HomeMy WebLinkAboutCity Council - 341 t RESOLUTION NO. 341 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA-, DECLAR- ING THEIR INTENTION TO ORDER THE IMFiOVEMENT OF THE ALLEYS IN BLOCKS 104, 204, and 203 OF HUNTINGTON BEACH, AND DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT- THE COST THEREOF AND DECLARING THE WORK OR IMPROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT, AND THAT THE EXPENSE OF SAID WORK SHALL BE ASSESSED UPON A DISTRICT. BE IT RESOLVED by the Board of Trustees of the City of Huntington Beach, California: SECTION I . That public interest and convenience r-e- quire, and that it is the intention of the Board of Trustees of the City of Huntington Beach, to order the following work to be done, to-wit: (a) That the ALLEY in BLOCK 104 of Huntington Beach running between Main Street and Fifth Street, as shown on the Map of Huntington Beach recorded in Miscellaneous Maps Book 3, page 36, Orange County Records, including all street intersec- , tions, be graded to the official grade, and be paved with hydraulic concrete base and oil and screenings wearing surface in accordance with Plan and Profile No. 1006. (b) That the ALLEY in BLOCK 104 of Huntington Beach running northeasterly from an intersection with the Alley des- cribed above to an intersection with the southwesterly line of Walnut Avenue, and so shown on the Map of Huntington Beach above referred to, including all street intersections, be graded to the official grade, and be paved with hydraulic concrete base and oil and screenings wearing surface in accordance with Plan and Profile No. 1006. (c) That the ALLEY in BLOCK 2o4 of Huntington Beach running between Walnut Avenue and Olive Avenue, and so shown on the Map of Huntington Beach above referred to, including all street intersections, be graded to the official grade and be paved with hydraulic concrete base and oil and screenings wearing surface in accordance with Plan and Profile No. 1006. (d) That the ALLEY in BLOCK 203 of Huntington Beach running between Walnut Avenue and Olive Avenue, and so shown on the Map of Huntington Beach above referred to, including all street intersections, be graded to the official grade and be paved with hydraulic concrete base and oil and screen- ings wearing surface in accordance with Plan and Profile No. loo6. SECTION 2. That Cement Curbs be constructed at intersections of the above described Alleys with the adjacent streets and Cement Curb Returns be constructed at said inter- sections where necessary to connect with existing curbs in said adjacent streets, all in accordance with Plan and Profile No. lo06. SECTION 3 . The above described proposed work shall be done in accordance with the following Specifications, which 2, • are on file in the office of the City Clerk of the City of Huntington Beach: Specifications No. 8 and the amendment thereto as adopted by the Board of Trustees of the City of Huntington Beach by Ordinances Nos. 125 and 164, and being for the "grading and paving of streets" , Specifications No. 1 for the construction of Cement Curbs; and shall also be done in accordance With the above described Plan and Profile No. 1006, which is on file in the office of the City Engineer of the City of Huntington Beach; reference is hereby made to said Plan and Profile and said Specifications for a more particular description of the above described work. SECTION 4. That the said contemplated work or im- provement is, in the opinion of the Board of Trustees of more than local or ordinary public benefit, and said Board ,of Trustees hereby declares that the district in the City of Hunt- ington Beach to be benefitted by said work or improvement and to be assessed to pay the cost and expenses thereof, is des- cribed as follows: All that portion of the City of Huntington Beach included within the following boundary lines, to-wit: Commencing at the intersection of the center line of Ocean Avenue with the center line of Hain Street, thence northeasterly in a straight line to the intersection of said center line of Fain Street with the center line of Walnut Ave- nue; thence southeasterly in a straight line to the intersection 3. • of the center line of walnut Avenue with the center line of , Third Street; thence northeasterly in a straight line to the intersection of the center line of Third Street with the center line of Olive Avenue; thence northwesterly in a straight line to the intersection of the center line of Olive Avenue with the center line of Fifth Street; thence southwesterly in a straight line to the intersection of the center line of Fifth Street with the center line of Ocean Avenue; thence southeast- erly in a straight line to the point of beginning; excepting therefrom any portion of any street or alley which is includ- ed within the above described district. This description is general only and reference is hereby made to Map No. 1007 as approved by the Board of Trustees of the City of Huntington Beach on the 9th day of February 1920, and on file in the office of the City Engineer of said City, for a more com- plete and detailed description of said district. SECTION 5. The City Engineer is directed to make a diagram of the property affected or benefitted by the pro- posed work or improvement as described in this Resolution and to be assessed to pay the expenses thereof. Such diagram shall show each separate lot, piece or parcel of land, the a- rea in square feet of said lots, pieces or parcels of land, and the relative location of the same to the work proposed to be done, all within the limits of the assessment district. SECTION 6. That the Board of Trustees determines that serial bonds shall be issued to represent assessments of Twenty-five ( 25.00) Dollars or over for the cost of said work 4. • or improvement; said serial bonds shall extend over a period ending nine (9) years from and after the second day of January next succeeding the date of said bonds, and an even annual proportion of the principal sum thereof shall be payable, by coupon, on the second day of January every year after their date until the whole is paid; and interest shall be paid semi- annually, by coupon, on the second days of January and July, respectively, of each year at the rate of seven (7) per cent per annum on all sums unpaid until the whole of said princi- pal and interest are paid. Said bonds shall be issued in accordance with the provisions of an act of the legislature of the State of California, entitled "an act to provide a system of Street Improvement Bonds to represent certain assess- ment for the cost of Street Work and Improvement within Muni- cipalities, and also for the payment of said-Bonds" , approved February 27, 1893, and of all acts supplementary thereto or amendatory thereof. SECTION 6. That the Street Superintendent shall post notice of this work as required by law, and shall cause said notice to be published by one insertion in the Huntington Beach News; and he shall also cause said notice to be posted for six days on or near the entrance to the City Hall. SECTION 7. That the City Clerk shall give notice of this work by mailing postcards, as required by law, and he shall also certify to the passage of this Resolution and shall cause the same to be published by two insertions in the Hunt- ington Beach News; and he shall also post and keep posted, a 5- • printed copy of this Resolution for a period of two days on or Bess the entrance to the City Hall.
