A RESOLUTION OF THE BOARD OF TRUSTFFS
OF THE CITY OF HUNTINGTON BEACH, CALI-
FORNIA, DECLARING ITS INTENTION TO
ORDER THE PAVING AND OTHERWISE IHPRO=-
VING OF FIFTH STREET IN THE SAID CITY
OF HU??TINGTON BEACH FR011, THE TIORTTf-
EASTERLY LINE OF OCEAN A177 UE TO THE
SOUTHEASTERLY LIME OF iAIN STREET;

TO BE ASSESSED, OR BOTH.
The Board of Trustees of the City of Huntington
Beach, California, pursuant to the provisions of the "Im-
provement Act of 1911" and all acts supplementary thereto
or amendatory thereof do resolve as follows:
Section 1. That the nublic interest and conven-
ience require and it is the intention of the Board of
Trustees of the City of Huntington Beach, California, to
order the construction of the following described work and
improvement in said City, to-wit:
1. The grading to the official grade there-
of of said Fifth Street in said City for the entire width
of said street, from property line to property line, from
the Northeasterly line of Ocean Avenue to the Southwester-
ly line of Main Street.

/ue, Fifth Street and Orange Avenue and on the Westerly side
of Fifth Street at the intersection with Magnolia Avenue;
together with branches or feeders on all four (4) corners
of the intersection of Fifth Street and Walnut Avenue and
the Southeasterly and the Southwesterly corners of Fifth
Street at the intersection of Orange Avenue and the South-
westerly corner of said Fifth Street at the intersection
of Magnolia Avenue, and on both sides of said Fifth Street
where it intersects Ocean Avenue; also a culvert under
drive leading to rear of the City Hall. Cement concrete
headwalls shall be constructed on the ends of culverts and
branches as shown on the plan.
5. The construction of an ornamental light-
ing system described as follows: thirty-four (34) orna-
mental single light standard fully equipped with a single
light and connected writh three-quarter (3/4) galvanized
electric conduit placed under ground adjacent to the curb
line; seventeen (17) of said single light standard on each
side of Fifth Street and spaced as shown on said plan.
They shall be of a single circuit and said circuit shall
terminate on the pole of the Southern California Edison
Electric Company which is situated in the m«.in alley in
the first block on Fifth Steet, which will be the feed-in
point for said circuit.
All of the aforesaid heretofore mentioned described
work to include the roadways, sidevaalk returns a_nd curb re-
turns of all intersecting and terminating street and alleys

and avenues in said Fifth Street between the aforesaid
mentioned described limit.
The grade to which all of the above described
work shall be done and improvement made, shall be the es-
tablished official grade and as shown on the plan, profile
and cross-section therefor on file in the office of the
City Engineer, to which said plan, profile and c-oss-sec-
tion reference is hereby made for the description of any
grade not officially established.
All of the foregoing work is fully set forth,
delineated and described on, the elan, profile and cross-
section and specifications therefor, to which reference
is hereby made for a. full, complete particular and detailed
description of the work,
Section-2, Plan, Profile, Cross-Section and
Specifications.
All of the said work and improvement to be done
as shown upon and according to the plan, profile, and cross-
section therefore numbered New Series Nine (9) in four (4)
sheets, and according to specifications numbered twenty-
seven and twenty-eight (27 & 28) for the construction of
asphaltic concrete base and Willite Plastic Composition
wearing surface pavement, headers, curbs, culverts, head-
walls, conduits, ornamental lighting standards and lights,
and grading roadways, on file in the office of the City
Clerk of said City, and all of said plans, profiles, cross-
sections and specifications have been approved and adopted

as the ;plans, profiles, cross-sections and specifications
to be followed in. making said improvement, and by reference
thereto the same are incorporated herein and made a part
hereof, and reference is hereby made thereto for a full,
complete, and more particular description of said work.
Section j. The Board of Trustees also determine
and declare that serial bonds shall be issued to represent
each assessment of Twenty-five ( 25.00) Dollars or more
remaining unpaid for twenty days after the date of the
warrant to represent the expenses of said work and. improve-
went. Said serial bonds shall extend over a period of ten
(10) years from the second (2nd) day of January next sue-
deeding the fifteenth (15th) day of the next November fol-
lowing their date, and even proportion of the principal
sum thereof shall be payable by coupon on the second (2nd)
day of January every year after the fifteenth (15_th) day
of the next November following their date, until the whole
is paid; and the interest shall be payable semi-annually,
by coupon on the second days (2nd) of January and July,
respectively, of each year after their date, at the rate
of seven (7) per centum per annum on all sums unpaid,
until the whole of said principal and interest are paid.
Section 4. Description of Assessment District.
That the contemplated work and improvement hereinbefore
mentioned is in the opinion of said Board of Trustees of
more than local or ordinary public benefit and the expense
of said work and improvement is made chargeable upon the

