HomeMy WebLinkAboutCity Council - 338.1 .RESOLUTION NO. 30s f A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIF ORYIA, ORDERING THE CONSTRUCTION OF A SEWER IN THAT PORTION OF THAT ALLEY IN THE CITY OF HUNTINGTON BEACH, CALIFORNIA, LYING BETWEEN HUNTINGTON AVENUE AND CALIF- ORNIA AVENUE, FROM A CONNECTION WITH THE PRESENT SEXIER IN CHICAGO STREET TO A POINT EIGHTY FEET NORTHERLY FROM THE NORTH LINE OF INDIAYAPOLIS STREET, AND THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREOF AND THAT THE EXPENSE OF SAID WORK BE ASS)ESSED UPON A DISTRICT. BE IT RESOLVED by the Board of Trustees of the City of Huntington Beech, California: SECTION I . That the construction of the SEWER here- in described is required by the public interest and convenience, and the Board of Trustees of the City of Huntington Beach, California, hereby orders the construction of a public sewer, with the necessary manholes, flush-tank, and cast-iron frames and covers, in the Alley between Huntington Avenue and Calif- ornia Avenue, in said City, as follows, to-wit: From a, connection with the present sewer in Chicago Street at the manhole now situated at the intersection of the center line of Chicago Street with a line four and one-half feet easterly from and parallel to the westerly line of said Alley, between Huntington Avenue and California Avenue, D roduced thence in a northerly 0. irection to a point eighty (801 ) feet northerly from the north line of Indianapolis Street, as shown on Plan and Profile No. 1000, to which said Plan and Profile reference is hereby mpde for P. raore -pprtioular description of the location and Plignment of said Sewer, manholes, junction chamber and flush-tank. The above described Sewer shall be constructed in accordance with Specifications No. 9 for the construction of sanitary sewers in the City of Huntington Beach and on file in the office of the City Clerk of said City; and shall also be constructed in accordance with the above described Plan and Profile No. 1000 and the following. Plans, all of which are on file in the office of the City Engineer of Huntington Beach: Manholes in P ccordance with Plan No. 200, Flush-tank Plan No. 205, Junction Chamber connection Plan No. '609 and Cast-iron Frames snd Covers in accordance with Plan No. 207 Sheet No. 1. Reference is hereby made to said Plans, Profiles and Specifi- cations for P more particular description of said work. SECTION 2. That the said contemplated work or im- provement is, in the opinion of the Board of Trustees, of more than local or ordinary public benefit, and said Board of Trust- ees hereby declares that the district in the City of Huntington Beach to be benefitted by said work or improvement and to be assessed to pay the cost and e x-Denses thereof, is described as follows: All that portion of the City of Huntington Beach included within the following boundary lines, to-wit: 2. Commencing at the northeast corner of Lot 3 Block 903 of Vista Del Mar Tract Section 1 as recorded in Ifiscel— lsneous Maps, Book 4, page 3, Orange County Re Lords, thence in a. straight line to the northwest corner of Lot 18 Block 903 of Vista, Del Mar TrP.ct Section I as above recorded; thence in a straight line to the southwest corner of Lot 20 Block 303 of Vista Del Mar Tract Section 2 as recorded in Miscel— laneous Yp,ns, Book 4, page 5, Orange County Records; thence in a straight line to the southeast corner of said Lot 20 of Block 303 Vista Del MRr Tract Section 2 as, above recorded; thence in a straight line to the northeast corner of Lot 11 Block 203 of Vista Del Mar Tract Section 2 as above recorded; thence in a straight line to the northwest corner of Lot 10 Block 203 of Vista Del Mar Tract Section 2 as above recorded; thence in a straight line to the southwest corner of Lot 1 Block 303 of Vista Del Mar Tract Section 2 as above recorded; thence in a straight line to the southeast corner of said Lot 1 Block 303 of Vista Del Mar Tract Section 2 as above recorded; thence in a straight line to the point of beginning; excepting therefrom any portion of any street or alley which in included within the above described district. This description is general only and reference is hereby made to Map No. 1001 as approved by the Board of Trustees of the City of Huntington Beach on the lst day of December, 1919, and on file in the office of the City Engineer of said City, for a, more complete and detailed description of said district. 3. • SECTION 3. The City Envineer is directed to make a diagram of the property affected or benefitted by the pro- posed vrork or improvement as described in this Resolution and to be assessed to pay the expenses thereof. Such diagram shall show each separate lot, piece or parcel of land, the area, in square feet of said lots, pieces or parcels of land, and the relative location of the same to the work proposed to be done, all within the limits of the assessment district. SECTION 4. That the Board of Trustees determines that serial bonds shdl be issued to represent assessments of Twenty-five (425.00) Dollars or over for, the cost of said work or improvement; said serial bonds shall extend over a period ending nine (9) years from and after the second day of January. next succeeding the date of said bonds, and an even annual proportion of the principal sum thereof shall be payable, by coupon, on the second day of January every year after their date until the whole is paid; and interest shall be paid semi-annually, by coupon, on the second days of Janu- ary and July, respectively, of each year at the rate of seven (7) per cent per annum on all sums unpaid until the whole of said principal and interest' are T)aid. Said bonds shall be issued in accordance with the provisions of an act of the legislature of the State of California, entitled, "An Act to Provide a. System of Street Improvement Bonds to Represent Certain Assessments for the Cost of Street Work and Improve- ment Within Municipalities, and Also for the Payment of Said 4. Bonds.. " approved February 27, 1893, and of all acts supple- mentary thereto or amendatory thereof. SECTION 5. The City Clerk is hereby directed to post and keep posted for a period of five days, on or near the entrance to the City Hall, a notice, with specifications, inviting sealed proposals or bids for doing said work, and he shall also publish R notice of said work inviting sealed proposals or bids for doing said work, and referring to the specifications posted or on file, by two insertions in the Huntington Beach News. Said notice shall require a certified check or bond, either, as prescribed by law, and for an amount not less than ten per cent of the aggregate of the proposal. SECTION 6. The City Clerk shall certify to the passage of this Resolution and shall cause the same to be published by two insertions in the Huntington Beach News, and he shall also post and keep posted, a printed copy of this Resolution, for a. period of two days, on or near the entrance to the City Hall.
