HomeMy WebLinkAboutCity Council - 430 RESOLUTION OF INTENTION NO. 430 A RESOLUTIO14 OF THE BOARD OF TRUSTEES OF THE CITY OF' HUNTINGTON BEACH, CAL- IFBRNIA, DECLARING ITS INTENTION TO ORDER THE PAVING AND OTHERWISE IM- PROVING OF ORANGE AVENUE IN SAID CITY OF HUNTINGTON BEACH FROM THE NEST CURB LINE LAKE AVENUE TO THE SOUTH- EASTERLY PROPERTY LINE OF TWENTY THIRD STREET; DECLARING SAID WORK OR IMPROVE- MENT TO BE OF MORE THAN LOCAL OR OR- DINARY PUBLIC BENEFIT; DECLARING THE DISTRICT TO BE BENEFITTED BY THE SAID WORK ftR IMPROVEMENT AND TO BE ASSESSED TO PAY THE COST OR EXPENSES THEREOF; DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT SAID COST AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING OB- JECTIONS TO SAID WORK OR I141PROVEMENT OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BOTH. The Board of Trustees of the City of Huntington Beach, California, do resolve as follows: That the public interest and convenience requires and it is the intention of the Board of Trustees of the said City of Huntington Beach, California, to order the construction of the following described work and improvement in said City, to-wit: lst. The grading to the official grade thereof of said Orange Avenue in said City for the entire width of the said Orange Avenue from propertymline to property line together with the intersections of intersecting streets and alleys between property lines of said streets and alleys and from property line to property line of said Orange Avenue from the west property line of Lake Avenue to the Southeasterly property line of Twenty third Street excepting therefrom any of said work already done to the official grade. The grades shown on the plans, profiles and cross- sections herein referred to shall for the purpose of this resolution be deemed to be the official grades. 2nd. The paving of the raadway of said Orange Avenue in said City from curb line to curb line together with the intersections of intersecting streets and alleys between the curb lines of said intersecting streets and alleys and from property line to property line of said Orange Ave- nue from the west property line of sake Avenue to the South- easterly property-,line of 23rd Street with a pavement con- sisting of a two inch Willite plastic Composition wearing surface laid upon a three (3) inch asphaltic concrete base, excepting therefrom the intersections of said Orange Ave- nue with 3rd Street, fain Street, 5th Street, 6th Street, 8th Street, 9th Street. loth Street, llth Street, 15th Street, 16th Street, 17th Street and any of said work al- ready done to the official. grade. 3rd. The construction of the following corrugated galvanized iron half round ten (10) gauge culverts on a two (2) inch thich cement concrete base, said culverts to be fifteen (15) inches wide at the base with a five (5) inch -2- rise. Two (2) culverts as above described one of which shall be constructed and placed in said roadway with the inner edge of said culvert contiguously and adjacent to the curb line produced of 7th Street in said City on each side of 7th Street at the intersection of said 7th Street and said Orange Avenue, crossing said Orange Avenue with feeders to the same on the Easterly and Southerly corners of said Intersection as shown on the plans; two (2) culverts as above described, one of which shall be constructed and placed in said roadway with the inner edge of said culvert contigu- ously and adjacent to the curb line of said Orange Avenue produced on each side of said Orange Avenue at the intersec- tion of said Orange Avenue and 12th Street and crossing said 12th Street with feeders to the same on the Southerly and Westerly corners of skid intersection as shown upon the plans; two (2) culverts as above described, one of which shall be constructed and placed in said roadway with the Inner edge of said culvert contiguously and adjacent to the curb line of said Orange Avenue produced on each side of Orange Avenue at the intersection of said Orange Avenue and 14th Street and crossing said 14th Street -with feeders to the same on all four corners of said intersection as shown upon the plans; two (2) culverts as above described one of which shall be constructed and placed in said roadway with the inner edge of said culvert contiguously and ad- jacent to the curb line of 18th Street produced on each -3- • side of 18th Street at the intersection of said 18th Street and Orange Avenue and crossing Orange Avenue with feeders to same on all four corners of said intersection as shown upon the plans; two (2) culverts as above described, one of which shall be constructed and placed in said roadway with the inner edge of said culvert contiguously and ad- jacent t6 the curb line of 19th Street produced on each side of 19th Street at the intersection of 19th Street and said Orange Avenue and crossing said Orange Avenue with feeders to thy+ same on the Northerly and Westerly corners of said intersection as shown upon the plans; two(2) cul- verts as above described, one of which shall be constructed and placed in said roadway with the inner edge of said culvert contiguously adjacent to the curb line of 20th g y and ,� Street produced on each side of 20th Street at the in6er- section of said 20th Htreet and Orange Avenue and crossing said Orange Avenue as shown upon the plans; two (2) culverts as above described, one of which shall be constructed and placed in said roadway with the inner edge of said culvert contiguously and adjacent to the curb line of 21st Street produced on each side of 21st Street at the intersection of said 21st Street and Orange Avenue and crossing said Orange Avenue with feeders to thw same on all four (4) cor- ners of said intersection as shown upon the plans; two (2) culverts as above described, one of which shall be constructed and placed in said roadway with the inner edge of said cul- -4- • vert contiguously and adjacent to the curb line of 22nd Street produced on each side of 22nd Street at the inter- section of said 22nd Street and Orange Avenue and crossing said Orange Avenue with feeders to the same on the North- erly and Westerly corners of said intersection as shown upon the plans.. Cement concrete headwalls shall be constructed at the ends of the above culverts and feeders and at the ends of culverts now in place where and as shown on the plans and detail sheet for said headwalls. 