HomeMy WebLinkAboutCity Council - 406 RESOLUTION NO. 406 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALI- FORNIA, DECLARING ITS INTENTION TO ORDER THE PAVING AND OTHERWISE IaIiiPRO- VING OF FIFTEENTH STREET IN THE SAID CITY OF HUNTINGTON BEACH FROM THE NORTHEASTERLY LINE OF OCEAN AVENUE TO THE SOUTH'TESTERLY CURB LINE OF PALM AVENUE; DECLARING THE SAID CORK OR IM= P MOVEMENT TO BE OF 'I"ORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT; DECCARING TILE DISTRICT TO BF BrNEFITED BY SAID WORK OR IMPROVEMENT AND TO BE ASSESSED TO PAY THE COST OR EXPENSES THEREOF; DETERMINI`�IG THAT BONDS SMALL BE ISSUED TO REPRESENT SAID COST AND EXPENSES AND FIXING A TIME AND PLACE FOR HEAR- ING OBJECTION TO SAID WORK OR IMPROVE- 14IENT OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BOTH. The Board of Trustees of the City of Huntington Beach California., pursuant to the provisions of the "Im- provement .tact of 1911" and all acts supplementary thereto or amendatory thereof do resolve as follows: Section 1. That the public interest and conven- tence require and it is the intention of the Board of Trustees of the said City of Huntington Beach, California, to order the construction of the following; described work a.nd improvement in said City, to-wit: 1. The grading to the official grade there- of of Fifteenth Street in said City for the entire width of the roadway, from curb line to curb lute , together with the intersections of intersecting streets and alleys be- i tween the curb lines and from property line to property line from the Northeasterly line of Ocean Avenue to the Southwesterly curb line of Palm Avenue. 2. The paving with a two (2) inch Willite Composition vrearing surface laid upon a three (3) inch asphaltic concrete base of the roadway of said Fifteenth Street in said City, from curb line to curb line .together with the intersections of intersecting streets between the curb line and from property line to property line from the Northeasterly 11ne of Ocean .Avenue to the Southwesterly curb line of said Palm Avenue. 3. The construction of a corrugated gal- vanized iron half-round ten (10) gauge culvert on a tlr=o (2) inch thick concrete base; said culvert to be fifteen (15) inches -ide at the base with a five (5) inch rise. The inner edge of said culvert to be constructed contig- uously and adjacent to the curb line of said Fifteenth Street on both sides of the intersection of said Fifteenth Street and Walnut Avenue with feeder to the same on the Southerly a.nd Easterly corners of said intersection--said feeders to be placed contiguously and adjacent to the curb line of said Walnut Avenue at said intersection: 2 culverts as above described shall be placed contiguously and adjacent to the curb line of Orange Avenue from pro- perty line to property line of said Fifteenth Street and across said Fifteenth Street with feeders on the Northerly and Westerly corners of the intersection of said Fifteenth -2- • i Street and said Orange Avenue; also two (2) culverts con- tiguously and adjacent to the said curb line of Fifteenth Street on both sides of said street crossing :agnolia Avenue with feeders as above described on all four corners of said intersection; also two (2) culverts as above de- scribed crossing Acacia Avenue with feeders on the Norther- ly and Westerly corners of the Intersection of_ said Acacia Avenue and Fifteenth Street; also one (1) culvert on the Westerly corner of the intersection of Palm Avenue and said Fifteenth Street extending from a ;point where the property line of said Fifteenth Street produced intersects the curb line of said Palm Avenue at its Westerly corner and running to a point where the Testerly property line of said Palm Avenue intersects the Northerly curb line of said Fifteenth Street--said culvert to be of the type as above described. Cement concrete headwalls shall be con- structed at the ends of the above culverts and feeders as shorn on the ?plan. 4. The construction of an ornamental light- ing system described as follows: Twenty five (25)_ orna- mental single light standards fully equipped with a. single light and connected with three--quarter (3/4) galvanzied electric conduits placed under ground adjacent to the curb line. Twelve (12) of said single light standards on one side of said Fifteenth Street and thirteen (13) on the other and spaced approximately two hundred and thirty (230) feet apart. They shall be of a single circuit and said circuit -3- • • shall terminate on the pole of the Southern California Edison Electric Company which is situated in the main Alley in the first block on said Fifteenth Street which will be the feed-inpoint for said circuit. All of the aforesaid heretofore mentioned described work to