RESOLUTION OF INTENTION NO. 408 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE PAV`- ING AND OTHERWISE IMPROVING OF TENTH STREET IN SAID CITY OF HUNTINGTON BEACH FROM THE NORTHEASTERLY LINE OF OCEAN AVENUE TO A LINE PARALLEL TO AND TWO (2) FEET NORTHEASTERLY FROM THE SOUTHWESTy ERLY CURB LINE OF PALM AVENUE. Declaring the said work or improvment to be of more than ordinary benefit; declaring the district to be benefited by said work or improvement and to be assessed to pay the cost or expenses thereof; determining that bonds shall be issued to represent said cost and expenses and fixing a time and place for hearing objections to said work or improvement , or to the extent of the district to be assessed, or both. The Board of Trustees of the City of Huntington Beach, California, pursuant to the provisions of "The Im- provement Act of 191111 , and all Acts supplementary thereto or amendatory thereof, do resolve as follows; Section 1. That the public interest and conven- ience require and it is the intention of the Board of Trus- tees of the said City of Huntington Beach, California, to order the construction of the following described work and improvement in said City, to-wit; 1. The grading to the official grade thereof of Tenth Street in said City for the entire width of the roadway, from curb line to curb line together with the intersections of intersecting streets and alleys between the curb lines and from property line to property line except where such improvements have already been made, from the Northeasterly line of Ocean Avenue to a line paral- lel"' to and two (2) feet Northeasterly from the Southwesterly curb line of Palm Avenue. 2. The paving with a two (2) inch Willite Com- position wearing surface laid upon a three (3) inch asphal- tic concrete base of the roadway of said Tenth Street in said City, from curb line to curb line together with the intersections of intersecting streets and alleys between the curb lines from property line to property line, except where such improvements have already been made from the Northeasterly line of Ocean Avenue to a line parallel to and two (2) feet Northeasterly from the Southwesterly curb line of said Palm Avenue 3. The construction of a corrugated galvanized iron half-round ten (10) gauge culvert on a two (2) inch thick cement concrete base; said culvert to be fifteen inches wide at the base with a five (5) inch rise. The inner edge of said culvert to be constructed contiguously and adjacent to the curb line of the Southwesterly side of Olive Avenue from property line to property line of said Tenth Street and across said Tenth Street with feeders -2 • on the Southeasterly corners of the intersection of said Tenth Street and Olive Avenue; also a culvert as above described crossing the Northerly corner of. said Olive Ave- nue and Tenth Street from the point of intersection of the Northeasterly property line of said Olive Avenue pro- duced with the Northwesterly curb line of said Tenth Street to the point of intersection of the Northwesterly property line of said Tenth Street produced with the Northeasterly curb line of said Olive Avenue; also two (2) culverts as above described contiguously and adjacent to the Northeast- erly and the Southwesterly curb line of Orange Avenue from property line to property line of said Tenth Street, each one crossing said Tenth Street with feeders on all four corners of the intersection of the said Tenth Street and said Orange Avenue; also a culvert as above described shall be placed contiguously and adjacent to the Southwesterly curb line of Palm Avenue from property line to property line of said Tenth Street and crossing said Tenth Street with feeders on the Southeasterly and Southwesterly cor- ners of the intersection of the said Tenth Street and Palm Avenue. Cement concrete headwalls shall be constructed at the ends of the above described culverts and feeders, and where required at the ends of the culverts already in place wherever shown on the plan. 4. The construction of an ornamental lighting system consistlnC of twenty-three (23) lights, standards -3- I and lights , twelve (12 ) of which are located on the South- westerly side of said Tenth Street and eleven (11) on the Northeasterly side of said Tenth Street spaced approximately two hundred and thirty-one (231) feet apart. Said light- ing system shall e fully equipped with a single light. stand- ard and lights , and connected with three-quarters (3/4) inch galvanized electric conduit placed under ground ad- jacent to the curb line. They shall be of a single gir- suit and said circuit shall terminate on the pole of the Southern California Edison Electric Company which is sit- uated in the main alley in the first block on said