4th1 The Construction of curbs, sidewalks and curb returns as shown upon the plan and detail sheet for said curbs, sidewalks and curb returns on both lids of said Orange Avenue and at the intersections with intersecting Streets and alleys from property line to property line from the west curb line of said Lake Avenue to the said South- westerly property line of said 23rd Street, excepting how- ever from all the Above described curbs, sidewalks and curb returns such portions of said work as may be already done to the official grade. 5th. The constructiog of an ornamental lighting system described as follows; forty two (42) ornamental single light standards fully equipped with a single light., twenty one (21) of said single light standards shall be located on the Southwesterly side of said Orange Avenue and twenty one (21) of said lights on the Northeasterly -5- side of said Orange Avenue, said lights shall be divided into two (2) circuits, onscircuit shall taRe in all lights on both sides of said Orange Avenue East of the alley run- ning Northeasterly and Southwesterly through Block 313 Huntington Beach Tract and Block 413 Huntington Beach Seven- teenth Street Section, the other circuit shall take in all lights West of said alley. The lights on the Southwesterly side of said Orange Avenue shall be connected with three quarter (3/4) inch galbanized electric conduit placed under- ground adjacent to the- curb lines, the lights on the Borth- easterly side of said Orange Avenue shall be connected with the lights on the Southwesterly side by one- (1) inch con- duit as shown on the lighting plan, said lights shall be spaced approximately -two hundred forty one and six tenths (241.6) feet apart; both of said circuits shall terminate at the pole of the Southern California Edison Electric Com- pany which is situated one and one hall (1i) feet North- westerly from the Northwesterly alley line produced in Block 313, Huntington Beach Tract, and two and one half (21) feet Southwesterly from the Southwesterly curb line of said Orange Avenue which will be -the feed-in point for said circuit,. For a more particular description of said lighting system reference is hereby made to said plan, pro- files and cross-sections of said work. The grade to which all of the above described work shall be done and improvement made, shall lie the grade as -6 shown on the plan, profile and cross-section therefor adopted by the Board of Trustees of the City of Huntington Beach, and now on file in the office of the City Engineer, to which plan, profile and cross-section reference is hereby made. All of the foregoing work is fully set forth, de- lineated and described in the said plan, profile and cross- section and specifications therefor to which reference is hereby made for a complete, full, particular and detailed description of the work. Section 2. PLANS, PROFILES, CROSS-SECTIONS AND SPECIFICATIONS. All of the said work and improvement shall be done as shown upon and according to the plan, profile and cross-section therefor Numbered New Series fifteen (15) in 6 sheets and according to specifications numbered thirty seven (37) for grading roadways and the construction of asphaltic concrete base Willite Plastic Composition wearing surpa.ce pavement, headers, culverts, headwalls, sidewalks, curbs and curb returns and specifications numbered thirty eight (38) for the construction of conduits, ornamental lighting standards lights on file in the office of the City Clerk of said City, all of which plans, profiles, cross- sections and specifications have been approved and adopted by the Board of Trustees of the City of Huntington Beach as the plans , profiles, cross-sections and specifications to be followed im making said improvement gnd by reference thereto the same are incorporated herein and made a part -7- hereof and reference is hereby made thereto for a full, complete and more particular description of said work. Section 3. The Board of Trustees also determine and declare that Serial Bonds shall be issued to represent the expense of and be secured by assessments which shall be made to pay for the cost of said work and improvement. Therefore; Notice is hereby given that serial bonds to represent unpaid assessments and bear interest at the rate of seven (7%) per cent per annum, will be issued hereunder in the manner provided by the Improvement Bond Act of 1915.r the the last installment of which bonds shall mature nine (9) years from the second (2nd) day of July next succeeding ten (10) months from their date. Section 4. DESCR.IPTION OF ASSESSMENT DISTRICT. That the contemplated work and improvement hereinbefore mentioned is, in the opinion of said Board of Trustees of more than local or ordinary public benefit and the said Board of Trustees therefore makes the expense of said work and' improvement chargeable upon the district hereinafter described, and said Board of Trustees does hereby declare said district to be the district benefitted by said work and improvement and to be assessed to pay the cost and ex- pense thereof, which district is bounded and described as follows, to-wit: All of that real property situated in the City of Huntington Beach, California , included within the following -8- • described exterior boundary lines, to-wit: Commencing at the point of intersection of the center line of Orange Avenue with the center line of Lake Avenue in said City, thence in a straight line to the most Southerly corner of lot Fifteen (15) Block three hundred and two (302) , Hunt- ington Beach Tract; thence Northwesterly