include the roadways of all intersecting and terminating streets and alleys and avenues in said Fifteenth Street between the aforesaid mentioned described limits, The grade to which all of the above described work shall be done and improvement made, shall be the es- tablished official grade and as shown on the plan, profile and cross-section therefor on File in the office of the City Engineer, to which said plan, profile and cross-section reference is hereby made for the description of any grade not officially established. All of the foregoing work is fully set Forth, delineated a"nd described on the plan, profile, and cross-section and specification therefor, to which refer- ence is hereby made for a full, complete , particular and detailed description of the work. Section 2. Plan, Profile, Cross-Section and Specification. All of the said work and improvement to be done as shown upon and according to the plan, profile, and cross-section therefor numbered New Series 10 in 4 sheets, -4- • and according to specifications nu jeered 20. and 30 for the construction of Asphaltic Concrete base and Willite Plastic Composition wearing surface pavement headers, cul- verts, head-walls, conduits, ornamental lighting standards and lights and grading roadways, on file in the office of the City Clerk of said City, and all of said plans, profiles, cross-sections and specifications have been approved and adopted as the plans, profiles, cross-sections and specifi- cations to be followed In making said Improvement, and by reference thereto the same are incorporated herein and made a part hereof, and reference is hereby made thereto for a full, complete and more particular description of said work. Section 3. The Board of Trustees also determine and declare that serial bonds shall be issued to represent each assessment of Twenty-five ($25) Dollar's or more re- maining unnpid for Vkenty days after the date of the war- rent, to represent the expenses of said work and Improve- ment. Said serial bonds shall extend for a period of 10 years from the 2nd day of January next succeeding the 15th day of the next November following their date and an even proportion of the principal suTn thereof shall be payable by coupon on the 2nd day of January every year after the 15th day of the next 11ovember following their date until the whole is paid; and the Interest shall be payable semi-annually, by coupon, on the 2nd days of Janu- -5- ary and July respectively, of each year after their date, at the rate of 7 per centurm per annum on all sums unpaid, until the whole of said principal and interest are paid. Section 4. Description of Assessment District. That the contemplated work and improvement hereinbefore mentioned is in the opinion of the Board of Trustees, of more than local or ordinary public benefit and the expense of said work and improvement is made chargeable upon the district hereinafter described, and said Board of Trustees does hereby declare said district to be the district bene- fited by said work and improvement and to be assessed to pay the cost and expenses thereof, which district is boun- ded a.nd described as Follows, to-wit: All of that real property situated in the City of Huntington Beach, Cali- fornia, included within the following described exterior boundary lines, to-wit: commencing at the point of inter- section of the center line of Ocean Avenue with the center line of 15th Street in said City, thence in a straight line to the most westerly corner of Lot 5 Block 115 Hun- most northerly corner of said lot 5 Block 115, Hun- tington Beach Tract; thence in a straight line to the / tington Beach Tract; thence in a straight line to the /Intersection of the center line produced of the alley run- ning through Block 115; 215, 515, 4159 515, 615, Hunting- ton Beach Tract with the center line of Palm .Avenue; thence In a straight line Southeasterly along said center line of said Palm :Avenue to: the point- of intersection of the center line produced of the alley running through Block 614 Huntington Beach Tract with said center line of said -6- Palm Avenue; thence turning and running along the said center line of said alley Southwesterly through Blocks 614, 514, 414, 314, 214, and 114 Huntington Beach Tract, to the most easterly corner of Lot 6 Block 114 Huntington Beach Tract; thence in a straiEht line to the most South- erly corner of said Lot 6 Block 114 Huntington Beach Tract; thence in a straight line to the point of beginning; ex- cepting therefrom any portion of any street or alley which is included within the above described district. The above description is general only. A plan, diagram or map of said district indicating by boundary line the extend of the territory included in the