HomeMy WebLinkAboutCity Council - 410 t _ RESOLUTION OF INTENTION NO. 410 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTING- TON BEACH, CALIFORNIA, DECLAR- ING ITS INTENTION TO ORDER CON- STRUCTION OF AN ORNAMENTAL LIGHT" ING SYSTEM ON ELEVENTH (llth) STREET IN THE SAID CITY OF HUNT- INGTON BEACH FROM THE NORTHEAST- ERLY LINE OF OCEAN AVENUE TO THE SOUTHWESTERLY LINE OF MIN STREET; DECLARING THE SAID WORK OR IMPROVE-, MENT TO BE OF MORE THAN LOCAL OR OR- DINARY PUBLIC BENEFIT; DECLARING THE DISTRICT TO BE BENEFITTED BY SAID WORK OR IMPROVEMENT AND TO BE ASSESS- ED TO PAY THE COST OR EXPENSES THEREOF; DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT SAID COST AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK OR IMPROVEMENT, OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED; OR BOTH. The Board of Trustees of the City of Huntington Beach, California, pursuant to the provisions of the Im- provement- Act of 1911 and all Acts supplementary thereto or amendatory thereof, do resolve as follows; Section 1. That the public interest and conven- ience require and it is the intention of the Board of Trus- tees of the said City of Huntington Beach, California, to order the construction of the following described work and improvement in said City, to- wit; 1. The construction of an ornamental lighting system fully equipped with single light standards and single i lights and connected with three-quarter (3/4) inch galvan- ized electric conduit placed under ground adjacent to the curb line. There shall be thirty (30) of said single light standards , fifteen (15 ) on each side of said Eleventh (llth) Street spaced approximately two hundred and twenty-five (225) feet apart more or less. They shall be of a single circuit and said circuit shall terminate on the pole of Electric the Southern California Edison/Company which is situated Block in the alley running parallel to Ocean Avenue in/110 Hunt- ington Beach Tract , Records of Orange County, California, on said Eleventh (llth) Street which will be the feed-in point for said circuit. The grade to which all of the above described work shall be done and improvement made shall be the es- tablished official grade, and as shown on the plan therefor on file in the office of the City Engineer, to which said plan reference is hereby made for the description of any grade not officially establtshed. All the foregoing work is fully set forth, de- lineated and described on the plan, detail sheet specifi- cations therefor to which reference is hereby made for a full, complete, particular and detailed description of the work. Section 2. Plan, Detail Sheet, and Specifications. All of the said work and improvement to be done as shown upon and according to the plan and detail sheet therefor -2- • numbered New Series Twelve (12) in two (2) sheets , and according to specifications numbered thirty-three (33) for the construction of ornamental lighting standards add lights on file in the office of the City Clerk of said City, and all of said plan, detail sheet and specifications have been approved and adapted as the plan, detail sheet and specifications to be followed in making said improve- ment, and by reference thereto the same are incorporated herein and made a part hereof, and reference is hereby made thereto for a full, complete and more particular des" cription of said work. Section 3. The Board of Trustees also determine and declare that serial bonds shall be issued to represent each assessment of Twenty-five Dollars ($25,00) or more remaining unpaid for twenty days after the date of the war- rant, to represent the expenses of said work and improve- ment. Said serial bonds shall extend for a period of ten (10) years from the second day of January next succeedigg the fifteenth day of the next November following their date, and an even proportion of the principal sum thereof shall be payable by coupon on the second day of January every year after the fifteenth day of the next November following their date until the whole is paid; and the interest shall be payable semi-annually, by coupon, on the second days of January and July respectively, of each year after their date,- at the rate of seven (7) per cent um -3- i • per annum on all sums unpaid, until the whole of said prin- cipal and interest are paid. Section 4. Description of Assessment District; That the contemplated work and improvement hereinbefore mentioned is , in the opinion of the Board of Trustees, of more than local or ordinary public benefit and the expense is of said work and Imnrovement/therefore made chargeable upon the district hereinafter described, and said Board of Taus tees does hereby declare said district to be the district benefitted, by said work and improvement and to be assessed to pay the cost and expenses thereof, which district is bounded and described as follows , to-wit: All of that real property situated in the City of Huntington Beach, California, included within the fol- lowing described exterior boundary lines, to-wit: Commencing at theppoint of intersection of the center line of Ocean Avenue with the center line of Eleventh (llth) Street in said City, thence in a straight line to the most westerly corner of Lot Five (5 ) in Block one hun- dred and eleven (111) Huntington Beach Tract; thence in a straight