HomeMy WebLinkAboutCity Council - 365 RESOLUTION NO. 365 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, DECLAR- ING THEIR INTENTION TO IMPROVE SECOND STREET, THIRD STREET, A PORTION OF LAKE AVENUE AND THE ALLEYS IN BLOCKS lO4, 204, and 203, HUNT- INGTON BEACH TRACT AND DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREOF AND DECLARING THE WORK OR IMPROVEMENT TO BE OF MORE THANIOCAL OR ORDINARY PUBLIC BENEFIT, AND THAT THE COST AND EXPENSES OF SAID 'CORK SHALL BE ASSESSED UPON A DISTRICT. BE IT RESOLVED by the Board of Trustees of the City of Huntington Beach, California: That public interest and convenience require, and that it is the intention of the Board of Trustees of the City of Huntington Beach, to order the following work to be done, to-wit: (a) That SECOND STREET in said City from the north- easterly curb line of Ocean Avenue to a line fifteen feet at right angles easterly from and parallel to the westerly line of Lake Avenue, including the intersections of intersecting streets and alleys within said limits, be graded to the official grade and the surface oiled, in accordance with Special "Specifica- tions No . 22, and that cement concrete curbs be constructed on both sides of said street and at the intersections with inter- secting streets and alleys, including the curb returns at the intersection with Lake Avenue, but excepting in such portions of said Street where existing curbs are to official line and grade , all in accordance with Plan and Profile No. 1026. (b) That THIRD STREET in said City from a line five feet southwesterly from and parallel to the northeasterly curb line of Ocean Avenue to its intersection with Lake Avenue, in- cluding the intersections with intersecting streets and alleys within said limits, be graded to the official grade , be paved with Willite Pavement , and that cement concrete curbs and side- walks be constructed on both sides of said street and at the intersection with intersecting streets and alleys within said limits, excepting in such portions of said street where exist- ing curbs and sidewalks are to official line and grade, and that culverts be constructed at street intersections as shown on the Plans, and that an Ornamental Street Lighting System be constructed on said Third Street within the above limits, all in accordance with Plan and Profile No. 1027, Plans Nos. 1030, 1031, and 1032, and Specifications No. 20 and Special E Specifications No. 21. (c) That a portion of LAKE AVENUE in said City from the westerly production of the northerly line of Block 301A, Huntington Beach, across said Avenue to the southerly line of Magnolia Avenue, be graded to the official grade, and that a Willite Pavement extending out fifteen feet on either side of the center line of said Lake Avenue be constructed within the above limits and also that a connection between said pavement and the proposed pavement on Third Street at the intersection of Third Street and Lake Avenue be paved with Willite Pavement , 2. all in accordance with Plan and Profile No. 1028 and Specifi- cations No. 20. (d) That the ALLEY in BLOCK lo4 of Huntington Beach running between Main Street and Fifth Street, as shown on the Map of Huntington Beach, recorded in Miscellaneous Maps Book 3 page 36, Orange County Records, including all street inter- sections , be graded to official grade, and be paved with Will- ite Pavement in accordance with Plan and Profile No. 1029 and Specifications No. 20. (e ) That the ALLEY in BLOCK 104 of Huntington Beach running northeasterly from the Alley described above to an intersection with the southwesterly line of Walnut Avenue, and so shown on the Map of Huntington Beach above referred to, in- cluding all street intersections, be graded to the official grade and be paved with Willite Pavement in accordance with Plan and Profile No. 1029 and Specifications No . 20. (f) That the ALLEY in BLOCK 204 of Huntington Beach running between Walnut Avenue and Olive Avenue, and so shown on the Map of Hunting ton Beach above referred, including all street intersections, be graded to the official grade and be paved with Willite Pavement in accordance with Plan and Profile No. 1029 and Specifications No. 20. (g) That the ALLEY in BLOCK 203 of Huntington Beach running between Walnut Avenue and Olive Avenue , and so shown on the Map of Huntington Beach above referred to, including all street intersections, be graded to the official grade and 3. be paved with Willite Pavement in accordance with Plan and Pro- file No. 1029 and Specifications No. 20. (h) That Cement Concrete Curbs be constructed at in- tersections of the above described Alleys in Blocks 104-204-203 with adjacent streets and cement concrete returns be constructed at said intersections where necessary to connect with existing curbs in said adjacent streets, all in accordance with Plan and Profile No . 