proposed district is on file in the office of the City Engineer. Re ference Is hereby made to the said plat or map for fur- ther, full and complete discription of the said assessment district. The said plat or map so on file shall govern for all details as to, the extent the said assessment dis- trict. Section 5. Time and .Place of Hearing. Notice is hereby given that on Monday the 7th day of Janu- ary 1924 at 7:30 o' clock P. M. In the Council Chamber of the Board of Trustees located in the City Hall in the said City of Huntington Beach any and all persons having any objection to the proposed work or improvement, or to the extent of the district to be assessed, or both, may appear before the said Board of Trustees and show cause why said proposed improvement should not �e carried out in accord- -7- • ance with this resolution. Section 6. Diagram of the Property to be Assessed; The City Engineer is hereby directed to make a diagram of the property effected or benefited by the proposed work or improvement as described in this Resolution of Intention and to be assessed to pay the expenses thereof. Which dia- gram shall shot each separate lot piece or parcel of land, the area in square feet of each of said lots, pieces or par- eels of land, and the relative location of the same to the work proposed to be done, all within the limits of the said assessment district. Section 7. Public Ways. The streets avenues and alleys referr--d to in this Resolu- tion of Intention are public ways in the said City of Hun- tington Beach. Section S. Improvement Act. All of the proceedings for the aforesaid pork and improve- ment shall be had and Ulm under and in accordance with the provisions of those acts of the Legislature of the State of California, designated as "The land, the area in. square feet of each of said lots, pieces or parcels of land, and the relative location of same to the work pro- Dosed to be done, all writhin the limits of said assessment district. Section 7. Public 'V, ^.ys The street, avenues and alleys, except the private drive- v7a.y formerly known as Magnolia Avenue, referred to in this _8- • Resolution of Intention are public "rays in the said City of Huntington Beach. Section 8. Improvement Act. All of the proceedings for the aforesaid work and improve- Ment shall be had and taken under and in accordance with the provisions of those Acts of the Legislature of the State of California, designated as the Improvement Act of 1911 approved April 7th, 1911 and all Acts supplementary thereto or amendatory thereof. Section 9. Willite Plastic Composition Licensed fixture Agreement Reference is hereby made to the California. Willite T1oad Construction Company Plastic Composition Li- censed Agreement, dated the 3rd day of December, 1923, and on file in the office of the City Clerk of said city of Huntington Beach, and open to public inspection. Section 10. Publication of Resolution of In- tention. The Huntington Beach News, a .weekly newsp per published e-nd circulated and of general circulation in the City of Huntington Beach, is hereby designated as the newspaper in vinich this Resolution of Intention shall be published and the City Clerk of said City is hereby directed to cause this Resolution of Intention to be published for two (2) insertions in said newspaper in the manner and form re- quired by later and the said City Clerk is hereby further directed to cause this Resolution of Intention to be post- ed in three conspicuous places in the said City of ,Hunting- ton Beach in the manner and form required by lair. The Board of Trustees does not deem it advisable that the Clerk mail copies of the notice of the improvement to owners or reputed o�A,mers , and he is not required to mail same. Section 11. Posting Notices of Improvement: The Street Superintendent of said City shall after the adop- tion of this Resolution of Intention, cause to be conspic- uously posted along the line of said contemplated work or improvement, and along the line of all the open streets within the hereinbefore described assessment district, notice of the passage of this Resolution of Intention and in said notices shall call attention to the Willite California Road Construction Company Plastic Composition Licensed Mix- ture ,Agreement dated the 3rd day of December 1923, and on file in the office of the City Clerk of said City of Hunting- ton Beach, California and open to public inspection, in the manner and form required by lair. Passed and adopted by the Board of Trustees of the City of Huntington Beach, California., and signed and approved by the President of said Board of Trustees at a regular meeting thereof held on the 3rd day of December 1923, Richard Drew President of the Board of Trus- tees.