in a straight line to the most Westerly corner of Lot Sixteen (16) Block three Hundred twenty two (322) Huntington Beach, Seventeenth (17th) Street section; thence in a straight line to the point of intersection of the center line of Twenty Third Street with the center line of OrangeAvenue; thence in a straight line to the most. Northerly corner of lot fourteen (14) Block four hundred twenty two (422) Huntington Beach, Seventeenth Street Section; thence in a southeasterly straight line to a point on the Southeasterly property line of Block four hundred five (405) , Huntington Beach, Main Street Sec- tion said point being distant One Hundred seventy five (175) feet Northeasterly from the most Southerly corner of said Blockr405; thence in a straight line to the most Northerly corner of Lot Twenty two ( 22) Block four hundred four (404) , Huntington Beach, Main Street Section; thence in a straight line to the Northwesterly corner of lot six (6) Block four hundred four (404) , thence along the North line of said lot 6 to the Northeast corner thereof; thence in a straight line to the most Northerly corner of lot twenty n&ne (29) Block four hundred three (403) ; thence in a straight line -9- � i to the most Easterly corner of lot seven (7) Block four hundred three (403) ; thence in a straight line to the most Northerly corner of Block four hundred tWo (402) ; thence in a straight line to the point of beginning excepting therefrom any portion of any street or alley which is in- cluded within the above described district. The above description &s general only, a plan, diagram or map of said district indicating by a boundary line the extent of the territory included in the proposed district is on file in the office of the City Engineer. Reference is hereby made to the said map or plat for fur- ther full and complete description of the said assessment district. The said plat or map so on file shall govern for all details as to the extent of the said assessment district. Section 5. TIME AND PLACE Or HEARING Notice is hereby given that on Monday, the 9th day of June, 19249 at 8:00 o' clo6k P.M. in the Council Chamber of the Board of Trusteew located in the City Hall in the said City of Huntington Beach, any and all persons having any-,objections to the proposed work or improvement, or to the extent of the district to be assessed, or both, or to the proposed grade or proposed modification of grade to which such work or improvement is to be done or made or all of them may appear before the said Board of Trustees and show cause why said proposed improvement should not be carried out in accordance with this resolution. Section 6., DIAGRA)A OF THE PROP7RTY TO BE ASSESSED. -10- The City Engineer is hereby directed to make a diagram of the property affected or benefitted by the proposed work or improvement as described in this Resolution of Intention to be assessed to pay the expense thereof. Such diagram shall show each separate lot, piece or ;parcel of land, the area in square feet of such lots, pieces or parcels of land, and the relative location of the same to the work proposed to be done, all within the lomits of the said assessment dis- trict. Section 7. PUBLIC WAYS. The streets, avenues and alleys referred to in this Resolution of Intention are public ways in the said City of Huntington Beach. Section S. I0ROVEIAENT ACT. Except as herein- before otherwise provided, for the issuance of said Serial of Bonds all/the proceedin or the aforesaid work and Improve- ment shall be had and taken under and in accordance with the provisions of those Acts of the Legislattre of the State of California, designated as "The Improvement Act of 191111, approved April 7th, 1911 and all Acts supple- mentary thereto or amendatory thereof and the said Serial Bonds shall be issued in accordance with the Improvement Bond Act of 1915 approved June llth, 1915 and all Acts supplementary thereto or amendatory thereof. . Section 9. WILLITE PLASTIC COMPOSITION LICENSE MIXTURE AGREEMENT. Reference is hereby made to the Calif- ornia Willite Road Construction Company Plastic Composition -11- License Mixture Agreement dated the 5th day of May, 1924, and on file in the office of the City Clerk of said City of Huntington Beach, and open to public inspection. Section 10. PUBLICATION OF RESOLUTION OF INTEN- TION. There 12eing no daily newspaper published and cir- culated in said City, the Huntington Beach News, a weekly newspaper published and circulated and of general circulation in the City of Huntington Beach, is hereby designated as the newspaper in which this Resolution of Intention shall be published, and the City Clerk of said City is hereby direct&d to cause this Resolution of Intention to be pub- lished for two (2) insertions in said newspaper in the man- ner and form required by law. Section 11. POSTING NOTICE OF IIDROVEMENT. The Street Superintendent of said City shall after the adoption of this Resolution of Intention, cause to be conspicuously posted as required by law along the line of said contempleted work or improvement, and along all the open streets within the hereinbefore described assessment district notices in the manner and form required by law of the passage of this Resolution of Intention and in said notice shall call atten- tion to the Willite California Road Construction Company Plastic Composition License Mixture Agreement dated the 5th day of May, 1924, and on file in the office of the City Clerk of said City of Huntington Beach, California, and open to public inspection, in manner and form required by -12- law. The Board of Trustees does not deem it advisable that the City Clerk mail copies of the notice of Improvement to ownerg or reputed owners, and he is not required to mail same. Passed and adopted by the Board of Trustees of the City of Huntington Beach, California, and signed and approved by the President of said Board of Trustees at a regular meeting thereof, held on the 5th day of May 1924.