Tenth Street which will be the feed in point for said circuit. All of the aforesaid heretofore mentioned des- cribed work to include the roadways of all intersecting and terminating streets , alleys and avenues in said Tenth Street between the aforesaid mentioned described limits except where improvements have already been made. The grade to which all of the above described work shall be done and improvement made shall be the estab- lished official grade and as shown on the plan, profile and cross-section therefor on file in the office of the City Engineer to which said plan, profile and cross-sec- t'e fe,�_v1L-Q tionAis hereby made for the description of any grade not officially established. All of the foregoing work is fully set forth, delineated and described, on the plan, profile and cross- -4- section and specifications therefor, to which reference is hereby made for a full, complete, particular and detailed description of the work. Section 2. Plan, Profile, Cross-section and Specifications. All of the said work and improvements to be done as shown upon and according to the plan, pro- file , and cross-section therefor numbered New Series eleven (11) in four (4) sheets, and according to the specifica- tions numbered 31 and 32 for the construction of asphaltic concrete base and Willite Plastic Composition wearing sur- face pavement, headers , culverts, head-walls, conduits, ornamental lighting standards and lights and grading road- ways , on file in the office of the City Clerk of said City and all of said plan, profile, cross-section and specifi- cations have been approved and adopted as the plan, pro- file, cross-section and specifications to be followed in making said improvement, and by reference thereto the same are incorporated herein and made a part hereof, and refer- ence is hereby made thereto for a full, complete and more particular description of said work. Section 3. The Board of Trustees also determine and declare that serial bonds shall be issued to represent each assessment of Twenty-five dollars ( 25.00) or more remaining unpaid for twenty days after the date of the warrant , to represent the expenses of the said work and improvement. Said serial bonds shall extend for a period -5- • of ten (10) years from 'the second (2nd) day of January next succeeding the fifteenth (15th) day of the next Nov- ember following their date, and an even proportion of the principal sum thereof shall be payable by coupon on the second (2nd) day of January every year after the fifteenth (15th) day of the next November following their date until, the whole is paid; and the interest shall be payable semi- annually, by coupon, on the second (2nd) day of January and July respectively, of each year after their date, at the rate of seven (7) per centfper annum on all sums un- paid, until the whole of said principal and interest are paid, Section 4. Description of Assessment District. That the contemplated work and improvement hereinbefore mentioned is, in the opinion of the Board of Trustees, of more than loea� or ordinary public benefit and the ex- pense of said work and improvement is made chargeable upon the district hereinafter described, and the said Board of Trustees does hereby declare said district to be the district benefitted by said work and improvement and to be assessed to pay the cost and expenses thereof, which district is bounded and described as follows, to-wit; All of that real property situated in the City of Huntington Beach, California, included within the fol- lowing described exterior boundary lines , to-wit; Commencing at the point of intersection of the -6- i center line of Ocean Avenue with the center line of Tenth Street in said City, thence in a straight line to the most westerly corner of Lot Five (5) Block one hundred ten (110) Huntington Beach Tract , thence along the Northwesterly line of said Lot 5 to the most Northerly corner of said lot , thence in a straight line to the point of intersection of the Northeasterly line of the alley running Southeasterly and Northwesterly in said block with the center line of the alley running Northeasterly and Southwesterly in said block, thence Northeasterly along the center line of said alley running Northeasterly and Southwesterly through Blocks One hundred ten (110), Two hundred ten (210) , Three hunr* dred ten (310) Huntington Beach Tract; Four hundred ten (410) , Five hundred ten (510) and Six hundred ten (610)- Huntington Beach Main Street Section to the point where said line projected Northeasterly intersects the center line of Palm Avenue, thence Southeasterly along the said center line of Palm Avenue to the point of its intersection with the projected line of the alley running Northeasterly and Southwesterly