district hereinafter described, and said Board of Trustees
does hereby declare said district to be the district bene-
fited by said work and improvement and to be assessed to
pay the cost and expenses thereof, Mich district is boun-
ded and described as follows, to slit:
All of that reel property situated in the City
of Huntington BeacN California, included within the follow-
ing described exterior boundary lines, to-wit: Commencing
at the point of intersection of the center line of Ocean
Avenue with the center line of Fifth Street, in said City;
thence in a straight line to the most Westerly (W) corner
of Lot Five (5) Block One hundred and five (105) , Hunting-
ton Beach Tract; thence in a straight line to the most
Northerly (N) corner of said Lot Five (5) Block One hun-
dred and five (105) , Huntington Beach Tract; thence in a
straight line to the intersection of the center line of the
alley running through Block One hundred and five (105) 2
Two Hundred and five (205) , Three Hundred and five (505)
and through Block Four Hundred and five (405) , Hunting-
ton Beach Tract with the center line of a private driveway
formerly Magnolia Avenue, thence in a straight line to the
point of intersection of the center line produced of the
alley running through Block Five Hundred and five (505)
Huntington Beach Main Street Section with said center line
of a private driveway formerly Magnolia Avenue; thence
Northerly along said center line of the alley running
through said Block Five hundred and five (505) Huntington

Beach Main Street Section to the point of intersection of
the said center line of said alley urith the Northerly boun-,
dary of Lot Five (5 ) in said Block Five hundred and five
(505) produced, thence along said Northerly boundary of
said Lot Five (5) produced, to the point of intersection
with the center line of ITain Street, thence Southerly along
said center line of Main Street to the point of intersection
of the Northerly line of Lot ten (10) , Block Four Hundred
and four (404) Huntington Beach Main Street Section, pro-
duced Easterly to said center line of Main Street; thence
in a. straight line to the point of intersection of said
Northerly line of said Lot Ten (10) Block Four hundred and
four (4W , Huntington Beach Main Street Section; produced
Westerly with the center line of the alley running through
said Block Four hundred and four (404) ; thence following
said center line of said alley Southerly and Southwesterly
through said Block Four hundred and four (404) and through
Blocks Three hundred and four (304), Two hundred and four
(204) and One hundred and four (104) Huntington Beach Tract
to the most Easterly corner of Lot Six (6) Block One Hun-
dred and four (104) Huntington Beach Tract, thence in a.
straight line to the most Southerly corner of said Lot Six
(6) Block One hundred and four (104) Huntington Beach Tract;
thence in a straight line to the point of beginning; ex-
cepting therefrom any portion of any street or alley which
is included within the above described district.
The above description is general only; A plan,
diagram or map of said district indicating by a boundary
line the extent of the territory included in the proposed
district is on file in the office of the CityEngineer.
Reference is hereby made to the said map or plat for fur-
ther full and complete description of the said assessment
district. The said plat or map so cn file shall govern
for all details as to the extent of the said assessment
district.
Section 5. Time and Place of Hearing:
Notice is hereby given that on Monday the Seventh (7th)
day of January, 19241 at 7:30 o' clock P.1 . in the Council
Chamber of the Board of Trustees located in the City Hall
in the said City of Huntington Beach, any and all persons
having any objections to the proposed work or improvement,
or to the extent of the district to be assessed, or both,
may appear before the said Board of Trustees and shove cause
why said proposed improvement should not be carried out
in accordance with this resolution.
Section 6. Diagram of the Property to be Assessed.
The City Engineer is hereby directed to make a diagram of
the property effected or benefitted by the proposed work
or improvement as described in this Resolution of Intention
and to be assessed to nay the expenses thereof. Which dia-
gram shall shover each separate lot, piece or -parcel of
"Improvement Act of 1911" approved April 7, 1911 and all
acts supnlementary thereto or amendatory thereof.
Section 9. Willite Plastic Composition Licensed
Fixture Agreement. Reference is hereby made to the Cali-
fornia Willite Road Construction Company Plastic Composi-
tion Licensed Agreement, dated the 3rd day of December
1923, and on file in the office of the City Clerk of said
City of Huntington ?each, and open to public inspection.
Section 10. Publication of Resolution of Inten-
tioni The Huntington Beach Nees, a weekly newspaper pub-
lished and circulated and of general circulation in the
City of Huntington Beach is hereby designated as the news-
paper in which this Resolution of Intention shall be pub-
lished and the City Clerk of said City is hereby directed
to cause this Resolution of Intention to be published for
two (2) insertions in said newspaper in the manner and form
required by law, and the said City Clerk is hereby further
directed to cause this Resolution of Intention to be posted
in three conspicuous places in the said City of Huntington
Beach, in the manner and form required by law. The Board
of Trustees does not deem it advisable that the Clerk mail
copies of the notice of the improvement to owners or reputed
owners, and he is not required to mail same.
Section 11. Posting Notices of Improvement:
The Street Superintendent of said City shall after the
adoption of this Resolution of Intention, cause to be con-
spicuously posted along the line of said contemplated work
or improvement, and along the line of all the open streets
within the hereinbefore described assessment district,

notices of the passage of this Resolution of Intention and
in said notices shell call attention to the Willite Cali-
fornia Road. Company Plastic Composition Licensed Mixture
Agreement dated the 3rd day of December 1923, and on file
in the office of the City Clerk of said City of Huntington
Beach, California, and open to public inspection, in the
manner and form rewired by law.
Passed and adopted by the Board of Trustees of
the City of Huntington Beach, California., and signed and
approved by the President of said Board of Trustees at a
regular meeting thereof held on the 3rd day of December,
1923.