line to the most Northerly corner of said Lot Five (5 ) Block one hundred and eleven (111) Huntington Beach Tract, thence Northeasterly in a straight line to the point of intersection of the produced center line of the alley running through Blocks 111, 211, and 311 Huntington Beath -4- • Tract with the center line of Orange Avenue, thence in -a straight line to the most westerly corner of Block 411., Huntington Beach 17th. Street Section, thence in a straight line to the most Northerly corner of Block 511, Huntington Beach 17th. Street Section, thence to the point of inter- section of the center line of Acacia Avenue with the pro- duced center line of the alley running through Block 611 Huntington Beach 17th. Street Section, thence in a straight line to the most westerly corner of Lot 19 Block 711 Hunt- ington Beach 17th. Street Section, thence in a straight line to the most Northerly corner of said lot, thence in a straight line to the most westerly corner of Block11 , Wesley Park Tract , thence in a straight line to the. North- westerly corner of said Block fill, thence in a straight line to the Southeasterly corner of Lot 12 Block 812, Wes- ley Park Tract , thence in a straight line to the Northeast- erly corner of Block 811, Wesley Park Tract , thence in a straight line to the Northwesterly corner of Block 910, Wesley Park Tract , thence in a straight line to the South- easterly corner of Lot 24 Block 810, Wesley Park Tract , thence in a straight line to the Southwesterly corner of said lot, thence in a straight line to the Southeasterly corner of Lot 14 in said Block, thence in a straight line to the Southwesterly corner of said Lot 14, thence in a straight line to the most Southerly corner of Lot 16 • Block 710 of said tract , thence in a straight line to the mast Northerly corner of Lot 15 of said Block, thence in a straight line to the point of intersection of the cen - ter line of the alley in Block 710 with the Southwesterly boundary line of Lot 10 in said Block projected Southeaster- ly, thence in a straight line to the Southeasterly corner of Lot 6 in Block 110 Huntington Beach Tract, thence in a straight line to the Southwesterly corner of said lot, thence in a straight line to the point of beginning, ex- cepting therefrom any portion ,of any street or alley which is included within the above described district. The above description is general only. A plan, diagram or map of said district indicating by b(lundary lines the extent of the territory included in the proposed district is on file in the office of the City Engineer. Reference is hereby made to the said plat or map for fur- ther full and complete description of the said Assessmeht District. The said plat or map so on file shall govern for all details as to the extent of the said Assessment District. Section 5. Time and Place of Hearing. Notice is hereby given that on Monday the Plat day of January 1924 at 7:30 o'clock P.M. in the council chamber of the Board of Trustees located in the City Hall in the said City of Huntington Beach, any and all persons having any objections to the proposed work or improvement , or to the -6- • extent of the district to be assessed, or both, may appear before the said Board of Trustees and show cause why said proposed improvement should not be carried out in accord- ance with this resolution. Section 6., Diagram, of the Property to be Assessed. The City Engineer is hereby dii-­�cted to make a diagram of the property effected or benefitted by the proposed work or improvement as described in this Resolution of Intention to be assessed to pay the expenses thereof; which diag- ram shall show each separate lot, ,piece or parcel of land, the area: in square feet of each of said lots , pieces or parcels of land, and the relative location of the same to the work proposed to be done, all within the limits of the said Assessment District. Section 7. Public Ways. The streets, avenues and alleys referred- to in this Resolution of Intention are public ways in the said City of Huntington Beach. Section 8. Improvement Act. All of the proceed- ings for the aforesaid work and improvement shall be had and taken under and in accordance with the provisions of those acts of the Legislature of the State of California, designated as "The Improvement Act of 1911" approved April 7th, 1911, and all acts supplementary thereto or amenda- tory thereof. Section 9. Publication of Resolution of Inten- tion. The Huntington Beach News, a weekly newspaper pub- -7- i i lished and circulated and of general circulation in the City of Huntington Beach, is hereby designated as the news— paper in which this Resolution of Intention shall be pub— lished, and the City Clerk of said City is hereby directed to cause this Resolution of .Intention to be published for two (2) insertions in said newspaper in the manner and form required by law, and the said City Clerk is hereby further directed to cause this Resolution of Intention to be posted in three (3) conspicuous places in the said City of Huntington Beach, in the manner and form required by law. The Board of Trustees does not deem it advisable that the Clerk mail copies of the notice of the improve- went to owners or reputed owners , and he is not required to mail the same. Section 10. Posting Notices of Improvement.
