers be constructed for sanitary purposes alonf and in certain streets, alleys and public ways in said city, the center lines of said sewers being described as follows, to-wit: Commencing in the first alley Northeasterly from Ocean Avenue at a point four and one-half feet Northeasterly from the Southwesterly line of the first alley Northeasterly from- Ocean Avenue, which point is four and one-half feet Southeasterly from the Northwesterly line produced of the first alley' Northwesterly from Fourteenth Street; running thence Nortwesterly in said first mentioned alley along a line four and one-half feet Northeasterly from and parallel to the Southwesterly line of said first men- tioned alley to a point sixteen (16) feet Southeasterly from the Southeasterly line of Twenty-third Street. The said sewers shall be constructed, and the work of constructing the same shall be done, in accordance with certain plans , profiles and specifications and careful estimates of the costs and expenses thereof, heretofore prepared and furnished to the Uity Council of said City by the City Engineer of said City, the said specifications being Specifications No.9, as adopted and provided by Ordinance No.143 of said City, and the said plans and profiles being numbered 132, 210, 202,208, 207, and �204; all of said plans , profiles and specifications being 2. �. • • now on file in the office of the City Engineer of said City of Huntington Beach, and each and all of said plans , profiles, and specifications are hereby referred to for a more particular description of said work; and it is proposed that the depth, size, material, manner of construction and location of said sewers shall be in accordance witn the aforesaid plans, pro- files and specifications. Section 2. That said Board of Trustees hereby determines and declares that said proposed work and improvement is of more than local or ordinary public benefit; that said proposed sewers will be located near together and will connect witn the same main line and form portions of the same general sewer system of said'_C;kty, and till affect and benefit the lands and district hereinafter described, and which said district is hereby declared to be the district affected and benefited by said work and improvement, and that, the entire cost and expense of said work and improve- vent shall be, and are hereby, made chargeable against and shall be assessable upon said lands and district, which district is within the City of Huntington Beach, County of Orange, State of California, and the exterior boundaries of said district and of said lands affected and benefited by said work and improve- ment, exclusive of any land within said boundaries which is now a part of the public streets, alleys and ways, are parti- cularly described as follows, to-wit : Beginning at the point of intersection of the Northeasterly line of Ocean Avenue with the Southeasterly line of Twenty-third Street and running thence Northeasterly along the Southeasterly line of Twenty-third Street to its intersection witn the South- 3. • westerly line of Edgeware Boulevard, thence Southeasterly along and Southwesterly line of Edgeware Boulevard to its intersection with the Northwesterly line of Sixteenth Street, thence Southwesterly along the Northwesterly line of Sixteenth Street to its intersection with the Northeasterly line of Palm Avenue, thence Southeasterly along the Northeasterly line of Palm Avenue to its intersection with the Southeasterly line of Fifteenth Street, thence Southwesterly along the Southeasterly line of Fifteenth Street to its intersection with the North- easterly line of the first alley Northeasterly from Ocean Avenue, thence Southeasterly along the -Northeasterly line of the first alley Northeasterly from Ocean Avenue to its intersection with the Southeasterly line of the first alley Southeasterly from Fifteenth Street, thence Southwesterly in a straight line to the Northerly corner of Lot 5 of Block 114, thence Southwesterly along the Northeasterly line of said Lot 5 to the Northeasterly line of Ocean Avenue, thence Northwesterly along the Northeasterly line of Ocean Avenue to the place of beginning. All of said Lots and Blocks are shown on that certain map of Huntington Beach, recorded on page 36 of Book 3 of Miscell- aneous Maps ,. records of Orange County, California. Section 3. That said Board of Trustees hereby further determines that serial bonds shall be issued to represent assess- ments of $25.00, or over, for the cost and expense of said work and improvements; that that said serial bonds shall ex- tend over a period of nine years from the 2nd day of January next succeeding their date and an even annual portion of the principal sum thereof shall be payable, by coupon, on the 2nd day of January every year after their date, until the whole is 4. rf paid, and the interest shall be payable semi-annually, by coupon, on the 2nd day of January and July, respectively, of each year at the rate of seven per cent per annum, on all sums unpaid, until the whole of said principal and ante#est are paid. Section 4. That notice is hereby given that on the 28the;-v day of February, 1916, at the hour of eight o'clock P.B . of s=�.id day, at the City Hall in said City of Huntington Beach, any and all persons having any objections to the proposed work and im- provements may appear before the Board of Trustees and show cause why said proposed work and improvements should not be carried out in accordance with this Resolution. Section 5. The City Clerk of said City shall cause this Resolution of Intention to be published twice in the Huntington Beach News, a weekly newspaper, printed, published and circu- lated in said City, and hereby designated by said Board of Trus- tees for that purpose. Section 6. The Street Superintendent of said City shall forthwith cause to be conspicuously posted along the line of "i said contemplated work and improvement, at not more than 300 feet in distance apart, but not less than three in all, and along all the open streets within said district, at not more than 300 feet in distance apart, but not lessthan three in all on each street, notices of the passage of this Resolution of Intention in the manner and form required by law, which notices shall contain also a statement of the day, hour and place when and where any and all persons having any objections to the pro- posed work and improvements may appear before the said Board of Trustees and show cause why said proposed work and improvements should not be carried out in accordance witn this _'resolution. 5. Section 7. All the herein proposed work and improvements and all proceedings taken in regard thereto shall be in pursuance of and in accordance with the aforesaid Act of the Legislature of the State of California, designated as the "Improvement Act of 1911" approved April 7th, 1911 , and the several acts amendatory thereof. Reference is hereby made to said Resolution of Intention fcr{ further particulars. Be it further resolved, that the city clerk of said city is hereby directed to post notives of said workrp together with the specifications therefor, conspicuously for five days on or near the Council Chamber door of the City Council, or Board of Trustees of said City, to-wit : The front door of the City Hall in said City of Huntington Beach, inviting sealed proposals or bids for doing the work ordered; and said city clerk is directed to publish a notice inviting such proposals and referring to the specifications posted, or on file, twice in the Huntington Beach News, a weekly newspaper published and circulated in the city of Huntington Beach, and hereby designated for that purpose, and it is ordered that the time fixed for the open- ing of said proposals or bids shall be not less than 10 days from the time of the first publication or posting of said notice . Be- it further resolved, that all proposals or bids offered for doing said work shall be accompanied by a check, payable to the City, certified by a responsible bank, for an amount which shall be not lessthan ten per cent of the aggre- gate of the proposal, or by a bond for the said amount, and so payable, signed by the bidder and two sureties who shall 6 justify before an officer competent to administer an oath, in double said amount, over and above all statutory exemptions.
