HomeMy WebLinkAboutCity Council - 342 RESOLUTION NO. 342 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, ORDER- ING THE CONSTRUCTION OF CONCRETE CURBS AND THE GRADING OF SIDEWALKS ON A PORTION OF DELAWARE AVENUE BETWEEN" FRANKFORT STREET AND JOLIET STREET, AND THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST OF SAID IMPROVEMENTS AND THAT THE COSTS AND EXPENSE OF SAID WORK SHALL BE ASSESSED UPON A DISTRICT. BE IT RESOLVED by the Board of Trustees of the City of Huntington Beach, California: SECTION I . That the street work herein described is required by public interest and convenience and that the Board of Trustees of the City of Huntington Beach hereby orders the following work to be done, to-wit: That Delaware Avenue from the center line of Frank- fort Street to the center line of Joliet Street have Cement Curbs constructed on both sides of the roadway therein and in- cluding curb returns to the boundary lines of said street at all intersections with cross streets, excepting however such portions of said street where existing curbs are to official line and grade; and that the sidewalk space between said curbs and the boundary lines of adjacent thereto be graded and brought to a true line and grade to conform to the official grade and cross-section; all in accordance with Plan and Profile No. 1002. The above described proposed work shall be done in accordance with the following Specifications, which are on file in the office of the City Clerk of the City of Huntington Beach: Specifications No. 1 "for the construction of Cement Curbs in the City of Huntington Beach" ; and shall also be done in accord- ance with the above Plan and Profile No. 1002, which is on file in the office of the City Engineer of Huntington Beach. Refer- ence is hereby made to said Plan and Profile and Specifications for a more particular description of said work. SECTION 2. That the said contemplated work or im- provement is, in the opinion of the Board of Trustees of more than local or ordinary public benefit, and said Board of Trust- ees hereby declares that the district in the City of Huntington Beach to be benefitted by said work or improvement and to be assessed to pay the cost and expenses thereof, is described as follows: All that portion of the City of Huntington Beach in- cluded within the following boundary lines, to-wit: Commencing at the intersection of the center line of Delaware Avenue with the center line of Joliet Street; thence westerly in a straight line to the intersection of the center line of the first Alley west of said Delaware Avenue with the center line of said Joliet Street; thence southerly along the center line of said Alley to its intersection with the center line of Frankfort Street; thence easterly along the center line of said Fraakfort Street to its intersection with the center line of the first Alley east of said Delaware Avenue; thence 2. • thence northerly along the center line of said Alley to its intersection with the center line of Joliet Street; thence west- erly along the center line of said Joliet Street to the point of beginning; excepting therefrom any portion of any street or alley which is included within the above described district. This description is general only and reference is hereby made to Map No. 1003 as approved by the Board of Trustees of the City of Huntington Beach on the 19th day of December , 1919, and on file in the office of the City Engineer of said City for a more complete and detailed description of said district. ! SECTION 3. The City Engineer is directed to make a diagram of the property affected or benefitted by the proposed work or improvement as described in this Resolution and to be assessed to pay the expenses thereof. Such diagram shall show each separate lot, ,piece or parcel of land, the area in square feet of said lots, pieces or parcels of land, and the relative location of the same to the work proposed to be done, all with- in the limits of the assessment district. SECTION 4. That the Board of Trustees determines that serial bonds shall be issued to represent assessments of Twenty-five ( 25 .00) Dollars or over for the cost of said work or improvement; said serial bonds shall extend over a period ending nine(9) years from and after the second day of January, next succeeding the date of said bonds, and an even annual pro- portion of the principal sum thereof shall be payable, by cou- pon, on the second day of January every year after their date until the while is paid; and interest shall be paid semi-annually, 3. by coupon, on the second days of January and July, respectively, of each year, at- the rate of seven (7) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said Bonds shall be issued in accordance with the provisions of an act of the legislature of the State of Calif- ornia,ornia, entitled "an act to provide a system of Street Improve- ment Bonds to represent certain assessments for the cost of Street Work and Improvement within Municipalities, and also for the payment of said Bonds" , approved February 27, 1893, and all acts supplementary thereto or amendatory thereof. SECTION 5. The City Clerk is hereby directed to post and keep posted for a period of five days, on or near the en- trance to the City Hall, a notice, with specifications, invi- ting sealed proposals or bids for doing said work, and he shall also publish a notice of said work inviting sealed proposals or bids for doing said work and referring to the specifications posted or on file by two insertions in the Huntington Beach News. Said notice shall require a certified check or bond, either, as prescribed by law, and for an amount not less than ten per cent of the aggregate of the proposal. SECTION 6. The City Clerk shall certify to the pas- sage of this Resolution and shall cause the same to be published by two insertions in the Huntington Beach News, and he shall al- so post and keep posted, a printed copy of this Resolution , for a period of two days, on or near the entrance to the City Hall. 11- • • PASSED and adopted by the Board of Trustees of the City of Huntington Beach, California, and signed by the Presi- dent thereof this lst day of March, 1920.
