HomeMy WebLinkAboutCity Council - 381.1 RESOLUTION NO. 381._ A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIF- ORNIA, DECLARING ITS INTENTION TO ORDER THE IMPROVEMENT OF A PORTION OF SEVEN- TEENTH STREET IN THE CITY OF HUNTINGTON BEACH, CALIFORNIA, AND DECLARING SAID WORK OR IMPROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT: AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK OR INPROV'EMENT AND TO BE ASSESSED TO PAY THE COSTS AND EXPENSES THEREOF; AND DETER14INING THAT BONDS SHALL BE ISSUED TO REPRESENT SAID COSTS AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK OR IMPROVEMENT, OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED OR BOTH. BE IT RESOLVED by the Board of Trustees of the City of Huntington Beach, California: SECTION I. That the public interest and convenience require, and that it is the intention of the Board of Trustees of the City of Huntington Beach, California, to order the following work to be done., to-wit: First: That SEVENTEENTH STREET, in the City of Huntington Beach, Orange County, California, from the center line of Clay Street at the City Limits or the northeasterly boundary line of said City, to the easterly line of Main Street, in said City, in- cluding all intersections or streets and alleys, be regraded • and repaved in accordance with plans, profiles and cross- ' sections, marked Plans, Profiles and Cross-Sections No. 1037, on file in the office of the City Engineer of said City, and adopted by the Board of Trustees on the 19th day of June, 1922, under Resolution No. 380, of said Board for said work or improvement and in further accordance with Specifications No. 23 adopted by the said Board of Trustees of said City of Huntington Beach under Resolution No. 380 on the 19th day June, 1922, and on file in the office of the City Clerk of said. City. Said Plans, Profiles and Cross-Sections No. 1037 and said Specifications No. 23 are each hereby referred to for a more particular description of said work and are each hereby ma-de a part hereof to the same effect as though here- in set forth in full. Second: That WILLITE PAVEMENT of a minimum thickness of three inches be laid on said Seventeenth Street from said center line of Clay Street, at the said City Limits or northeast- erly boundary line of said City to said easterly line of Main Street, including all intersections of streets and al- leys; said pavement shall be a repaving placed on said Seven- teenth Street after treatment thereof as described in the next paragraph. Said Willite Pavement shall be laid of a width, character and material as prescribed by the plans, profiles and cross-sections, marked Plans, Profiles and Cross-Sections No. 1037, on file in the office of the City 2. Engineer of said City, (adopted by the Board of Trustees on the 19th day of June, 1922, under Resolution No. 380 of said Board of Trustees) for said work or improvement and further in accordance with Specifications No. 23 (adopted by said Board of Trustees of said City of Huntington Beach under Reso- lution No. 380 on the 19th day of June, 1922) and on file in the office of the City Clerk of said City. Said Plans, Pro- files and Cross-Sections No. 1037 and said Specifications No. 23 are hereby referred to for a more particular description of said work and are hereby made a part hereof. SECTION 2. Reference is hereby made to the Calif- ornia Willite Road Construction Company' s Plastic Composition License Mixture Agreement dated June 19th, 1922, on file in the office of the City Clerk of said City of Huntington Beach, California, and open to public inspection. SECTION 3. That the said contemplated work or im- provement, in the opinion of said Board of Trustees, is of more than local or ordinary public benefit, and said Board of Trustees hereby makes the expense of said work or improvement chargeable upon a district, which said district said Board of Trustees hereby declares to be the district benefited by said work or improvement and to be assessed to pay the costs and expenses thereof; which said district is bounded and described as follows: All that portion of the City of Huntington Beach, California, included within the following described exterior boundary line, to-wit: 3. Commencing at the point of intersection of the center line of Main Street with a line running parallel with and distant one hundred eighty-five feet (1851 ) North-westerly (NW) from the center line of Seventeenth Street; running thence Northeasterly (NE) along said last mentioned line to the point of intersection of said line with a line running due East and nest and parallel with -and distant one hundred eighty-five feet (1851 ) Northerly (N) from the center line of Seventeenth Street where said Seventeenth Street runs East (E) and