s RESOLUTION NO. 500 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, ORDER- ING THE GRADING OF SECOND STREET FROM ITS INTERSECTION WITH OCEAN AVENUE TO ITS INTER- SECTION WITH LAKE AVENUE, IN SAID CITY, AND THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST OF SAID IMPROVEMENT AND THAT THE COST AND EXPENSE OF SAID WORK SHALL BE ASSESSED UPON A DISTRICT. BE IT RESOLVED by the Board of Trustees of the City of Huntington Beach, California: SECTION I . That the Street Rork herein described is required by public interest and convenience and that the Board of Trustees of the City of Huntington Beach hereby orders the following work to be done, to-wit: That SECOND STREET, in said City, be graded to the official grade from its intersection with the northeasterly line of Ocean Avenue to its intersection with the westerly line of Lake Avenue, including the intersection of intersec- ting streets within said limits. The above described work or improvement shall be done in accordance with Specifications No . 5, excepting Sec- tion 3 of said Specifications relating to Oiling of Street, excepting also that portion of Section 1 relating to the pre- paring of the grade preparatory to Oiling and beginning with the words "It shall then be plowed" and ending with the words M • "of sand therein to the said ten (10) per cent; " said Specifi- cations No. 5 being on file in the office of the City Clerk of said City; and shall also be done in accordance with Plan and Profile No. 1008 on file in the office of the City Engineer of said City. Reference is hereby made to said Plan, Profile and Specifications for a more particular description of said work. SECTION 2. That the said contemplated work or im- provement is, in the opinion of the Board of Trustees, of more than local or ordinary public benefit, and said Board of Trust- ees hereby declares that the district in the City of Huntington Beach to be benefited by said work or improvement -and to be assessed to pay the cost and expenses thereof, is described as follows: All that portion of the City of Huntington Beach included within the following boundary lines, to-wit: Commen- cing at the intersection of the center line of Second Street with the center line of Ocean Avenue; thence in a straight line to the westerly corner of Lot 1, Block 102, Huntington Beach Tract, as recorded in Miscellaneous Maps, Book 3, page 36, Orange County Records; thence in a straight line to the northerly corner of said Lot 1, Block 102, Huntington Beach Tract, as above recorded; thence in a straight line to the westerly corner of Lot 11, Block 102, Huntington Beach Tract, as above recorded; thence in a straight line to the northerly corner of Lot 27, Block 302, Huntington Beach Tract, as above recorded; thence in a straight line to the intersection of the center line of said Second Street with the center line of Lake 2. • Avenue; thence in a straight line to the intersection of the westerly line of Lake Avenue with the northwesterly boundary line of the Alley running through Block 301, Huntington Beach Tract, as above recorded; thence in a straight line to the southerly corner of Lot 12, Block 101, Huntington Beach Tract, as above recorded; thence in a straight line to the easterly corner of Lot 10, Block 101, Huntington Beach Tract, as above recorded; thence in a straight line to the southerly corner of said Lot 10, Block 101, Huntington Beach Tract, as above recorded; thence in a straight line to the point of beginning; excepting therefrom any portion of any street or alley which is included within the above described district. This des- cription is general only, and reference is hereby made to Map No. 1009, as approved by the Board of Trustees of the City of Huntington Beach on the 6th day of July, 1920, and on file in the office of the City Engineer of said City, for a more com- plete and detailed description of said district. SECTION 3. The City Engineer is directed to make a diagram of the Property affected or benefitted by the pro- posed work or improvement as described in this Resolution and to be assessed to pay the expenses thereof. Such diagram shall show eacheeparate lot, piece or parcel of land, the area in square feet of said lots, pieces or parcels of land, and the relative locations of the same to the work proposed to be done, all within the limits of the assessment district. SECTION 4. That the Board of Trustees determines -that serial bonds shall be issued to represent assessments of 3• Twenty-five ($25.00) Dollars or over for the cost of said work or improvement; said serial bonds shall extend over a period ending nine (9) years from and after the second day of January next, succeeding the date of said bonds, and an even annual pro- portion of the principal sum thereof shall be payable, by cou- pon, on the second day of January every year after their date until the whole is paid; and interest shall be paid semi-annually by coupon, on the second days of January and July, respectively, of each year at the rate of seven (7%) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said bonds shall be issued in accordance with the provisions of an act of the legislature of the State of Calif- ornia, entitled "An Act to provide a system of Street Improve- ment Bonds to represent certain assessments for the cost of Street Mork and Improvement within Municipalities, and also for the payment of said Bonds," approved February' 27, 1893, and of all acts supplementary thereto or amendatory thereof. SECTION .5. The City Clerk is hereby directed to post and keep posted for a period of five days, on or near the en- trance to the City Hall, a notice, with specifications, invit- ing sealed proposals or bids for doing said work, and he shall also publish a notice of said work inviting sealed proposals or bias for the doing of said work and referring to the speci- fications posted or on file by two insertions in the Huntington Beach News. Said notice shall require a certified check or 4. • bond, either, as prescribed by law, and for an amount not less than ten per cent of the aggregate amount of the proposal. SECTION 6. The City Clerk shall certify to the pass- age of this Resolution and shall cause the same to be published by two insertions in the Huntington Beach News, and he shall also post and keep posted, a printed copy of this Resolution, for a period of two days, on or near the entrance to the City Hall. PASSED and adopted by the Board of Trustees of the City of Huntington Beach, California, and signed by the Presi- dent thereof this 16th day of August, 1920.