1029, SECTION 2. The above described proposed work shall be done in accordance with the following Specifications, which are on file in the office of the City Clerk of the City of Hunt- ington Beach: Specifications No. 1 for the construction of Cement Concrete Curbs, Specifications No. 2 for the construction of Cement Concrete Sidewalks, Specifications No. 20 for the grading and paving of Streets with Willite Pavement; Specifications No. 21, being Special Specifications for the construction of an Ornamental Lighting System on Third Street, Specifications No. 22, being Special Specifications for the grading and oiling of Second Street; and also shall be done in accordance with the above described Plans and Profiles and Special Plans, all of which are on file in the office of the City Engineer of the City of Huntington Beach. Reference is hereby made to said Plans, Profiles and Specifications for a 4. more particular description of the above described proposed work. SECTION-3. That the said contemplated work or improve- ment is, in the opinion of the Board of Trusteesof more than local or ordinary public benefit, and said Board of Trustees hereby declares that the district in the City of Huntington Beach to be benefitted by said work or improvement and to be assessed to pay the costs and expenses thereof is described as follows: All that portion of the City of Huntington Beach in- cluded within the following boundary lines, to-wit Commencing at the point of intersection of the center line of Fifth Street with the center line of Ocean Avenue; thence in a straight line to the point of intersection of the center line of Fifth Street with the center line of Olive Avenue; thence along said center line of Olive Avenue to its intersection with the center line of the Alley running northeasterly through Blocks 203 and 303; thence northeasterly and northerly along the center - line of said Alley through Blocks 303 and 403 to its intersec- tion with the center line of Magnolia Avenue; thence along said center line of Magnolia Avenue easterly to its intersection with the easterly boundary line of Blocks 301A and 402A produced northerly; thence southerly along said easterly boundary lines of said Blocks 402A and 301A and their productions to the south- east corner of said Block 301A; thence to the southwest corner of said Block 301A; thence in a, straight line to the intersec- tion of the center line of the Alley running northeasterly through Blocks 201 and -301 with the westerly line of Lake Ave- nue; thence southwesterly along said center line of said Alley 5. to the most easterly corner of Lot 6, Block 101, Huntington Beach Tract; thence in a straight line to the intersection of the line between Lots 5 and 6, Block 101, Huntington Beach Tract produced southwesterly with the center line of Ocean Avenue to n - its intersection with the line between Lots 5 and 6, Block 103, Huntington Beech Tract produced southwesterly with. t he center line of the Alley running northeasterly through Block 103, Hunt- ington Beach Tract; thence in a straight line to the intersec- tion of the center line of the Alley running northeasterly through Block 103, Huntington Beach Tract with the center line of Walnut Avenue; thence in a straight line to the intersection of the said center line of Walnut Avenue with the center line of Main Street; thence in a straight line to the intersection of the center line of Main Street with the center line of Ocean Avenue; thence in a straight line to the point of beginning; excepting therefrom any portion of any street or alley which is included within the above described district. This des- cription is general only and reference is hereby made to Map No. 1025 as approved by the Board of Trustees of the City of Huntington Beach on the 1st daycf August, 1921, and on file in the office of the City Engineer of said City, for a more complete and detailed description of said district. SECTION 4. The City Engineer is directed to make a diagram of the property affected. or benefitted by the pro- posed work or improvement as described in this Resolution and to be assessed to pay the costs and expenses thereof. Such 6 diagram shall show each separate lots piece or parcel of land, the area in square feet of said lots, pieces or parcels of land, and the relative location of the same to the work pro- posed to be done, all withim the limits of the assessment dist- rict. SECTION 5. Notice is hereby given that serial bonds to represent unpaid assessments and bear interest at the rate of seven (7%) per cent per annum will be issued hereunder in the manner provided by the "improvement bond act of 1915", the last installments of which bonds shall mature nine years from the second day of July next succeeding nine months from their date. SECTION 6. That the Street Superintendent shall post notice of Street Work, as required by law, and shall cause said notice to be published by one insertion in the Huntington Beach News; and he shall also cause said notice to be posted for six days on or near the entrance to the City Hall. SECTION 7. That the City Clerk shall give notice of this work by mailing postcards, as required by law, and he shall also certify to the passage of this Resolution and shall cause the same to be published by two insertions in the Hunting- ton Beach News; and he shall also post and keep posted, a printed copy of this Resolution for a period. of two days on or near the entrance to the City Hall. SECTION 8. The proceedings hereunder shall be had and taken under the Act to provide for work upon streets, lanes, 7. alleys, courts, places, and sidewalks, and for the construction of sewers, within municipalities, Approved March 18th, 1885, as amrnended ( com-nonly known as the Vrooman Act), excepting that all portions therof relating to the issuance of bonds to rep- resent delinquent assessments shall be had and taken under the "Improvement Bond Act of 1915".