through Block Six hundred nine (609.) Hunt- ington Beach Main Street Section, thence Southwesterly along said projected center line of said alley through Blocks Six hundred nine (609) , Five hundred nine (509) and Four hundred nine (409 ) Huntington Beach Pain Street Sec— tion, and Blocks Three hundred nine (309) , Two hundred nine (209) and One hundred nine (109) Huntington Beach Tract _7_ to the point of its intersection. with the Northeasterly line of the alley running Northwesterly and Southeasterly through Block One hundred nine (109) , thence in a straight line to the most easterly corner of Lot Six (6) , said block One hundred nine (109) , thence along the Southeasterly boundary line of said Lot Six (6) to the most Southerly corner of said lot, thence to the point of beginninIg. The above description is in general only. A. plan, diagram or map of said district indicating by a boundary line the extent of the territory included in the proposed district is on file in the office of the City Engineer. Reference is hereby made to the said plat or map for fur ther ,full and complete description of the said Assessment District. The said plat or map so on file shall govern for all details as to the extent of the said assessment district. Section 5. Time and Place of Hearing. Notice is hereby given that on Monday the 2 day of Jan^ nary 1924 at 7;30 O' clock P.M. in.the Council Chamber of. the Board of Trustees located in the City Hall in the said City of Huntington Beach, any and all persons having any objection to the proposed work or improvement , or to the extent of the District to be assessed, or both, may appear before the said Board of Trustees and show cause why said proposed improvement should not be carried out in accord- ance with this Resolution. Section 6. Diagram of the Property to be Assessed. The City Engineer is hereby directed to make a diagram of the property ,effected or benefitted by the proposed work or improvement as described in this Resolution of Inten- tion and to be assessed to pay the expenses thereof. Which diagram shall show each separate lot, piece or parcel of land, the area in square feet of each of said lots , pieces or parcels of land, and the relative location of the same to the work proposed to be done, all within the limits of the said Assessment District. Section 7. Public Ways. The streets, avenues and alleys referred to in this Resolution of Intention are public ways in the Raid City of Huntington-Beach. Section 8. Improvement Act. All of the proceed- ings for the aforesaid work and improvement shall be had and taken under and in accordance with the provisions of those acts of the Legislature of the State of California, designated as "THE IMPROVEMENT ACT OF 1911" approved April 7th, 1911 and all acts supplementary thereto or amendatory thereof. Section 9. Willite Plastic Composition License Mixture Agreement. Reference is hereby made to the Calif- ornia Willite Road Construction Company Plastic Composi- tion Licensed Agreement dated the JZth day of D��Pr 1923 and on file in the office of the City Clerk of said City of Huntington Beaci, and open to public inspection. -9- Section 10. Publication of Resolution of Inten- tion. The Huntington Beach News , a weekly newspaper pub- lished and circulated and of general circulation in the City of Huntington Beach, is here by designated as the news- paper in which this Resolution of. Intention shall be pub- lished, and the City Clerk of said City is hereby directed to cause this Resolution of Intention to be published for two (2) insertions in said newspaper in the manner and form required by law, and the said City Clerk is hereby further directed to cause this Resolution of Intention to be posted in three (3) conspicuous places in the said City of Huntington Beach, in the manner and form required by law. The Board of Trustees does not deem it advisable that the Clerk mail copies of the notice of the improvement to owners or reputed owners , and he is not required to mail the same. Section 11. Posting Notices of Improvement. The Street Superintendent of said City shall after the adoption of this Resolution of Intention cause to be con- spicuously posted along the line of said contemplated work or improvement and along the line of all the open streets within the herein before described assessment district, notices of the passage of this Resolution of Intention and in said notices shall call attention to the California Willite Road Construction Company Plastic Composition Licensed Mixture Agreement dated the 111h day of December -10- 1923 and on file in the office of the City Clerk of said City of Huntington Beach, California, and open to public inspection, in the manner and form required by law.
