HomeMy WebLinkAboutCity Council - 337 • r RESOLUTION NO• 37 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, DECLAR- ING THEIR INTENTION TO IMTPROVE A PORTION OF DELAWARE AVENUE BETWEEN FRANKFORT STREET AND JOLIET STREET BY THE CONSTRUCTION OF CONCRETE CURBS AND THE GRADING OF THE SIDEWALKS THERE- IN; AND DETERMINING THAT BONDS SHALL BE IS- SUED TO REPRESENT THE COST THEREOF AND DECLAR- ING THE WORK OR IMPROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT, AND THAT THE EXPENSES OF SAID WORK SHALL BE ASSESSED UPON A DISTRICT. BE IT RESOLVED by the Board of Trustees of the City of Huntington Beach, California: SECTION I . That public interest and convenience re- quire, and that it is the intention of the Board of Trustees of the City of Huntington Beach, to order the following work to be done, to-wit: 1. That Delaware Avenue from the center line of Frankfort Street to the center line of Joliet Street have Ce- ment Curbs constructed on both sides of the roadway therein and including curb returns to the boundary lines of said street at all intersections with cross streets, excepting, however, such portions of said street where existing curbs are to offi- cial line and grade; and that the sidewalk space between said curbs and the boundary lines adjacent thereto be graded and brought to a true line and grade to conform to the official grade and cross-section; all in accordance with Plan and Pro- file No. 1002. • The above described proposed work shall be done in accordance with the following Specifications, which are on file in the office of the City Clerk of the City of Huntington Beach: Specifications No. 1 Of the construction of Cement Curbs in the City of Huntington Beach" ; and shall also be done in accordance with the above Plan and Profile No. 1002, which is on file in the office of the City Engineer of Huntington Beach. Reference is hereby made to said Plan and Profile and Specifications for a more particular description of said work. SECTION 2. That the said contemplated work or im- provement is, in the opinion of the Board of Trustees of more than local or ordinary public benefit, and said Board of Trustees hereby declares that the district in the City of Huntington Beach to be benefitted by said work or improvement and to be assessed to pay the cost and expenses thereof, is described as follows: All that portion of the City of Huntington Beach included within the following boundary lines, to-wit: Commencing at the intersection of the center line of Delaware Avenue with the center line of Joliet Street; thence westerly in a straight line to the intersection of the center line of the first Alley west of said Delaware Avenue with the center line of said Joliet Street; thence southerly along the center line of said Alley to its intersection with the center line of Frankfort Street; thence easterly along the center line of said Frankfort Street to its intersection 2. i • with the center line of the first Alley east of said Delaware Avenue; thence northerly along the center line of said Alley to its intersection with the center line of Joliet Street; thence westerly along the center line of said Joliet Street to the point of beginning; excepting therefrom any portion of any street or alley which is included within the above des- cribed district. This description is general only and refer- ence is hereby made to Map No. 1003 as approved by the Board of Trustees of the City of Huntington Beach on the 15th day of December, 1919, and on file in the office of the City En- gineer of said City, for a more complete and detailed descrip- tion of said district. SECTION 3. That the City Engineer is directed to make a diagram of the property affected or benefitted by the proposed word or improvement as described in this Resolution and to be assessed to pay the expenses thereof. Such diagram shall show each separate lot, piece or parcel of land, the area in square feet of said lots, pieces or parcels of land, and the relative location of the same to, the work proposed to be done, all within the limits of the assessment district. SECTION 4. That the Board of Trustees determines that serial bonds shall be issued to represent assessments of Twenty-five ( $25-00) Dollars or over for the cost of said work or improvement; said serial bonds shall extend over a period ending nine (9) years from and after the second day of JanuaTY 3. next succeeding the date of said bonds, and an even annual pro- portion of the principal sum thereof shall be payable, by cou- pon, on the second day of January every ,year after their date until the whole is paid; and interest shall be paid semi- annually, by coupon, on the second days of January and July, respectively, of each year, at the rate of seven (7) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said bonds shall be issued in accord- ance with the provisions of an act of the legislature of the State of California, entitled, "an act to provide a system of Street Improvement Bonds to represent certain assessments for the cost of Street 'Work and Improvement within Municipalities, and also for the payment of said Bonds" , approved February 27, 1993, and of all acts supplementary thereto or amendatory there- of. SECTION 5. That the Street Superintendent shall post notice of this work as required by law, and shall cause said notice to be published by one insertion in the Huntington Beach News; and he shall also cause said notice to be posted for.- six days on or near the entrance to the City Hall. SECTION 6. That the City Clerk shall give notice of this work by mailing postcards, as required by law, and he shall also certify to the passage of this Resolution and shall cause the same to be published by two insertions in the Huntington Beach News; and he shall also post and keep posted, a printed 4. copy of this Resolution for a period of two days on or near the entrance to the City Hall. PASSED and adopted by the Board of Trustees of the City of Huntington Beach, California, and signed by the Presi- dent thereof this 195th day of December, 1919 .