West (W) ; thence East (E) along said line to the point of intersec- tion of said line with a line running Northeasterly (NE) and Southwesterly (SW) and parallel to and distant one hundred eighty-five feet (1851 ) Northwesterly (NW) from the center line of Seventeenth Street; running thence Northeasterly (NE) along said last mentioned line to the point of its intersection with the center lime of Clay Street, which is the northerly City Boundary Line; running thence Easterly (E) along said center line of Clay Street to the point of its intersection with a line running Northeasterly (NE) and Southwesterly (SW) and distant one hundred eighty-five feet (1851 ) Southeasterly (SE) from and parallel with the center line of Seventeenth Street; running thence Southwesterly (SW) along said last mentioned line to the point of its intersection with a line running due East (E) and West (W) and distant one hundred eighty-five feet (1851 ) Southerly (S) from the center line of Seventeenth 'Street where it runs East (E) and West (W) ; 4. running thence Westerly along said last mentioned line to the point of its intersection with a line running Northeast- erly (NE) and Southwesterly (SIV) and distant one hundred eighty-five feet (1851 ) Southeasterly (SE) from and Parallel with the center line of Seventeenth Street to the point of intersection of said last mentioned line with the center line of Main Street, running thence Northerly (N) along said center line of Vain Street to the -point of beginning; all as shown on Map numbered No. 1038, approved by the said Board of Trust- ees ,on the 26th day of June, 1922, and on file in the office of said City Engineer, to which said Map reference is hereby made for a more particular, complete and detailed description of said district, excepting from said district any portion of any public street or alley which may be included therein. SECTION 4. That said Board of Trustees hereby fur- ther determines that serial bonds shall be issued to represent assessments of $25.00 or over, for the cost and expense of said work and improvement; that said serial bonds shall extend over a period of nine years from the 2nd day of January next succeeding their date and an even annual proportion of the principal sum thereof shall be payable by coupon, on the 2nd days of January every year after their date, until the whole is paid, and the interest shall be payable semi-annually, by coupon, on the 2nd day of January and July, respectively, of each year at the rate of seven per cent (70L) per annum on all sums unpaid until the whole of said principal and interest 5. are paid; said bonds shall be payable at the office of the City Treasurer Of the City of Huntington Beach; California. SECTION 5. That the work and improvements and the proceedings for the aforesaid improvement shall be had and taken under an Act of the Legislature of the State of California designated and known as the "Improvement Act of 1911", approved April 7, 1911, and all acts supplementary thereto or amendatory thereof. SECTION 6. The City Engineer is directed to make a diagram of the property affected Or benefited by the pro- posed work or improvement as described in this Resolution of Intention and to be assessed to pay the cost and expense thereof. Such diagram shall show each separate lot, piece or parcel of land, the area in s quare feet of e ach o f such lots, pieces or parcels of land, the relative location of the same to the work proposed to be done, all within the limits of the assessment district, as provided by law. SECTION 7. The Street Superintendent shall cause to be conspicuously posted along the line of said contemplated work or improvement, and on all streets, alleys and highways within the district above described, notices of the passage of this Resolution of Intention, in the manner and form re- quired by Law. NOTICE IS HEREBY GIVEN THAT on Monday, the twenty- fourth dey of July, 1922, at the hour of eight o'clock P. V. 6. of the said day, in the Council Chamber of the Board of Trust- ees of said City at the City Hall, in the said City of Hunting- ton Beach, California., any and all persons having any objections to the proposed work or improvement, or to the extent of the district to be assessed or both, may appear before said Board of Trustees and show cause why said proposed improvement should not be carried out in accordance with this Resolution. SECTION 8. The City Clerk shall certify to the pass- age and adoption of this Resolution of Intention, and he shall cause the same to be published twice in the Huntington Beach Nears, a weekly newspaper of 7. eneral circulation, -�')-cinted, pub- lished anal circulated within the City of Huntington Beach, and rhich is hereby designated for that purpose.
