HomeMy WebLinkAboutCity Council - 400 j RESOLUTION Nd0. #400 RESOLUTION REGULATING THE USE Al p FIXING THE FEES FOR LETTING THE MUNICIPAL AUDITORIUM IN THE CITY OF HUNTINGTON BEACH. The Board of Trustees of the City of Huntington Beach do resolve as follows: Section 1. The Municipal Auditorium is hereby placed under the care, custody and control of city clerk under the supervision, nevertheless, of the Board of Trus- tees. Section 2. All applications for the use of the Municipal Auditorium shall be made to the said officer and subject to the direction of the Board of Trustees of the City of Huntington Beach, he is hereby authorized to grant or deny all or any of such applications; and no person as principal, agent or otherwise shall use or occupy the Mu- nicipal Auditorium or enter the same for the purpose of preparing or arranging for the use or occupancy thereof, without first having obtained a, permit so to do from the City Clerk, provided however, that the City Clerk or his representative shall at all times have free access to said Auditorium. Section 3. The• following schedule of charges for the letting of Municipal Auditorium' is hereby fixed and established as follows: 1. For all mass meetings, dance, entertainments, conventions or other uses the object of which is not fi- nancial gain which shall be open to the public and at which there shall be no charge for admission made or no collection taken, there shall be no charge for its use. 2. For all mass meetings, dances, entertainments, conventions or other uses, to which admission is granted by Invitation or card only, or the object of which is finan- cial gain, there shall be a charge of twenty-five ($25.00) dollars for the use of said Auditorium for the entire day and evening of such day; provided however, that in the event the applicant as hereinafter described desires to use said Auditorium only in the afternoon or evening, the charge for the use of said Auditorium for such afternoon or even- ing shall be only the sum of fifteen ($15.00) dollars. The words, "financial gain" as used in this Re- solution shall mean and shall be construed to mean that the applicant as hereinafter described, expects to derive any profits from the use of said Auditorium, ­,hether or not said profits are to be obtained by a charge for admission or by taking up a collection and whether or not said profits or receipts are to be used for charitable , philantropic, civic, political or any other purpose, It being the inten- tion of this Board that if said Auditorium is used to raise any money for any purpose, that the expenses incident to using said Auditorium, shall be paid by the applicant. Section 4, It is expressly provided, however, -2- that said Auditorium shall under no circumstances be used by any person, firm, corporation, association or organi- zation for the purpose of financial gain to such person, firm, corporation, association or organization or to any member, partner, officer, stock holder or beneficiary of such person, firm, corporation, association or organization, provided, further, however, that this restriction shall not be construed to prevent the use of said Auditorium by any charitable, philantropic, fraternal, religious, political, social or patriotic organization which is not organized for profit as defined under the laws of the State of Cali- fornia. In order to prevent the use of said Auditorium by any corporation organized for profit, when the receipts to be derived therefrom are to be used for charitable or philantropic purposes and from which the members of such firm, person, corporation, association or organization re- ceive no benefit. Section 5. The said City Clerk shall collect in advance all money for rental charges of said Municipal Auditorium and deposit the same at least once each month with the City Treasurer and take receipts therefor. Section 6. Any person, firm, corporation, as- sociation, convention, religious, fraternal, charitable or philantropic organizations desiring to use the said 1,11unicipal Auditorium shall file with the City Clerk of the City of Huntington Beach a written application for the use of said Auditorium which said application shall set -3- • forth the name of the applicant the date on which the applicant desires to use the Auditorium and whether in the afternoon or evening or both; the nature, kind, 'form or class of entertainment, convention, meeting, gathering or assembly proposed to be had or held; whether or not an admission charge is to be asked; whether or .not a collec- tion will be taken; whether or not any money received will be used for private gain whether for gain of an organi- zation or association, organized for civic, political, social, fraternal or patriotic purposes; whether any moneys to be received are to be devoted to philantropic or chari- table purposes and if so whether within this city, state or country; if the same is for the purpose of hearing an address, the name of the speaker or speakers to address the gathering, meeting or convention; whether the applicant is a religious, patriotic, civic, fraternal, political or social organization and if so, of which class. The said application shall be upon a form to be provided by the City Clerk and shall be signed by the applicant or an officer thereof, thoreunto duly authorized and shall be accompanied by the amount of rental fee hereinabove provided to be paid. Section 7. The City Clerk shall have power and authority to grant or reject any application for use of said Municipal Auditorium in his discretion, provided however, that the applicant may appeal from the decision of said City Clerk to the Board of Trustees of said City, and the said Board of Truatees shall have power to decide -4- • i whether or not application shall be granted and for such purpose may cell in any witnesses or other persons it may desire or may investigate the applicant or the purpose for which the Auditorium is sought to be used and shall in their discretion grant or refuse the use of said City Auditorium and their decision in the matter shall be final and conclusive.
