HomeMy WebLinkAboutCity Council - 295A i RESOLUTION OF INTENTION NO. 295 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITYi_;OF HUNTINGTON BEACH, CALIFORNIA, DECLARING ITS INTENTION TO :ORDER THE CONSTRUCTION OF SEWERS ALONG AND IN CERTAIN STREETS, ALLEYS AND PUBLIC MAYS IN SAID CITY OF HUNTINGTON BEACH, AND PRO- VIDING THAT THE PROPOSED WORK BE DONE UNDER "THE IMPROVEMENT ACT OF 1911t1 , as aMENDED, AND GIVING NOTICE OF TIME FOR HEARING OBJECTIONS. The Board of Trustees of the City of Huntington Beach do hereby resolve as follows: Section 1. That the public interest and convenience re- quire, and that it is the intention of the Board of Trustees of said City to order, the following described work to be done and improvements to be made in and upon certain alleys, streets and public ways in said city, to-wit: That sewers be constructed for sanitary purposes along and in certain streets, alleys and public ways in said City, the center lines of said sewers being described as follows, to-wit: Commencing at a point in Main Street which point is sixteen and one-half (162) feet Southeasterly from the Northwesterly line of Fain Street and (4j) four and One-half feet Northeasterly from the Southwesterly line produced of the first alley North- easterly from Ocean Avenue, running thence Southwesterly in Fain Street in a straight line to a point in Main Street, which point is (24*) twenty-four and one-half feet Southeaster4 from the Northwesterly line of Main Street and (129j) one hyndred twenty-nine and one-half feet Southwesterly from the South- westerly line of Ocean Avenue. That said sewers shall be constructed and the work of constructing the same shall be done in accordance with certain 1. plans , profiles and specifications and careful estimates of the costs and expenses thereof, heretofore prepared and furnished to the City Council of said City by the City Engineer of said City, the said specifications being specifications No.9 as adopted and provided by Ordinance No. 143 of said City, and the said plans and profiles being numbered 134 and 208; all of said plans, profiles and specifications being now on file in the office of the City Engineer of said City of Huntington Beach, and each and all of said plans, profiles and specifications are hereby referred to for a more particular description of said work; and it is proposed that the depth, size, material, manner of construction and location of said sewers shall be in accordance with the aforesaid plans , profiles and specifications . Section 2. That said Board of Trustees hereby determines and declares that said proposed work and improvement is of more than local or ordinary public benefit; that said proposed sewers will be located near together and will connect with the same main line and form portions of the same general sewer system of said city, and will affect and benefit the lands and district hereinafter described, and which said district is hereby de- clared to be the district and benefited by said work and improve- ment, and that, the entire cost and expense of said work and improvement, and that, the entire cost and expense of said work and improvement shall be, and are hereby, made charge- able against and shall be assessable upon said lands and dis- trict, which district is within the City of Huntington Beach, County of Orange, State of California, and the exterior bound- aries of said district and of said lands affected and bene- fited by said work and improvement, exclusive of any land within, 2. c • said boundaries which is now a part of the public streets, alleys and Ways, are partidularly described as follows, to-wit: Beginning at the point of intersection of the Northwesterly line of Fain Street with the Northeasterly line of the first alley Northeasterly from Ocean Avenue and running thence South- westerly along the Northwesterly line of Main Street to its intersection with the Northeasterly line of Ocean Avenue, thence Northwesterly along the Northeasterly line of Ocean Avenue to Its intersection with the Southeasterly line of Fifth Street; thence Southwesterly along the produced Southeasterly line of Fifth Street - distance of (255) two hundred and fifty-five feet to a point, thence Southeasterly along a straight line which is (155) one hundred and fifty-five feet Southwesterly from and parallel to the Southwesterly line of Ocean Avenue a distance of (575) five hundred and seventy-five feet to a point on the produced Northwesterly line of Third Street, thence Northeasterly along the produced Northwesterly line of Third Street to its intersection with the Northeasterly line of Ocean Avenue, thence Northwesterly along the Northeast- erly line ofOcean Avenue to U intersection with the South- easterly line of Main Street, thence Northeasterly along the Southeasterly line of Main Street to its intersection with the Northeasterly line of the first alley Northeasterly from Ocean Avenue, thence Northwesterly, in a straight line to the plac e of beginning. Section 3. That said Board of Trustees hereby further determines that serial bonds shall be issued to represent assessments of $25.00, or over, for the cost and expense of said work and improvements; that said serial bonds shall 3 . Y • • extend over a period of nine years from the 2nd day of January next succeeding their date, and an even annual portion of the principal sum thereof shall be payable, by coupon, on the 2nd day of January every year after their date, until the whole -is paid, and the interest shall be payable semi-annually, by coupon, on the 2nd day of January and July, respectively, of each year at the rate of seven per cent per annum, on all sums unpaid, until the whole of said prin- cipal and interest are paid. Section 4. That notice is hereby given that on the 17th day of April, 1916, at the hour of eight o' clock P. I. of said day, at the City Hall in said City of Hun tington Beach, any and all persons having any objections to the proposed work and improvements may apprar before the Board of Trustees and show cause why said proposed work and improvements should not be carried out in accordance with this resolution. Section 5. The City Clerk of said City shall cause this Resolution of Intention to be published twice in the Huntington Beach News, a weekly newspaper, printed, published and circu- lated in said City, and hereby designated by said Board of Trustees for that purpose. Section 6. The Street Superintendent of said City shall forthweith cause to be conspicuously posted along the line of said contemplated work and improvement, at not more than 300 feet in distance apart, but not lessthan three in all, and along all the open streets within the district, at not more than 300 fee$ in distance apart, but not lessthan three in all 4. • • on each street, notices of the passage of this Resolution of Intention in the manner and form required by law, which notices shall contain also a statement of the day, hour and place when and where any and all persons having any objections to the proposed work and improvements may appear before the said Board of Trustees and show cause w1wy said proposed work and improvements should not be carried out in accordance with this Resolution. Section 7. All the herein proposed work and improvements and all proceedings taken in regard thereto shall be in pursu- ance of and in accordance with the aforesaid Act of the Legis- lature of the State of California, designated as the "Improve- ment Act og 1911" , approved April 7th, 1911, and the several acts amendatory thereof.
