HomeMy WebLinkAboutCity Council - 334 t RESOLUTION NO. 334 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, DECLAR- ING THEIR INTENTION TO ORDER THE CONSTRUCTION OF A SEWER IN THAT PORTION OF THAT CERTAIN ALLEY IN THE CITY OF HUNTINGTON BEACH, CALIF" ORNIA, LYING BETWEEN HUNTINGTON AVENUE AND CALIFORNIA AVENUE, FROM A CONNECTION WITH THE PRESENT SEXIER IN CHICAGO STREET TO A POINT EIGHTY FEET NORTHERLY FROM THE NORTH LINE OF INDIANAPOLIS STREET, AND DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREOF AND DECLARING THE WORT OR IMPROVE- MENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND THAT THE EXPENSE OF SAID WORK SHALL BE ASSESSED UPON A DISTRICT. BE IT RESOLVED by the Board of Trustees of the City of Huntington Beach, California: SECTION I . That public interest and convenience re- quire, and that it is the intention of the Board of Trustees of the City of Huntington Beach to order the construction of a public sewer with the necessary manholes, flush-tank and cast-iron frames and covers, in the alley between Huntington Avenue and California Avenue, in said City, as follows, to-wit: From a connection: with the present sewer in Chicago Street at the manhole now situated at the intersection of the center line of Chicago Street with a line four and one-half feet easterly from and parallel to the westerly line of said Alley, between Huntington Avenue and California Avenue, pro- duced, thence in a northerly direction to a point eighty (801) feet northerly from the north line of Indianapolis street, as shown on Plan and Profile No . 1000, to which said Plan and Pro- file reference is hereby made for a more particular description of the location and alignment of said Sewer, manholes, junction chamber and flush-tank. The above described Sewer shall be constructed in accordance with Specifications No. 9 for the construction of sanitary sewers in the City of Huntington Beach and on file in the office of the City Clerk of said City; and shall also be constructed in accordance with the above described Plan and Profile No. 1000 and the following Plans all of which are on file in the office of the City Engineer of Huntington Beach: Manholes in accordance with Plan No. 200, Flush- tank Plan No. 205, Junction Chamber connection Plan No. 209 and Cast-iron Frames and Covers in accordance with Plan No. 207 Sheet No. 1. Reference is hereby made to said Plans, Profiles and Specifications for a more particular description of said work. SECTION 2. That the said contemplated work or im- provement is, in the opinion of the Board of Trustees of more than local or ordinary public benefit, and said Board of Trust- ees hereby declares that the district in the City of Huntington to be benefitted by said work or improvement and to be assessed to pay the cost and expenses thereof, is. d escribed as follows: All that portion of the City of Huntington Beach in- cluded within the following boundary lines, to-wit: 2. • Commencing at the north-east corner of Lot 3 Block 903 of Vista Del Mar Tract Section 1 as recorded in Miscellaneous Maps, Book 4, page 3, Orange County Records; thence in a' straight line to the north-west -corner of Lot 18 Block 903 of Vista Del Mar Tract Section 1 as above recorded; thence in a straight line to the south-west corner of Lot 20 Block 303 of Vista Del Mar Tract Section 2 as recorded in Miscellaneous Maps, Book 4, page 5, Orange County Records; thence in a straight line to the south-east corner of said Lot 20 of Block 303 Vista Del Mar Tract Section 2 as above recorded; thence in a straight line to the north-east corner of Lot 11 Block 203 of Vista Del Mar Tract Section 2 as above recorded; thence in a straight line to the north-west corner of Lot 10 Block 203 of Vista Del Mar Tract Section 2 as above recorded; thence in a straight line to the south-west corner of Lot 1 Block 303 of Vista Del Mar Tract Section 2 as above recorded; thence in a straight line to the south-east corner of said Lot 1 Block 303 of Vista Del Mar Tract Section 2 as above recorded; thence in a straight line to the point of beginning; excepting therefrom any portion of any street or alley which is included within the above described district. This description is general only and reference is hereby!! made to Map No. 1001 as approved by the Board of Trustees of the City of Huntington Beach on the lst day of December 1919 , and on file in the office of the City Engineer of said City, for a more complete and detailed descrip- tion of said district. 3- SECTION 3. The City Engineer is directed to make a diagram of the property affected or benefitted by the proposed work or improvement as described in this Resolution and to be assessed to pay the expenses thereof. Such diagram shall show each separate lot, piece or parcel of land, the area in square feet of said lots, pieces or parcels of land, and the relative location of the same to the work proposed to be done, all with- in the limits of the assessment district SECTION 4. That the Board of Trustees determines that Serial Bonds shall be issued to represent assessments of Twenty-five ( 25.00) Dollars or over for the cost of said work or improvement; said serial bonds shall extend over a period ending nine (9) years from and after the second day of January next succeeding the date of said bonds, and an even annual pro- portion of the principal sum thereof shall be payable, by cou- pon, on the second day of January every year after their date until the whole is paid; and interest shall be paid semi- annually, by coupon, on the second days of January and July, respectively, of each year at the rate of seven (7) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said bonds shall be issued in accord- ance with the provisions of an act of the legislature of the State of California, entitled "an act to provide a system of Street Improvement Bonds to represent certain assessments for the cost of Street Work and Improvement within Municipalities, and also for the payment of said Bonds" , approved February 27, 4. • 1993, and of all acts supplementary thereto or amendatory there- of . SECTION 5. That the Street Superintendent shall post notice of this work as required by law, and shall cause said notice to be published by one insertion in the Huntington Beach News; and he shall also cause said notice to be posted for six days on or near the entrance to the City Hall. SECTION b. That the City Clerk shall give notice of this work by mailing postcards, as required by law, and he shall also certify to the passage of this Resolution and shall cause the same to be published by two insertions in the Hunt- ington Beach News; and he shall also post and keep posted, a printed copy of this Resolution for a period of two days on or near the entrance to the City Hall.
